ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO
AMENDING SECTIONS OF CHAPTERS 2.08, 4.041 4.18, 6.04,.
6.08, 6.12, 6,16, 6.20, 6.28 AND 6.32 OF THE PALO
ALTO MUNICIPAL CODE REFLECTING CHANGES REQUIRED BY
THE OPERATION OF THE NEW ANIMAL-SERVICES ANO PLAC~MENT
CENTER AND ADDIN~ REGULATIONS CONTROLLING DANGEROUS AND
WILD AN!MALS ·INCLUDING DOGS
The Counci-1 of the City· of Palo Alto does ORDAIN as follows·:
SECTION 1. The first paragraph of ·section 2.08.220 of the ,
Palo Alto Municipal Code is amended to read:·
n2.os.220 Animal services-divi~ion.-The animal services
division shall be under the cfa.redtion of a superintendent
6£ ani~al services who shall be accountable to the chief
of police. His duties shall be as follows: "

time by the city manager1 is hereby authorized and estahlished,.

appointed by the city manclqeJ:' shall possess while engaged
in the discharge of. their duti_es -badges plainly ·designating
their office,excep~ that wheriany policeman acts as an

(b) It shall be unlawful for any peraon:to.resist or

shall hold any stray animal lmpounaea.under the· provisicms of
this ti.tle fe>r a period of-three days ·during whic~1 time the
owner· of such animal, if known,· shall be notified by· mail,
after which time said animal may be s·old by the superintendent
as follows: · ·
(1) Notice of the time and place of· sale and ·containing a
description of the animal to be sold.must be.posted for
three· days on the bulietin board at the animal center.
(2) Sales shall be'£6r cash; at a price established by the

SECTION 8. Section 6.16.030 of the Palo Alto M~nicipal Code
is amended to read:
u6.16.030 License fee: late fee. (a) The fee for a dog
li,cense issued under this cfiapter, except as provided in
(b) below, shall be as follows;

SECTION 11. Section 6.16.070 of the Palo Alto Municipal Code
is amended to read:
"6.16.070 License fee ;;,.. Paid uJion redemption. If a license
fee has not been paid for the t en current year for any .
impounded dog, theparty redeeming must, before redemption,
pay all required license fees. . Whenever a dog is redeemed,
the party redeeming mustgive the superintendent a receipt

6_.28.010 Definitions. 'rhe following words and phrases
whenever used in this chapter are defined as follows: -
(a) 11 0e.ngerous animal" shall mean any dog or other animal
which demonstrates a propensity to assault, bite, scratch
or harass people or ot~er animals without provocation.
Any animal that bites a person shall be presumed to be
dangerous. _
· (b) 11 Wi ld Anima 1 11 sh al 1 mean anv ·exotic, venomous , non
domes tic, or untrained animal whlch because of its size,
natural disposition,. or-other characteristic constitutes a
hazard or menace to persons,or animals or is likely to damage
property. --
6.28.020 Dangerous animals at large.· It is unlawful-for
any, person ow:ning.or })aving possession, dustody, charge, -or,
control of any· dog or other animal-known by such person to
be -d~ngerous to cause or, permit the animal to run loose _

6.28.040 Pos~essing dangerous or wild animals. (a) It is
unlawful fordany.person to own or have possession, custody,
charge; or control of any elephant, bear, hippopotamus ..
rhinoceros, ocelot, lion, tiger, alligator, crocodile,
leopard, wolf, monkey, dangerous dog, or any venomous or
dangerous reptile. of any kind, 01' · any dangerous or,:. wild
animal without first obtaining a permit from the chief of
police. Any dangerous dog shall also be licensed.
(b) Applicants for such permit shall pay a permit fee of
ten dollars per animal annually.
(c) All permits provided for in this section shall be valid
for one year from the date of issuance, unless revoked as
p1"-:.'\lided in this section.
-(d) Upon receipt of an application for a' pertni t to maintain
any -of the animais._ set forth in this section the chief of
police ·may issue such _permit. if he is satisfied that such>
animal wi:l.1 be· kept in a safe, secure and hwnane fashion
and.without menacing the safety of any.person or animal or
causing_ damage_ tq property. As· a condition_ of granting
~ha permit, the chie.f of police may require ~that such
animal be pr6per1y cage,d pr tethere·a and may make and-issu_e
regulations iegi\rding.the·poSsession or maintaining of such

(e) Any permit issued under· this section may be revoked
when any provision of this·chapter ·or any .condition or
regulation issued by the chief of police hereunder is
violated, ·or when, in the 6pini0n of the chief of police,
the. sa.f.'Ct-Y~ of any pers-on or·. animal is menaced or property
is likely 'to be· damaged b~t ·the possession or maintenance

(f) This se~tlon shall hot apply to any dangerous'·'or.
wild animal caged in,~ safe and humane manner.when being
transported through the city or when such animal· is within

ing fee shall be charged to an owner or custodian.of an
animal who immediately transports such animal· to the animal
center.
The health officer or his duly authorized representative
is empowered to enter upon any public or private premises
within the city for the purpose of enforcing the provisions .
of this section; and he is empowered to call upon the animal
control officers and the police officers of the city for
assistance in enforcing such provis;tons.11
