HomeMy WebLinkAboutORD 2754......................................... ,~ ............................ .. .. • • ORIGINAL ORDINANCE NO. 2754 ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO AMENDING CHAPTER 4.10 OF THE PALO ALTO MUNICIPAL CODE CONCERNING PEDDLERS AND SOLICITORS The Council of the City of Palo Alto does ORDAIN as fol- lows a SECTION 1. Section 4.10.040 of the Palo Alto Municipal Code hereby is amended to read as follows: "4.10.040 License fees for solicitors and peddlers. The fee for a-r!Cense for soliciting or pedaling shall be five dollars per day, thirty dollars per quarter, or one hundred dollars per year. Additional licenses may be issued to employees of a licenseholder on the payment of five dollars per year for each employee after approval and investigation by the chief of police. 11 SEC~ION 2. Section 4.10.055 hereby is added to the P.alo Alto Municipal Code to read as follows: "4.10.0~5 Identification cards for solicitors and Ieddlers. (aJ · Contents. Tfie hoiair of any pedd er or solicitor license shall furniPh each person engaged in the licensed activity with a suitable identification card or badge. The cards or badges shall con.tain such information as the chief of police d~e~ necessary, but shall include at least the followings (1) The name of the licensee •. (2) The n~e of the main licen"ehqlder, if different~ (3) The natu~e of the licensed activity. (4) The product or eerviae being peqdled or solicited. (b) · ,Acts. r~guireQ,. Such cards or badges sh~ll be prodQoea-O:n demand of the chief of police. or any memb~r of the police department, Iw~ediately prior to eaoh peddling or solicitation activity,. every peraon lipensed as a peddl•r or solicitor shall do all o; the following ~n ~~e order prescribed; ·. 't (1) Present h~~ identificatiqn card or badge to th• pqt-nti•+ oust~r, (2) Request that-the pot.en~ial cuat;om•r re!ld the iCient.ifica.tion card or badg~. · (3) Info~ the po~ential customer in clear lanq~age of th~ n~ture and purpose of the visi~." SECTION 3. section 4.10.090 hereby is added to the Palo Alto Muniaipa~ COde to read as follows& • "4.10,090 License exemltions. shall be required of the fol ~lng: • No license (1) Any person who peddles to, or solicits orders from, a regularly established business in the city; provided, however, that the product or service sold must be for resale or use in the business. (2) Any person who peddles or solicits orders for fresh food products of tarm or garden grown by himselfo {3) Any person who solicits orders for newspapers to be delivered personally by himself on a regular route to customers or subscribers. (4) Any person entitled to a license exemption under chapter 4.04 of this title." SECTION 4. Section 4olO.lOO herety is added to the Palo Alto Municipal Code to read as follows: "4$10;100 Fee exemptions. In order to claim a license fee exemption as a veteran, as specified in sections 16001 and 16001.5 of the Business and Professions Code of the State of California~ or any license fee exemption required by state or federal law, the applicant shall file with the city treasurer an affidavit or a declaration under pen­ alty of perjury, on the form provided by him, es­ tablishing the facts entitling the applicant to such fee exemption" The treasurer may require proof of such facts.
