ORDINANCE NO. 2744
ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO
AMENDING SECTION 18,08,040 OF THE PALO ALTO MUNICIPAL
CODE (THE ZONING M}.P) TO CHAL"'lGE THE CLASSIFICATION OF
PROPERTY KNOWN AS 4295 ALMA STREET FROM R-1-B-8-A TO
P-C, SUBJECT TO CONDITIONS
The Council of the City of Palo Alto does ORD~IN as follows:
SECTION 1. Section 18.08.040 of the Palo Alto Municipal
Code, the "Zoning Map," is hereby amended by changing the zoning
of certain property known as 1295 Alma Street from R-l~B-8-A to
P-C. Said property is shown on a map attached hereto, incorporated
herein by reference and entitled 11 Change of District from R-1-B·S-A
To p ... c".
SECTION 2. The diagrams attached hereto, entitled "Development
Plan, Scheme B," are incorporated herein by reference. Said
Development Plan is approved pursuant to Section 18.68,070 of the
Palo Alto Municipal Code, subject to the following conditione:
A. Usea
34 total units of which 26 shall be market-priced living
units and B shQll be offered for sale to households of
moderate income by tha developer in cooperation with the
City or the City's designated representative who will
assist the developer in the qualification of buyers.
All of the units sold to moderate inoorn~ ~uyers are
hereby made subject to 4 right of first refusal to
purchase such unit o~ un~ts vested in the City of Palo
Alto or e;ny governme~tal or nor1p:rofi t organization
designated by the City of Palo Alto.
The City or its designee may assign this ri~ht to an
individual private buyer who meets the City's approved
eligibility qualifications.
Until such time as the riqht of first refusal
herein is exercised or eKpires, none of the eight
anita to be sold to moderate income buyers here
under or any part or portion thereof shall be
leased, ranted, assigned or otherwise transferred
to any person or entity, except with the express
•
written consent of the City of Palo Alto or its
designee, which consent shall be consistent with
the City's goal of creating, preserving, main
taining, and protecting housing in Palo Alto for
persons of low and moderate income.
Right of first refusal and the rental restrictions
above must be included in the deed of ownership by
the developer. The right may be exercised by the
City or its designee within 60 days of written
notice of intent to sell by the owner or written notice
of any other method or mode of termination of ownership.
If and in the event that the City or its designee
exercises its option or purchase, close of escrow of
such purchase shall be within 90 days of the opening of
such escrow. Closing costs shall be pursuant to the
custom and practice in the City of Palo Alto at the
time of the opening of such escrow. The purchase price
of such unit or units shall be fixed at the lowest
price arrived at via the follo'><~ing two methods of price
agreement:
1. The City or its designee shall have an appraisal
made by an appraiser vf its choice to establish the
market value. The owner may also have an appraisal made
by an appraiser of his choice to establish the market
value. If agreement cannot be reached, the midpoint
of the two appraisals shall be termed the market price.
2. The price of each unit shall be the base price
for which the unit originally sold, plus that amount
equivalent to the rise in the cost of living index for
the San Francisco Bay Area as determined by the u. s.
Department of Labor, Bureau of Labor Statistics.
Should the City or .its designee decide not to exercise
the above option or to sell them on the open market,
the developer shall have the right of second refusal
for acquisition in accordance with the price determina
tion rules outlined above. The developer would then be
free to sell at market rates.
B. Improvements:
1. Buildings, parking, landscaping, driveways
and all other improvements shall be substantially as
shown on the approved development plan.
~. An emergency vehicle entrance on Alma Street
shall be provided in accordance with the requirements
of the Chief of the City of Palo Alto Fire Department.
3. The driveway onto San Antonio Way shall be
constructed in accordance with the requirements of
the Director of Public Works so as to facilitate
traffic circulation and safety and to provide sidewalk
continuity for pedestrians and bicycles.
4o Developer shall offer by subdivision map and
otherwise all streets for dedication to the City.

5. Curbs and gutters shall be installed on both
sides of the street, and a four-foot wide sidewalk on
one side to city standards, both at developer 1 s sole
expense.
6. The street shall be not less than twenty-four
feet wide as measured from the back faces of the curbs, except
where shown at greater widths on the development plan.
7. Prior to issuance of building perrn.it, developer
shall obtain the approval of the Planning Commission as to
street lighting, architectural and landscaping details.
a. The wall along San Antonio Way shall be set
back three feet from the property line to permit land
scaping between the wall and the public sidewalk. Said
landscaping shall be regularly maintained, along with
all other common landscaping, by a homeowners' assoc
iation.
9. The moderate inc~~e units shall be set back
at least twenty feet from the property line.
SECTION 3, The Development Schedule for the subject property
shall be as follows=
A. Start of construction with:tn four {4) months of City
Council approval.
B. Completion of all construction and development within
one (1) year of start of construction.
SECTION 4. The proposed development is hereby found to have
no significant environmental impacto
SECTION 5, This ordinance sha!l become effective upon the
expiration of thirty days from its passage.
