Title 15 of the Palo AJ to Hunicipal Code, Fire Prevention, is amended as set forth in EXHIBIT A attached hereto and made a part hereof. SECTION 2. The City Council hereby finds that the changes made to the 1973 Uniform Fire Code are neqessary to conform the code to local practices and procedures; to provi.de for current administrative enforcement practices; to continue amendments to previous editions qf the Uniform Fire Code; and to protect the public health, safety and welfare. SECTION 3. The Council finds that the changes to the Palo Alto Municipal Code set forth in EXHIBIT A have no substantial environmental impact. SECTION 4. The "Uniform Fire Code, 1973 Edit on" of the Internati.onal Conference of Building Officials and Western Fire Chiefs Association, 5360 South Workman Mill Road~ Whittier~ California 90601 is hereby adopted, including Appendices A through E, and Tables Nos. 5-A 5-B 5-C-5-D 11-A 17-A 33-A 38-Al, 42-A, and 42-B.' Whenever the phrase uuniform·fire code" appears in this code or any ordinance of the city·, such phrase shall be deemed and construed to refer and apply to the "Uniform Fire CodeJ 1973 Edition" as adopted and amended by this code. 15.04.020 Subsections (i) and (j) are a "(i) Fire and life safety plan-review of all new construction, remodels and additions. (j) Air pollution district regulations. 11 15.04. 030 Section L 202 amended. Section 1. 202 is amended to read: "Sec. 1.202 The Chief, with the approval of the City _ Manager, is authorized to make and enforce su.ch rules and regulations, policies and-departmental orders, for the prevention and control of fb:es and fire hazards as may be necessary from time to time to carry out the intent of this·code~ Three certified copies of such rules and regulations, policies and departmental orders shall be filed with tne city clerk and shall be in effect immediately there- after and additional copies shall be kept in the office of the Fire Department for distribution to the public. The procedure for the adoption of such rules and regulations. policies and departmental orders shall be as specified in Section 2.08.050 of the municipal code." · 15.04.040 1.207:-Section . rcr~nd (d) to read: ,. (c) All buildings which are deficient_ in fire and life safety measures to such an extent where in the judgment of the fire chief unusual hazards to life exist due to inadequate or unprotected means of egress; unprotected vertical openings; inadequate ons means of emergency access either in_terior or exterio.r; inadequate provisions for smoke and heat removal or ventilation; inadequate emergency lighting and other emergency power supplies; inadequate area separations, occupancy separati.ons. compartmentation walls or smoke stop partitions; lack of or· ir.tadequate fire protection equipment, fire alarm, emergency coDDD.unication systems, fire detection devices; or interior finishes, furnishings, carpeting equipment or processes not in compliance with - 2 - acceptable fire safety standards shall for the purpose of this section be declared deficient buildings . The fire chief in cooperation with the building official shall prescribe reasonable corrective measures necessary to abate the deficiencies. Abatement shall be enforced in accordance with established procedures in the uniform fire code and the Palo Alto Municipal Code. (d) Where in the opinion of-the fire chief an emergency evacuation plan will increase the· level of fire and panic safety to the occupants of astructure. the fire chief may require that such a·plan be postedin a conspicuous location and periodic drills be held. Records of such drills shall be made available to the inspecting authority upon request." 15.04.040 Section 1.215 deleted-Board of Appeals. Section 13.2nb -Is amended to rea : "Obstructing Fire Hydrants Section 13.206 (a) Whenever the chief determines that the visibility of any fire }lydrant is wholly or partially obstructed to the view of members of the fire department answering emergency fire calls, by light or sign standards, utility poles, or by similar installations on the sidewalk, street or parking, he may cause to be painted on each such obstruction a stripe, the top of which shall be not more than four feet above the surface of the sidewalk, street or parking in which such obstruction is located. The stripe shall be not over twelve inches in width and shall be of the same color as that of the fire hydrant so obstructed. (b) No person shall permit any tree, shrub, plant or other vegetation to grow or to be within a radius of three feet from any fire hydrant or permit any obstruction within three feet of any fire hydrant·when such growth, plant or thin.g so situated will in any way interfere with the view of the fire hydrant from the street and both intersections, or will interfere with or impede, in any way, the immediate and safe access to the fire hydrant. (c) No person shall in any way deface or change the established color of any fire hydrant. (d) No person shall stop, park; or leave standing any vehicle within fifteen feet of a fire hydrant and shall comply with other provisions as stipulated in the vehicle code, state of Californis." 15.04.130 Section 13.207-Hydrant Use A~~roval amended. Section 13.207-Hydrant Use Approval Is amende to read: "Hydrant Use Approval Section 13.207 No person shall use or operate any hydrant or other valve installed on any water sy~tem intended for use of the chief for fire suppression purposes and which is accessible to any public highway • alley ~r private stre2t open to~ or generally used-by the public, unless such person first secures a ~·itten permit for such use from the city water department. This section does not apply to the use of a hydrant or other valve by a person employed by, and author­ ized to make such use by, the water company which supplies water to such hydrant or other valve .