HomeMy WebLinkAboutORD 2808----------------------------~----------------------.......................... ~ .. • -ORIGINAL ORDINANCF. · NO. zags • ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO AMENDING VARiOUS SECTIONS OF THE PALO ALTO MUNICIPAL CODE REFLECTING ADMINISTRATIVE CHAHGES .The Council of the City of Palo Alto does ORDAIN as follows: SECTION 1. Section 2.04.110(c)(2)(B) of the Palo Alto Municipal Code ls amended to read: "(B) Tie votes are 'lost' motions and may be reconsidered during the time permitted by subsection (d) hereof on motion by any member of the council votins aye or nay during the original vote. Before a motion is TJlade on the next item on the agenda, any member of the council may make a motion to continue the matter to another date. Any continuance hereunder shall suspend the running of any time ln \vhich action of the city council is required by law. 11 SECTION 2. Section 2.04.375 of the Palo Alto Hunictpal Code is amended to read: "2.04.375 Effective date. No ordinance adopted by the cour.cil shall become effective until the commencement of the tl1irty-first day after the date of its adoption, except the follm-1ing which shall be effec!=ive upon ·adoption: (1) An ordinance calling G~ otherwise rGlating to an election; (2) An improvement proceeding ordinance adopted under some law or procedural ordinance; (3) An ordinance declaring the amount of money necessary to be raised by taxation, or fixing the rate of taxation, or levying the annual tax upon property, ·Jr adopt1.ng a ·budget; _ (4) An emergency ordinance adopted in the manner provided for in this chapter; {5) An oriinance annexing areas to the city; or (6) An ordinance providing for tax ·levy or appropriation for the usual current expenses of the city. An ordinance adop~·ed after midnight but dt~r.ing a meeting which commenced that same evening $hall be c~emed to have been adopted upon the earlier of the ttY'O calendar days. Adoption of an ordinance at an adjourned meeting shall be.oeemed to be adopted upon the calendar date at which said adoption actually occurred. ' • \ SECTION 4. Section 2.-08.160 of the Palo Alto Municipal Code is-amended to read: 11 2.08.160 De artment of The department o u get an sta serv ces s a under the direction of the director of budget and staf£'$ervices who shall be accountable-to the city manager. It shall be composed of divisions.2.08.165 through 2.08.205~ inclusive~ and such others as may be delegated. In addition, he shall have such other duties as may from time to time be assigned by the city manager.11 SECTION 5. The first sentence of Section 2.08.165 of the Palo Alto Municipal Code is amended to read: uThe division of budget and resource analysis shall be under the supervision of the director of budget and · ·staff services_'' SECTION 6. Section 2.08.170 of the Palo Alto Municipal Code is amended to read~ "2. 08.170 Division of reproduction and maili!!:,g_. The division of-reproduction and mailin& shall oe under the supervision of the supervisor of reproduction and mailing who.shall be accountable to the director of budget and staff services. His duties shall be as follows; (1) He shall provide mail and messenger services for all city departments. (2) He shall administer the pneumatii.-cube system at the~civic center. (3) He shall provide offset printing and other duplicating facilities fot all city departments. (4) He shall perform such other duties as may be required. (":) He shall provide periodic reports to the director of budget and staff services which summarize performance, present position~ and planning for the division~ and provide such special reports as may be required from time to time. " SECTION 7. The flrst sentence is amended and subsection (10) is adaed to Section 2.08.180 of the Palo'Alto Municipal Code to read: "The division of purcha&M and stores shall be under the supervision of a director of purchasing services who shall be accountable to the director of budget and staff services. (10) He shall provide periodic reports to the director of budget and staff services which summarize performance, present position and planning for the division; and also provide such special reports as may be required from time to time." SECTION 8. Section 2~08.190 of the Palo Alto Municipal Code is amended to read~ "2.08.190 Division of building maintenance. The division of building maintenance services shall be under the supervision of a director of building and equipment services who shall be accountable to the director of budget and staff services. His duties shall be as follows: - 2 - ~; . . • (1) He shall maintain and operate the physical plant of the municipal service center regarding the assignment of space~ the maintenance of the buildings, and the recommend­ ation of such rules and regulations as are proper for the efficient use of the faci.lities of the municipal service cet&ter. (2) He shall be responsible for and direct the maintenance of all public structures owned or operated by the city, and shall establish a maintenance program. :f.ncluding janitorial services, security and safety~ for the upkeep of all public structures owned or operated by the city) and shall report the conditton of such structures. (3) He shall periodically report to the director of budget and staff services summarizing performance, present position and planning for the division and provide such special reports as may be required from time to time. (4) He shall perform such other duties as may be required of him. 11 SECTION 9. Section 2.08.195 is added to the Palo Alto Municipal Code to read: 11 2.08.195 Division of eguipment maintenance. The division of equipment maintenance shall 'be under the supervision of the director of building and equipment services who shall be accountable to the director of budget and staff services. His duties shall be as follows~ (1) He shall operate the city garage and machine shop keeping a record of 'the work performed by those sections for other departments of the city. He shall recommend a schedule of rates for such services rendered by these sections. (2) ~e shall keep the operating records of all motorized equipment used or operated by the city and recommend interdepartmental charges, if any 1 for such equipment as may be used by the several departments. (3) He shall coordinate the needs of the several depart­ ments into the overall requirements of the city for motorized equipment, (4) He shall re_commend rules and regulations governir\,g the u-e.e .Q.Qd car-e o£ mecnariical equipment-used 'by ·the var"ious departments of the city. (5) He shall provide periodic reports to the director of budget and staff services which summarize performance1 present position and planning for the division, and provide such special reports as may be required from from time to time. (6) He shall actively supervise a preventive m~intenance program for all mechanical equipment oWned or operated · by the city~ (7) 6e shall perform such other duties as may be required of him." - 3 - • • SECTION 10. The first sent~nce and subsections (1), (4) and (9) are amenoed and subsection (10) is added to Section 2.08.200 to read: 11 The division of cormnunications shall be under the supervision of a director of communication services who shall be accountable to the director of budget and staff services. (1) He shall coordinate the telephone service provided for all city departments. (4) He shall provide and maintain special communications services including but not limited to sound equipment, audio-visual aids, inter-office communications, and centralized dictation equipment. He ~all ~ custody of such equipment which shall be available for use by city departments. (9) He shall provide periodic, reports to the director of budget and staff services which summarize performance, present position, and planning for the division; he shall also provide such special reports as may be required from time to time. (10) He shall perform such other duties as may be required of him". · SECTION 11. Section 2. 