HomeMy WebLinkAboutORD 2745... • • • ORDINANCE NO. 2745 ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO AMENDING VARIOUS SEC'rlONS OF '.C!TLE 18 OF THE PALO ORIGINAL ALTO MUNICIPAL CODE (ZONING) TO PROHIBIT CONVERSION OF RESIDENTIAL PROPERTY TO OFFICE OR BUSINESS USES IN R-3-P AND R-4 ZONES, TO ESTABLISH A 50-FOOT HEIGHT LIMIT, AND TO CHANGE REQUIREMENTS FOR POSTING AND MAILING NOTICE OF CERTAIN HEARINGS The council of the City of Palo Alto does ORDAIN as followR: SECTION 1. Section 18.22.140 is he!eby added to the Palo Alto Municipal Code to read: "18.22.140 conversion of-residential proeerty prohibited. Notwithstanding any other·provision of th~s code,·no property, structure, or portion thereof, last used for residential dwelling purposes, shall be used for or converted to any commercial, business, ur office use otherwise permitted under this chapter ... SECTION 2. section 18.24.110 of the Palo-Alto Municipal Code is amended to read: "18.24.110 Building height·limi.t. Building height limit in the·-R-5 district shall be--fifty feet." SECTION 3. Section 18.26.120 of the Palo Alto Municipal Code is amended to read: 11 18.26.120 Building height limit. Building height limit in the R-4 district shall be fifty feet." SECTION 4. Section 18.26.140 is hereby added to the Palo Alto Municipal Code to read: "18.26.140 9onversion·of~resi~~tial pro~erty prohibited. SECTION 5. Section 18.32.060 of the Palo Alto Municipal Code is amended to read: "18.32.060 Maximum·building.height·and coverage. Building coverage mus~ be such that the total floor~ area does not exceed that allowed in the most restrictive-abutting district, provided that no building sha~l exceed fifty feet in height. An increase of building height over · fiftY feet may be approved by the City Council whenever each of the requirements of Chapter 18. 82 have. ·been met. er ... ... - 1 - •• ~,., Sf;C'rlON 6. .tic:n 18.34.110 of the Pa.Alto Nunicipal Code is amended to read: "18.34.110 Building haiqht limit. No building in the HDA district shall exceed fifty feet in height ... SECTION 7. Section 18. 40 .• 0 80 of the Palo Alto Municipal Code is amended to read: "l8.40~cao Building height limit. No building in the c-2 district shall exceed fifty feet in height.~ SECTION 8. Section 18.48.060 of the Palo Alto Municipal Code is amended to read~ "18.48.080 Building height limit. No building in the C-2;FGM district shall exceed fiity feet in height.11 SECTION 9. Section 18.54.090{a) of the Palo Alto Hunicipal Code is amended to read: "18.54.090 Building height limit. (a) Notwithstanding any other provis1on of this chapter, no building in the M-1 district shall exceed fifty feet in height." S.EC'r!ON 10. SECTION 11. Section 18.79. 050 of the Palo Alto l-'lunicipal Code is amended to read: "18. 79.050 Maximum and minimum building heights. Building·s shall have a maximum ne~qn~ of r2r~y feet and a minimum height of thirty-five feet.» ·, SECTION 12. Section 18.90.030(b) of the Palo Alto Nunicipal Code is amended to read: "(b) A certified list as shown on the last equalized ass.essment roll of the names and addresses of all persons to whom is assessed the property and the street address and any sub addresses of each residential, commercial or industrial occupant located within a distance o£ 250 feet from the exterior boundaries of the property involved." SECl'ION 13. Failure to give such notice by mailing, or of the person addressed to receive the same, shall not affect the jurisdiction of the zoning adminis­ trator to proceed with the hearing. Such notice shall contain either the street address shown by the records of the city of Palo Alto or a legal description cf the property for which a variance or use permit is sought, notice of the time, place and purpose of the hearing, reference to the application on file with the zoning administrator for particulars, and a statement that any interested person may appear either in p•~rson 1 or by agent, and be heard. (b) -Time limit. Mailing of notice of hearing shall be comple-ted not less than ten days prior to the date of hearing~~~ SEC'.riON 14. This ordinance shall become effective upon the expiration of thirty days from its passage. INTRODUCED!