-'1 . Section 13.210 Whenever any on·site fire protection facilities or accessways have been installed; as provided in this title either pursuant hereto or-prior to-the· effective date hereof, the following provisions shall be applicable. - A. Access -Obstructions Prohibited. Ho owner or lessee of the land or proprietor, partner, officer 1 director, manager or agent of any business or other activity carried on upon the land shall, after receiving notice thereof. permit or otherwise allow and no person shall cause any activity, practice, or condition to occur or exist or continue to exist upon said land which shall lessen,. obstruct· or impair the access required to be maintained. B. Access-Parking May be Prohibited. If in the judgment of the fire chief it is necessary to prohibit:vehicular parking alohg private accessways in order to keep them clear and unobstructedt he may require the oWner, lessee or the person in charge of the premises to paint the curbs red or install signs or give other appropriate --notice to the effect that parking is prohibited by the fire department. It shall thereafter be unlawful for such ownar, lessee-or other person in charge to fail to install and maintain in good condition the form of notice so prescribed. When such areas are marke.d or signed as provided herein, no person shall park or leave standing a vehicle adjacent to any such curb marking or contrary to such sign. Section 10.60.1.60 shall be applicable to prosecutions under this section. If 1.5.04.170 Subsections (d) throu 13.301. Section 13.301 is amenae (d) through (h) to read: "{d) Adequate water supply (required fire flow) judgment and reasonable working distance defined. Adequate water supply shall mean the available water flow of water which the fire chief determines is, or reasonably may be necessary, to protect any building or structure on the land to be developed against fire. Judgment shall mean the judgment of the fire chief or his appointee as provided h?rein, based upon sound fire prevention and engineering principles, which judgment shall be conclusive. _ Reasonable working distance shall mean the distance from the available water supply and shall be deemed not to exceed t!lree hundred feetexcept where in the judgment of 'the fire chief the app~ication of such .l:."ule under the circumstances would be harsh or impracti~able. (e) Facilities required, Whet\ any land is proposed to be developed in such a manner that all or a substantial part of any building or structure thereon will be in excess of the reasona,ble working distance from an adequate water supply for fire protection, the owner, developer or agent shall provide such fire protection facilities upon the land as shall be determined nece,sary under this chapter .. The fire chief may prescribe that the development include the installation of such on-site fire protection facilities as in his judgment are necessary to provide an adequate water supply arid access on the land to be developed. Such facilities including all surface access roads shall. be installed and made serviceable prior to and during the time of construction. The installation shall be at the expense of the owner or developer. All facilities required to be installed hereunder shall be approved by and meet the specifications of the fire chief as to location, size and type of materials and manner of installation. Construction shall be carried out under the inspection of the Fire Prevention Bureau. All inspection costs shall be paid by the owner or developer. (f) Adequate Water Supply. Clty hydrants shall be taken into account in determining when an adequate water supply exists with reference to a given building. Other water sources may be counted as contributing to said supply if, in the judgment of the fire chief, said source is dependable? readily accessible, adaptable to use by City equipment) and within reasonable working distance of the building or portions thereof, to be served by the source. No source on private land adjoining the land to be developed shall be considered to be readily accessible unless there shall be obtained the irrevocable and unobstructed right to use the same upon svch terms as may be approved by the fire chief. (h) Final Inspection. No final inspection under the building code as to all or any portion of the development shall be deemed completed and no certificate of occupancy or temporary certificate of occur-ancy shall be issued 11nless and until the installation of the prescribed facilities and access lvays have been completed and the final inspection approval thereof of the fire chief as provided herein, and all inspection costs paid. Such final inspection shall be conducted solely to implement the enforce~ ment of the provisions of this title and shall in no manner be deemed an assurance on the part of the city that said facilities are, or will continue to be, in good working order. " 15,04.180 Section 13.307(a) amended. Subsection (a) of Section 13.307 is amended to read: (e), "(a) Every apartment house three stories or more in height or containing more than fifteen apartments and every hotel three stories or more in height or containing twenty or more guest rooms, shall have an approved fire alarm system as specified in the fire code.11 Subsections "(e) Private fire alarm system connections -installations. The fire chief is hereby authorized to permit connections of private fire alarm circuits and systems to the city fire alarm system and to permit private fire alarm com­ panies and systems to house fire alarm equipment in city buildings in accordance with such rules and regulations as he shall prescribe in ac.cordanc.e wi.th standards of NFPA Ho. 71 and 72. (f) Permit Required. Any permit to make any such con-· nection shall be revocable and non-assignable and shall be issued upon the express condition that the permit.tee shall indemnify and hold the City, its officers 1 agents and employees harmless for any loss or ltability arising out of any failure or alleged failure of such private system, the city system or any such connection ~herewith. (g) Connection fees-service charges. Any connection fees and periodic service charges to be levied in connection therewith shall be fixed by the city council. 