08.203 is added to the Palo Alto Municipal Code to read: -- "2.08.203 Division of real estate. The division of real ~tate shall oe under the supervision of the administrator of real property who shall be accountable to the director of budget and staff services. His duties shall be as follows: (1) He shall obtain and secure all easement titles and leases on behalf of the city. (2) He shall negotiate for the purchase or disposition of real property on behalf of the city. (3) He shall manage all property owned by the city and leased to other persons or agencies. (4) He shall provide periodic reports to the di.rector of budget and staff services which summarize performance, present position and planning for the division; he shall also provide such special reports as may be required from time to time. (5) He shall perform such other duties as may be required of him." SECTION 12. The first sentence and subsections fl) (5) and (6) are amended. subsection (9) deleted and subsections (iO) through (12} renumbered to be (9) thro 1~gh (11) of Section 2. 08.240 of the Palo Alto Municipal Code and shall read: "The department of public works and engineering shall be under the direction of the director of public works- city engineer who shall be accountable to the city manager. (1) .' He will formulate and reconnnend policies and procedures for· the planning, design, construction, maintenance, .repair, and improvement of all public works facilities and places owned or operated by the-C.i..t:v 0:-exc.ep..t.._.as otherwise provided in this code, and. shall administer s~ch polici.~s !Jnd procedures when approved 4nd shall conduct such activities for the city. - 4 - • • (5) He shall inspect all construction work done by or for the ~ty and require compliance with all contracts made in connect1on therewith. All progress payments of construction work done for the city, and filing of notices of completion thereof with the county recorder and the city controller shall be subject to his approval. (6) He shall direct the activities of the manager of public works engineering, superintendent of parks, and superintendent of public works and act in tb~capacittes in all matters req'li:ced of those positions. (9) He sh311 be responsible for maintaining all markings for. traffic control painted or placed upon the streets or curbs. (10) He shall operate such equipment as i.s necessary for the fulfillment of his function. (11) He shall recommend a schedule of fees and rates to be charged for services performed by his department. (12) He shall perform such other duties as may be required of him." SECTION 13. Section 2.08.250 of the Palo Alto Municipal Code is amended to read: 11 2. 08. 250 Delartment of util i-~_-l.es. The department of utilities sfia I be under. thE:: tlirection. of a director of utilities who shall be accountable to the city manager. His duties shall be as follows: (1) He shall plan, direct and coordinate the operations of the city's utilities department consisting of electric, water, gas and sewer distribution syrtems, a sub-regional ~ter quality control plant and the customer services division, (2) He shall work with utilities department management personn~l in interpreting policies of the city council and city manager, establiDhing department priorities, ~nito~iqg department performance, identifying action which will increase the department's level of performance, and coordinating utilities department activity with other city departments. (3) He shall participate as a member of the city manager's management team, to review and .elp develop overall approaches to city problems and priorities. (4) He shall establish and maintain a good working relationship ~"ith the. city council and council committees on matters relating to utilities department activities in order to gain maximum cooperation and assistance. (5) He shall coordinate the forcasting of Palo Alto's long-r4nge utility needs and develop plans to insure that the .city will be able to meet servic~. operating and financial requirements. - 5 - • • • • (6) He shall be responsible for the collection of refuse and garbage in the city. (7) He shall negotiate with water, gas and electric power producers to meet existing and future supply requirements at the lowest possible cost, searching for new sources of utility supply to insure that an adequate supply will be maintained in future years. (8) He shall perform such other duties as may be required of him.0 SECTION 14. The first sentence and subsections (5), (8), (10) and (11) of Section 2.08.260 of the Palo Alto Municipal Code are amended to read: 11 2.08.260 Office and duties of the manager of customer service-city treasurer'. The OI:'fice ana duties of the city treasurer shall be under the direction of a manager · of customer service-city treasturer who shall be accountable to"the director of utilities. (5) He shall render to the city controller both a daily report and a monthly report for submittal to the city manager as to the status of all moneys, securities, accounts receivable and collections thereof for which he is responsible. (8) He shall undertake assignments relating to the business and customer service function of the municipal utilities. (10) He shall administer the parking enforcement program. (11) He shall keep and maintain appropriate files and records for the accomplislunent of all functions.11 SECTION 15. The first two sentences are amended and subsection (7) iteieteCI and subsection (8) renumbered to r·ead (7) in Section 2.08.215 of the Palo Alto Municipal Code to read: "2.08.275 Community service de~artments. The community service departments shall be un er the direction of the assistant city manager who shall be accountable to the city manager. His duties as they relate to the community service·. departments shall be as follows: (7) He shall perform such other duties as may be required of him." SECTION 16. The first sentence and subsection (8) of Section 2.08.36\J of the Palo Alto Municipal Code are amended to read: "2.08.300 Division of inslectional services.
