ORDINANCE OF THE COUNCIL OF.TI:.;:; CITY OF PALO ALTO
AMENDING CHAPTER 9.14 OF THE PALO ALTO MUNICIPAL
CODE RELATING TO SMOKING
The Council of the City of Palo Alto does ORDAIN as fol
lows:
· · SECTION l. Chapter· 9.14 .of the. 1:1a1o Alto .MWlicipal Code...
is hereby amended to change the title thereof from "-NONSMOK'tNG
SPACE IN MOTION PICTURE THEATERS" to 11 SMOKING REGULATED OR
PROHIBITED".
SECTION 2. Section 9.14.020 of the Palo Alto Municipal Code
is hereby amended to read:
"9 .14. 020 _·_ Prohibi tiolt.,o·f: smokin9 •.. Smoking
is hereby prohibited: ·
-"(a) .. Elev&tors •. Within elevators in buildings
generally used ·hy and open to the public.
"(b). Public. meetings. In-hearing rooms,
chawbers, or.places of public assembly in which
public business is conducted 1 : ·requiring or pro
viding direct participation or. observation. by the
general }:"\1'-u1.ic, while a public meeting .is in
progress.
"(c) .. '!'heaters. Withln every .publicly or
privately Ow-n~d building or enclosed facility
open to the general public for the primary. pur•
pose of exhibiting.any motion. pictu~e, stage
drama,· musical recital, or. any other performance,
in any. area other than·.that. commonly known as the
· · lobby & Every _theater owner or manager shall post
signs. C1onspicuously in the lobby ·thereof .st-ating .
that smoking is· prohibited· wi th·in: the auditorium,
and in. the case of motion. picture theaters,. such .
information shall· be shown· upon .the screen for at
·least five· seconds· prior· to the: showing of e.1.ch
· feature motion pictureo 11
SECTION 3. Section 9.14.030 of the Palo Alto Municipal
Code Is hereby amended to read:
"9 .14~ 030 Hospitals and health .care
facilities.
"(a) In public areas of health care
faciliti~s and hospitals, as defined in
Section 1250 of the California Health and
Safety Code, inc~uding waiting rooms, public
hallways and lobbies, except in specially
designated. smoking· areas_., which may be all or
part of a public a.rea_,all smoking is prohibited.

"(b) Every publicly or pr.ivately owned
health care facility, including hospitals,
shall make a reasonable effort to determine
preference and to assign-patients placed in
bed apace utilized for two or more· patients
according to the patient's individual non
smoking or smoking. preference.
''(c) In bed space areas utilized for
two or more patients, smoking shall be pro
hibited for hospital 9taff, visitors, and the
general public. "STAFF AND VISITOR SUOKING
PROHIBITED" signs shall be conspicuously
-posted in such bed space areas. 11
SECTION it. Section 9.14. 040 of the Palo Alto Municipal
Code is hereby amended to read:
"9 .14. 040 .... Posting. ;of·.,si·gns:~required .-.
. Except.where other signs are required, when
ever in this code smoking· is prohibited, ·
conspicuous signs shall be posted so stating,
containing all capital lettering not less than
one inch in heiyht, on a contrasting background.
Said signs shall· be placed by the· owner,
operator, manager, or other persons having
control of· such· room·,· b\lilding, · or other place
where smoking. is prohibited.n
SECTIONs. Section 9.14.050 is-hereby.added to the Palo
Alto Municipal Code to read:
"9.14.050 .. Violations:.to·.~be: ... infractions·.·
Violation .of any. provision of· this.· Chapter . ·
shall be an: infraction-, punishable· .as provided
in this code. n
· · · SECTION 6. The Council finds that 'the .passage --.of ,this
ordinance will have -no significant' environrumtal. dmpact.
SECTION 7. This ordinance· shall··become: !effecbive upon
the commencement ·of the thirty-first day after the day of its
passage.
