Chapter 16.08, Plumbing Code; of the Palo Alto Municipal Code is amended as set forth in EXHIBIT A attached hereto and made a part hereof by reference. SECTION 2. The City Council finds that the changes made to the uniform~. plumbing code are necessary to conform the code to local practices and procedures; to provide for current administrative enforcement practices; to continue amendments to previous editions of the plumbing code for which no findings need be made; to provide for matters not covered in whole or in part in the uniform plumbing code; and to protect the public health, safety ar,d welfare. - SECTION 3. The Council finds that the changes to the Palo Alto Run!cipal Code set forth in EXHIBIT A have no slmstantial environmental impact. SECTION 4. This ordinance shall become effective upon the expiration of thirty days from its passage. The Uniform Plumbing Co e, 73 E ition 1nc u 1ng a appendices, promulgated by the International Association of Plumbing and Mechanical Officials Association 1 5032 Alhambra Avenuei Los Angeles 1 California, 90032 which regulates the installation, alteration, repair, removal, conversion, use and maintenance of plumbing, gast swimming pools, drainage systems and other similar work and provides for the issuance of permits for the doing of such work, is hereby adopted and by this reference made a part of this municipal code with the same force and effect as though se~ out herein in full. Tnree copies of the uniform plumbing code are on file for public inspection in the office of the city clerk, 16.08.020 Short title. In this co~e or any ordin~nce of the city where the pfirase rruniform plumbing code" or "plumbing code" appears, such phrase shall oe_ deemed and considered to refer and apply to the uniform plumbing code which is described and referred to in Section 16.08. 010', · 16.'08.030, Alplica-tion and scope. The provisions of the unifonn plumbing code shs 1 apply to all new construction, relocated buildings, and to any alterations, repairs, or reconstruction except as provided for otherwise in this code. 16.08.040 Administrative authority and duties. Whenever the term 11 administrative authority" is used in this code -it-'shall be construed to mean the building official or his authorh;ed representative. The building official shall maintain puhlic office hour·~ necessary to efficiently administer the provisions of this code and amendments thereto and shall perform the following duties: EXHIBIT A - 1 - J (1) (2) (3) (4) (5) (6) (7) (8) (9) • Require submission of, examine and check plans and specifications, drawings, descriptions, and/or diagrams necessary to show clearly the character, kind and extent of work covered by applications for a permit and upon approval thereof shall issue the permit applied for. , Keep a permanentJ a~curate account of all fees for permits issued and other monies collected and received as provided by this code~ the names of the persons upon whose account the same were paid, the date and amount thereof, together with the location or premises to which they relate. Administer and enforce the provisions of this code in a mannar consistent with the intent thereof and shall inspect all plumbing and drainage work authorized by any permit to assure compliance with provisions of this code or amendments thereto, approving or condemning said work in whole or in part as conditions require. Issue upon request a Certificate of Approval for any work approved by him. Reject all work done or being done or materials used or used or·being used which do not in all respects comply with this code and amendments thereto. Order changes in workmanship and/or materials essential to obtain compliance with all provisions of this code. Investigate any construction or work regulated by this code and issue such notices and orders •. Keep a complete recQrd of all the essential transactions of his office. Transfer all fees collected by ~im to the proper authority pr.ovided by law to'receive such funds. 16.08.050 Right of entri. The building official and his official representatives Shall carry proper credentials of their respective office~ upon exhibition of which they shall have the right of entry, during usual business hours~ to inspect any and all buildings and premises in the performance of their duties. (b) Whenever-brought to the attention of the department having jurisdiction that any unsanitary conditions exist or that any construction or work regulated by this code is - dangerous, unsafe, unsanitary, a nuisance or a menace to life,-health or property or otherwise in violation of this code,the said department may request an investigation by the building official who, upon determining such information to be fact, shall order a.uy person, firm or corporation using. or maintaining BnY such condition or responsible for the use or maintenance-thereof to discontinue the use or maintenance thereof or to repair, alter., change, remove or demolish same as he may consider necessary for the proper protection of life, health or property and in the case of any gas piping - 2 - J \. or gas A~~liance may order any person~ firm or corporation~ suppLying gas to such piping or applianc~ to discontinue sup~lying gas thereto until such piping or appliance is made safe to life 1 health or property. (c) Refusal, failure or neglect to comply with any such notice or order is unlawful. (d) When any plumbing system is maintained in violation of this code and in violation of any notice issued pur~uant t~ the provisions of this section or where a nuisance exists in any building or on a lot on which a building is situated, the building offj~ial shall institute any appropriate action or proceeding in any court of competent jurisdiction to prevent, restrain, correct, or abate the violation or nuisance. 