Z?34 ----- ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO AMENDING VARIOUS SECTIONS OF' TITLE 18 (ZONING) OF THE PALO ALTO l1UNICIPAL CODE TO DEFii'i.:.; VARIOUS TYPES OF CHILD ~~RE FACILITIES, TO CHANGE THE FEE FOR A USE PEHN.IT FOR FAMILY DlW CARE HO:f\1ES (7 TO 10 CHILDRENj 1 AND TO REMOVE THE REQUIREMENT FOR A USE PE~~I~ FOR DAY CARE H0t-1ES ( 6 OR FEWER CHILDREN} The Council of the City of Palo Alto does OPnAIN as follows: SECTION lo Section 18,04-144 is hereby added to the Palo Alto Municipal Code to read: "18,04,144 Da~ care center, The term "day care center" shall mean a facility-IICensed by the State of California intended or used for day care purposes for more than ten children" Thi~ term includes nursery schools, pre-schools and similar type facilities." Subsection (a) of Section 18.12.030 of the Palo Alto Nunicipal Code is hereby amended to read: "(a) Private schools which offer instruction in the several branches of learning and study required to be taught in the public schools by the Education Code of the state of California, family day care homes, day care centers and private nonprofit recreation areas." SECTION 6. Subsection {a} of Section 18.14.030 of the Palo Alto Municipal Code is hereby amended to read: "(a) Private schools which offer instruction in the several branches of learning and study required to be taught in the public schools by the Education Code of the state of California, family day care homes, day care centers and private nonprofit recreation areas." SECTION 7. Subsection {b) of Section 18.20.030 of the Palo Alto Municipal Code is hereby amended to read: "(b) Private schools which offer instruction in the several branches of learning and study required to l.>e taught in the public schools by the Education Code of the state of California, family day care homes, day care centers and private nonprofit recreation areas." SECTION 8. Subsection (c) of Section 18.24.030 of the Palo Alto l-iunicipal Code is hereby amended to read: "(c) Private schools which offer instruction in the several branches of learning and study required to be taught in the public schools by the Education Code of the state of California, family day care homes, day care centers and private nonprofit rec1·ea tion areas. " SECTION 9a Subsection (a) of Section 18.90.040 of the Palo Alto Municipal Code is hereby amended to read: n (a) '~!"'or z,.· use pernii t: $100.0 0, except that thE:: fee for an application for a family day care home shall be $25.00." SECTION 10. Section 18.88.050 of the Palo Alto Municipal Code is hereby amended to add subsection (d) to read: c' (d) . This ordinance shall become effective upon the expiration of thirty days from its passage.
