AMENDING SECTION 16.48.020 Of' THE PALO Al.'l'O MUNI
CIPAL CODE RELATING TO THE: JURISDICTION OF THE ARCHI.
TECTURAL REVIEW BOARD AND TilE PLANNING COMlHSSION
The Council of the City of Palo Alto does ORDAIN as fol~
lows:
SECTION 1 Section 16.48.020 of the Palo Alto Municipal
Code IS:amended to read as follows:

Trt1e 16 o this code shall be issued except after approval
of the design of th~ project by the architectural review
board or the city council, as the case may be, in com
pliance with this chapter. Public property and projects
are subject to the requirements of this chapter. This
chapter shall apply to all new construction in the city,
including paved areas, and all other exterior work and
signs which require a permit from the city. Singly
developed single family dwellings and duplexes, and
additions thereto, are exempt from this chapter. All uses
in the "O-S" district, except one-family dwellings and
accessory buildings and accessory uses, are subject to the
requirements of this chapter. The director of planning,
building official, and zoning administrator shall have
discretion to submit applications for fences, variances
and use permits to the arohitectural review board when
in their judgrne.nt a significant effect. upon the aesthetic
character of the city or the area affected may be caused
thereby.
(b) Applications, including all plans, drawings,
maps, and sketches, for approval of any 11 P-C 11 district,
for design approval of any district.,which is combined
with a "-D" district, or for design approval of gasoline
service stations pursuant to Chapter 18.82 as required in
C-1, C-2:GSC, C-J:GC, M-1 1 M-2, L-M, L-M-1, .:md L-.H-5
districts, and for approval of any development, construc
tion, or improvements in any 11 0-S" district, except
one-family dwellings and accessory buildings and accessory
uses, shall be initially review~d by the planning commis
sion for conformance with the requirements of this code
for which the planning commission has advisory authority,
then acted upon by the architectural review board as
provided in this chapter, which action shall be a final
reconuneitdation for the purposes of this chapter, and then
acted upon by the planning commission pursuant to the
provisions under which the application wa·s brought for
final recommendation to the city council.
(1) In the event the planning co~~ission at its
initial review recommends denial of the application,
such recommendation shall be forwarded ~directly to the
city council, and the architectural review board shall
take no action on the application except as may be.
directed by the pity council.

, (2) In the event of a difference between the
action of the architectural review board and the
planning commission, the board and the ccrrunission
shall attempt to resolve such difference prior to
the commission making a final recommendation to the
city councilt by means which may include a joint
meeting, according to joint rules which may be
adopted by the board and the commission. If the
difference is not resolved, then the separate
recomr1.endations of each body, together with the
minutes of their respective meetings or of the
joint meeting, shall be transmitted to the city
council.
(c) Where the time for action upon any application
which·rnust be approved pursuant to this subsection is
prescribed in this code or any other provision of law,
such time period shall conunence to run as so prescribed.~~
SECTION 2. The Council finds that the enactment of this
ordinance will have rio significant environmental impact.
SECTION 3. This ordinance shall become effective upon
the commencement of the 31st day after the day of its passage.