16 08 070 Permits< 'fhe issuance or granting of a permit or approval of plans and specifications ~1 not be deemed or construed to be a permit for, or at! approval of, any violation of any of the provisions of this code. No permit presuming to give auchority to violate or cancel the provisions of this code shall be valid 3 except insofar as the work or use which it' authorized is lawful. The issuance or granting of a permit or approval of plans shall not prevent the bui.iding official from thereafter requiring the correction of errors in said plans and specifications or from preventing construction operations being carried on thereunder when in violation of this code or of any other ordinance or from revoking any certificate of approval when issued in error. Every permit issued by the building official under the provisions of this code shall expire by limitation and become null and void, if the work authorized by such permit is not commenced within sixty days from the date of such permit~ or if the work authorized by such permit is suspended or abandoned at any time after the work is commenced for a period of one hundred twenty days. Before such work can be recommenced a new permit shall be first obtained so to do~ and the fee therefor shall be one-half the amoul:lt.required for a new permit for such work, provided no changes have been made, or will be made in the original plans and specifications for such work; and prov:Lded, further, that such suspension or abandonment has not exceeded one year. 16. 08. 080 Permit reguired. . (a) :rt shall be unlawful for any person to install, remove, alter, repair or replace or cause to be installed, removed, altered, repaired or replaced any plumbing, gas or drainage piping work or any fixture or water heating or treating equipment in a building or premises without first obtaining a permit to do . such work from the building official. (b) A separate permit shall be obtained for each building or structure. (c) No peraon shall ~llow any other person to do or cause to be done any work under a-permit secured by a permittee except person$ in his employ. 16.08.090 Work not requiring permit. No permit shall be required in tfi~ c~se.o£ any :repair work as follows: The stopping of leaks in drains; soil, waste or vent pipe~ - 3 - • .I • • provided, however, that should any trap, drainpipe, soil, waste or vent pipe be or become defective and it becomes necessary to remove and replace the same with new material in any part or parts, the same shall be considered as such new work and a permit shall be procured and inspection made as hereinbefore provided. No permit shall be required for the clearing of stoppages or the repairing of leaks ~n pipes, valves or fixtures, when such repairs do not involve or require the replacement or rearrangement of valves, pipes, or fixtures. 16.08.100 To whom termits maa be issued. (a) No permit shal be Issue to any person to do or cause to be done any work regulated by this code, except to a person holding a Valid unexpired and unrevoked plumbing contractor license from the State of California, except when and as otherwise hereinafter provided in this section. (b) Any permit required by this code may be issued to any person to do any work regulated by this code in a single family dwelling used exclusively for living purposes, including the usual accessory buildings and quarters in connection with such buildings in the event that any such person is the bona fide owner of any such dwelling and accessory buildings and quarters, and that the same are occupied by said •Nnerr provided, that said owner shall personally purchase all material and shall personally perform all labor in connection therewith. (c) All plumbing installations or alterations thereto including equipment, piping and appliances related thereto shall be inspected by the building official to insure · compliance with all requirements of this code. 16.08.110 Ap¥lication for permit. Any person legally entitled to applyor and rccelve a permit shall make such application on forms provided for that purpose. He shall give a description of the character of the work proposed to be done~ and the location, ownership, occupancy and use of the premises in connection therewith. The building official may require plans, specifications or drawings and such other information as he may deem necessary. If the building official determiDes that the. plan$, specification~, dra~ .. ifngs, descriptions or information furnished by the applicant is in compliance with this code, he shall issue the permit applied for upon payment of the requi~ed fee as hereinafter fixed • . 