POSSESSION OF REfftDENTIAL RENTAl.. UNITS PROPOSED TO
BE DEMOLISHED
. '· The Council hereby finds that: ·'
{a) There is an acute shortage of rental housing in the
City o'f Palo Alto suitable fo~ persons of low and moderate income,
can~ing such persons to live in substandard housing lfni ts or to

(g) such demolition permits do not entitle any landlord to
greater rights to evict tenants than otherwiee provided by law,
but such permits may-be mis.understood and create the impression
among some tenants that the City is or<;lering' eviction or otherwise
reducing ri{thts that such teJ1ants.have under the law.
NOW, THEREFORE! the Council hereby ORDAINS as followf:I:
SECTION 1. Section 16.04.075 is added to· the Palo Alto
Municipal· Code to read as follows:

"Section 301 (e) added ~.-Demolition ~ermits ~
subsection (e} ·is ~dded to section Ol of the
uniform building code to read:
'(e) Demolition permits. In addition to other
n~quirernents 01 law, every person seeking a
demolition permit for a unit used for residential
rental purposes.shall furnish an affidavit.or
declaration under penalty of perjury that th..::·
unit pror9sed to be demolished is vacant, or
t:.i1at notice to 'Vacate has been given to each
tenant i·awfully in possession -thereof as re
quired by law or by :~~e. fi~rms of such tenancy.

'No work of demoliti,(:)'rt sh.all begin upon any
portion of such a unit until each and ev~ry
-portion· 'has been vadated by all tenants lawfully
in possesoion ·thereof on the date of issuance of
a demolition permit, or who may have become lawful
