HomeMy WebLinkAboutORD 2571• ..,:KJmh 66-25-70~ • Rev, -29-70 ORDINANCE NO. ?571 ORIGINAL AN ORDINANCE OF THE CITY OF PALO ALTO, CALIFCHNIA, AMENDING THE PALO ALTO MUNICIPAL CODE BY ADDING SECTION 13.12.080 TO TITLE 13 THEREOF, DECLARING NEED FOR PARKING AUTHORITY TO FUNCTION IN THE CITY OF PALO ALTO, PRESCRIBING ITS NAME, ORGANIZATION, PURPOSES, POWERS, OPERATION, MANAGEMENT AND FINANCING The Council of the City of Palo Alto does ordain as follows: SECTION 1,. Section 13.12.080 is added to Title 13 ot the Palo· Alto Municipal Code, to read: 11 13.12.080 Parking Authority. (a) Parking Authority - Need: The Council hereby declares that there is need ror a parking authority to function in the City, and that there 1a a need for the City to exercise the power o~ a parking authority. (b) Name: The name of the parking authority shall be 'City of Palo Alto Parking Authority', hereinafter referred to as 1 the Authprity'. (c) Organization: The Council hereby declares itself to be the Authority, and all of the rights, powers, duties, privileges and inununit1es, vested bylaw in the Authority, except as otherwise provided in this 6~~tion, shall be vested in the Council as the parking authority. (d) Source of Powers: This section is adopted pursuant to the municipal affairs provision of the charter of the City and the Parking Law of 1949. To the extent that any power granted to the Authority herein is adjudge.d to be a State · affair, the source thereof shall be deemed to be the Parking Law of 1949. To the extent that such power is adjudged to be a munici12al at"f'air, its source shall be deemed to be Article Xl, Section 6 of the State Constitution and said municipal att'a1ra provisions of the City charter. (e) Powers -General: The Authority shall have and m&J exercise all of the powers granted to a· parking authority by the Parking Law of 1949 •. The Authority shall also have and. may exercise the powers hereinafter enumerated in this section. (f) Method of Financi,ng: The method of f_inancing of a project may include any method authorized by the Parking Law ot 1949, by any other applicable general law, or by this Code, and may consist.or all, or any combination, or said methods. (2) A statement of the rentals or payments pro­ posed to be·made, the sources of funds therefor, and the assessment formula or formulae proposed to be applied; · (3) ·Any other· engineering or financial data required by law to sanction the levy of a legal and valid special assessment. The mailed notices of hearing shall, to the extent pos­ sible, set forth the estimated annual assessments against the parcel covered by each notice. Subsection (x) of Section 13.16.130 shall apply in the event of ~ssessment delinquencies. {h) Issuarn!e and 5~1e of Bonds: Section 33138 o:t the Parking Law of 1949 shall not apply. The Authority may issue and sell its bonds at public or private sale, at or below par, and ~t the interest rate fixed by the bid of the pur­ chaser." SECTION 2. If any section, subsection, sentence, clause, phrase, or portion of thi1g ordinance is for any ::reason held to be inva11d or unconstitutional by the decision of any court of compe­ tent jurisdiction, such decision shall not affect the validity of the· remaining portions of thi~s ordinance. The Council hereby declares that it would have adopted this ordinance and ea.ch section, subsection, sentence, clause, phrase, or portion thereof, irre­ spective ot• the· fact that any one or more sections, subsect:tons, sentences, clauses, phrases, or portions be declared invalid or \L~constitutional. ~ECTION 3.