11 15,04.200 Section 13.315 added. Section 13.315 is added to read: "13.315 Exhaust hood and duct systems shall be protected in accordance with NFPA Pamphlet No. 96. 1971 Edition4 There shall also be provided fire extinguishers in accordance with this code. Hoods, ducts and fan housing shall be cleaned at sufficient~ intervals, not less than once each thirty days, to prevent the accumulation of grease therein." - 8 -·"" ---------------------- '·. 15,04.210 to read: •• Section 13.316 added. • Section 13.316 is added "13.316 Approved color coding of fire fighting appli­ ances~ on-site fire hydrants and sprinkler hydrants. On-site Hydrants. Painting of all on-site fire hydrants shall be done using visibility yellow to identify the hydrant. Sprinkler System Hydrants. Fire hydrants that are considered to be sprinkler system hydrants on-site shall be color coded the same visibility yellow as on-site hydrants but with their tops painted red to identify them as sprinkler hydrants." 15,04.220 to read: Section 13.317 added.· Section 13.317 is added "13.317 Access--Exterior Stairways. Exit stairways, where doors are locked to access from the exterior, and where automatic unlocking capability does not exist, such doors shall be equipped with a master key lock. Such master key to be kept on the premises in a centrally located secure location, which is immediately available to the fire department." 15,04.230 to read: Section 13.318 added. Section 13.318 is added "13.318 Key safe. Where required by the' fire chief a key safe shall be providP.d which will be immediately available to the fire department, for the purpose of obtaining those building keys deemed necessary to be kept available to the fire department. Such key safe to be equipped with a single registered key, available only to the fire department. Keys to be maintai.n.""3.d, j_.n the key safe will be determined by the fire chief for the particular facilities within the buildingt i.e.: elevator manual override key, stairtoweJ: access door key, fire alarm system keys, mechanical and air handling system keys, etc.·~ 1?,04.240 .Paragralh addJ:d to S~ction 15.103. The fee shall be based on the values in accordance\w~th the fee schedules contained in Title 16, Section 16. 04,.090 of the Palo Alto Municipal Code and shall be payable to the City of Palo Alto Division of lnspectional Services." - 9 - -~----~--------------------~--~------------------------------------------------------~ • Subsection 15,04, 250 S.ubsection fa) added to Sectiqn 20.101, (a) is added to Section 20.10 to read: "(a) Liquified petroleum gas shall not be permitted within the city limits where natural gas mains exist. Upon the installation of natural gas mains, conversion from LP gas to natural gas must be made within thirty days of installation of the mains. ~fuen an area is annexed to the city and no natural gas·mains exist, the same condition shall apply, otherwise conversion from LP gas to natural gas shall be made within thirty days of annexation. EXCEPTION: Installation of LP gases may be permitted in the city limits if used as a means of emergency standby supply for industrial operations or used for medical, research and testing or other purposes not suited to the use of natural gas,11 15,0~.260 Section 20.102~~ amended. Subsection (a) of Section 20.102 is amended to rea : "(a) No person shall install or maintain any LP Gas container~ or operate any tank vehicle which is used for the transportation of LP Gas without a permit. Where a single container o~ the aggregate of inter­ connected containers is over one hundred twenty gallons water capacity, the installer shall submit plans to the fire chief. A permit shall not l:·e required for the installation or maintenance of portable containers of less than one hundred twenty gallon water capacity." 15.04.270 Section 20.104(a) added. Subsection (a) is added to Section 20.104 to read: "(a) Liquified petroleum gas shall not be stored or used in connection with any public assemblage unless the storage containers. equipment 1 fittings, and appliances and the placement use and operation of such equipme1~t complit;s with the suggested liquefied petroleum gas · safety orders of the State of California Department·/ of. Industrial Relations, Division of Industrial Safety." 15,04.280 Section 26.102(b) am~ndeq. Subsection (b) of Section 26.102 is amended to read~ (k) "(b). Decorative material. . All drapes, hangings,., curtains, drops and all other decorative material, , including Christmas tre.e..s, ..that would tend to i.J::a.creas·e the fire a~d panic hazard shall be-made "from non.:flatmnable material r .;or shall be treated and maintained in a flame retardant'' condition by means of flame retardant solution or process approved by the Fire Marshal. Exit doors, exit lights, fire alarm sending stations, wet standpipe hose cabinets, and fire extinguisher locations shall not be concealed or obstructed by any decorative material." Subsections 11 (k) Loose St:!at;lng Arrangement. Occupancies having a seating capacity of ten or more loose, folding chairs, or other similar facilities, that are not fixed to the 10 .. ., . floor shall not have more than six intervening seats between any seat and the nearest aisle. The spacing of rows of seats from back to back shall be not less than thirty-three nor less than twenty­ seven inches plus the sum of the thickness of the back and inclination of the back. Seats or benches without backs shall be spaced not less than twenty-six inches from the back of the seat to the back of the nexc seat behind it. When bench type seats are used a minimum of eighteen inches of width shall be provided for each seat. (1) Special provisions for handicapped persons. Spaces for wheelchairs. Every place of public assembly, as defined by this code, shall provide in any seating arrangement, _space for individuals in wheelchairs.
