ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO
ESTABLISHING A MORATORIUM ON SUBDIVISIONS, MISCELLANEOUS
DIVISIONS OF LAND, ZONE;CHANGES, USE PERMITS AND. THE
ISSUANCE OF BUILDING AND GRADING PERMITS IN THE CITY
OF PALO ALTO IN AN.AREA SOUTHERLY OF JUNIPERO SERRA
FREEWAY FOR A PERIOD OF SIX MONTHS DURING THE PENDENCY
OF STUDIES OF THE AREA, EX:CMP'l'ING CERTAIN CO?~STRUCTION,
AND ESTABLISHING 'AN·· EXCEPTION PROCEOUU:L
WHEREAS, the lands in the City of' Palo A.J.to located southerly
of Junipero Serra Freeway, hereinafter. called 1;The Foothills 11

possess unique charactflristics·not found in otherareas of the
City : of Palo· Al to, and
h~EREAS, the Foothills have.been the subject of.an extensive
study by th~ City's consultant, and
WHEREAS, the Foothills are designated for col'),serv . .tttion,
parks and/or open spac~ on the General Plan ·of.the ~lty of Palo
·Alto, and
WHEREAS,· the ·staff and.'-the Council of the City of Palo Alto
are studying the appropriateness of existing zoning, possible
·changes in the· existing zcning, possi.bie changes· in ''the regulations
wi thii~ existing zoning, the cre-at.'.i,on of new zones, and various
methods and means short. of the ac.l1Uisi tiory. of fee title to

WHEREAS, subdivisions, miscellaneous divisions of land,
and applications for zone changes, use permits; building permits,
and qradinq permits, or any of them, are imminent, and
·WHEREAS,-the council.finds that construction on lawful parcels
of three acres or less will not have an unusually adverse affect

upon aaid studies or upon t~e policies.of the City Council.
· NOW, THEREFORE, the Council of the City of Palo Alto does
ORDAIN as follows:
SECTION· l. For six months next fol.lowing the effective date
of this ordinance, no application shallbe accepted for subdivisions,
miscellaneous divisions of land, us~ permits, zone changes, _b1:1ildin9
permits, or grading permits for property_ not owned ~y the City o~
Palo Alto within the city limits of ·the· City of Palo Alto.lyin9

Foothills",, nor shall any of the above be granted, issued or
approved ..
SECTION 2. Any person havin~. a financial int·erest in any
parcel or qroup of contiguous parcels iri the Foothills and who
cl.aim• that, the moratorium eat:abl1shed by this ordinance creates

-ordinance creates an extraordinary hardship upon either or both;
(2) petitioner•• situation, parcel or contiguous parcels are
affected to a substantially greater degree by the operation of
this ordinance than other persons or property similarly situated
in the Foothills; ·and (3) ·an unusually adverse affect upon the
Foothills studies or upon the policies of the City Council will
not·be created_by granting the relief requested. The·burden of
proof shali be upon the petitioner.
SECTION 3. This ordinance does not appl.Y to any single family
residence existing on the ef:f.ective date hereof, or any accessory
structure thereto, to·· the extent that a building permit and such
other permits as may be reqUired, rnay be issued for modifications,

alterations and enlargemants of said building or buildings not to
exceed fifty percent of the existing squar~ footage thereof. '!'bis
ordinance does not ap~l_y to construction on any lawful parcel of
three acres or less existinq on July 6, 1971.
SECTION 4. This or.d,inance sh:i.ll become effective upon the
expiration of thirty day_~ from its passage.