16.08.120 Cost of permit (a) Every applicant fot a permit to do work regulated by this code shall state in writing on the application form provided for that purpose, the character of work proposed to be done and the amount and kind in connection therewith, together ~th such information pertinent thereto as may be ·required. ·. ' '. ,l Such l!Ppi-i~~rtt sha.l'l pay for each permit issued at the time of issuance: a fee';in accordance with the fee schedule, ~ri section (b) herein. - 4 - .. • • (b) Any person who shall commence any work for which a permit is required by this code without first having obtained a permit therefor shall, if subsequently permitted to obtain a·permit: pay double the permit fee fixed by this section for such work; provided, however, that this provision shall not app:y to emergency work when it shall be proved to the satisfaction of the building official that such work wan urgently necessary and that it was not practical to obtain a permit therefor before the commence­ ment of the work. In all such cases a permit must be obtained as soon as it is practical to do so, and if there be an unreasonable delay in obtaining such permit, a double fee as herein provided shall be charged. All plumbing and drainage systems"sfia11 be inspecte by the building official to insure compliance with all the requirements of this code. , 16.08.140 Notification. It shall be the duty of the person doing the work authorized by the permit to notify t1-te building offici.al orally or in writing, that said work is ready for inspection. Such notification shall be given not less than twenty-four hours before the work is to be fusptcted. · · ;' It shall be the duty of the person doing· the-work authorized by the permit, to make sure that the work will s~4nd the tests prescribed elsewhere in this code, before givUftg the above notification. ... 5 - • • 16.08.150 Extra instections. When extra i~spections are necessary by reason o deficient or defective work, or otherwise through fault or error on the part of the holder of the.· permit or on the part of his employees 1 only one such extra inspection shall be made under the regular fees as herein prescribed; and for each and every further extra visit or inspection for which the holder of the permit or his employees is entirely responsible, a fee of ten dollars. 16.08.160 Section 104 amended. Section 104 (definitions) of the uniform plumbing code is amended by adding: "Condensate Waste.. Waste water caused by the formation of moisture on the outside of coils or other aurfaces. " 16.08. 170 Section 107 amended. Section·.lo7 (definitions) of the uniform plumbing code is amended by adding~ "First Floor. The first floor is the ground floor, or -the slab floor on the ground or immediately above the elevation of the house drain which flows by gravity to the house sewer." 16.08.180 Section 211 Section 211 Use o honmeta ic plumbing code: "211. Use of Nonmetallic pipe (a) Nonmetallic pipe shall not be used for any above ground or underground drainage and vent systems wh2n part of the sanitary systam. ~ \' ' (b) Nonmetallic pipe for above ground chemical drainage and vent systems shall conform to the commercial standards noted in Table A and as approved by the building official. _ (c) Nonmetallic pipe shall not be used for potable water systems within a building. (d) Nonmetallic pipe for underground non-potable water systems shall not be installed below concrete floor slabs or paving unless approved by the building official. (e) Nonmetallic pipe for above ground and underground non-potable water systems shall conform to the commercial standards noted in Table A. (f) . The bu.ilding official may approve the installation of nonmetallic pipe for potable water systems when installed underground on the exterior of the building structure. 16.08.190 Table 4-3, footnote ~dded. The following footnote is addeCI to Table 4-3 (page ?+I} of the uniform plumbing code: 11 All horizontal drainage piping below the first floor, receiviJ;Lg.......t.bs-~charg;e._of :watac .Q\qset.s. shall be·not less than four inches in diameter." 16.08. 200 Section 608 _.;.. Appliances, devices, or equipment classified .as comfort cooling units of not more than. ten ton capacity may dispose of the condensate drainage into the city storm drainage system or through a system of dry wells or french drains when approved by the building official. · ·Units consisting of over-ten ton capacity may dispose of the condensate drainage into the city storm drainage system or city sanitary sewer system, subject to direction from the building official." --6 - II ' • ' • • • • 16.08.210 Section 612 deleted. Section 612 of the uniform plumbing" code Is defetecr:--For the regulation and control of industrial wastes see Chapter 16.09 of this code. 16.08;220 Section 613 Section 613 (vertLca code is deleted. 16.08.230 Subsection lOOl(a) added. Section 1001 of the uniform plumbing code is amended by adding subsection (a) to read: "(a) Hoae bib required. All commercial and industrial buildings whose building face is parallel to the city sidewalk shall have a hose bib connection installed conveniently available to accommodate persons washing building face, watering plants or wash down of city sidewalks." 16.08.240 Section 1107 amended -Cleanouts. Subsection (g) is added to Section 1107 of the uniform plumbing code to read; "(g) At a point of connection between the house sewer line and the city lateral a wye branch fitting which does not exceed forty-five degrees from the horizontal shall be installed. The cleanout riser shall be full bore cast iron and brought to grade at the proper location with respect to property line. If required a cast iron forty-five degree bend shall be installed to bring the cleanout riser to grade at the proper location. When sewer cleanouts are to be connected to existing ci~y vitrified clay lateralsr such connection shall be accomplished by using a hot poured C.P.r. joint or approved equal. Cement joints will not be allowed. A concrete cover box shall be placed over the cleanout, set to grade. This concrete box will be supplied by the sewer department at the Municipal Service Center. There will be no charge for these boxes. The removal of one square of concrete, full width of the sidewalk, shall be required where the house sewer laterals cross Wlder the sidewalk. Tunneling under the sidewalk is not permitted." · .-_-:; - 7 -
