SE~. 37.102 COUNC~TO ADOPT RULES AND REGULATIONS
1'he City Council may by cesolut.ion adopt rulE~s and regu
lations ,governing utility ser -!ices other than comDrunication
.services in the City and the fees and charges therefor. Every
person supplied with such utility services by the City shall be
cons:i.dered as hav:Lng expressei consent to be bound by s·uch
rl;l.les and regulations.

The Council of the City o::: Palo Alto does hereby find and
dete.rmine that tht! public inte::est requires that all facilities
and wi.res used in supplying el(~ctric, communication or similar
associated service to be con:Jtructed in the City of Palo Alto
after July 1, 1965 shall be plc!Ced urtderground in o:r·der to
prom:ote e.nd preserve the healtb 1 safety and general welfare
of the public and to assure tht! orderly development of the
City of Palo Alto, The Chief tlectrical Engineer of the City
may authorize 'overhead lines fer new construction when i':l his
opinion underground ins·tallaticn in any particular instance
would nett be feasi.ble or practicable. His decision in such
matters shall be final.
SEC. 37.202 1~~ERGROUND UT:tiTl DISTRICTS ESTABLI~
The Council of the Cit:y.of Palo Alto further fi.nds and
determines that the public interest requi1.·es that the following
described areas of the City of Palo Alto as delineated wi.th
more particularity in that certain map entitled "UttdergJ:·ound
Utility District Maps~ "attached to this ordinance a.t1.d mace a
part h~eof by reference, be declared to be ;md the same are de
clared, to be and established as Underground Utility Districts
and pe. sons maintalning poles a :1d overhead lines ancli associated
overhead structures in such dis :ricts shall remove t.he same
within the period of time as in!icated:

(a) District No. 1. All lands fronting on OrE!gon
Avenue, :temoval by September 1, 1965.

Distrir.:t it shall be unlawful for any person or· utility to
er.ect, construct, use or maintain any pole, ov~~rbead line
or associated overhead struct'-lre within such Underground
Utility District.
ViolaJ:.i.on "! Misdemeanot:,. Any persort or ut:!.lity who shall
erect, construct, place, keep, rnc:intain, continue, employ
or operate any such pole or overhead linE~ or associated
overhead. structure within any Underground. Utility Dist1~ict
or shall l'teglect to take dow'r. and remove any stJCh pole!,
overhead wire, or associated. overhead stx"uctur·es within the
time designated i;n this Chap·t er or who shall otherwise fail
to comply with the provisiotts of this Ch~1pter shall be
guilty of a misdemeanor and 1.;.pon convictton thereof shall
be punishable by a. fine not to exceed $500.00. Each con
secutive fifteen (15) day pE~l iod during 'iiJhich the fail<Jre
to comply with t:he provistonE hereof shall con.stitute a
separat(: offense. Such violl.tion is likcNise hereby d·e
clared to be a nuisance and r1ay be abated by the City
Attorney in the manner provJ.ded for the abaten:,ent of
nuisances. :
SEC. 37.204 COUNCIL HAY DESIGNATE ADDITIONAL UNDER
GROUNDt[:'!LITY DISTR'LCTS -
The Ci.ty Council may from t:1Lnle to time call public hearings
to ascertain whether the public l'l·~cess ity, health or safety
requires the removal of poles and overhead lines and associated
overhead structures :from some cles Lgnated area of the City. The
City Clerk shall not:ify all affec :ed property owne1:.-s as shown
on the last equalized tax roll o:E the City and affl:!Cted utilities
by mail of the time and place of such hearings at least thirty (30)
days prior to the.date thereof.
If, after any such public h·ea:ring, t~e Council finds that
the public necessity, health and safety require su.ch removal the
Council shall, by ordinance amending Section 37.202 of thi::~.
Chapter, declare such area an Underground Utility District. Such
ordinance shall include a description of the area comprising
such district and shall fix the time wi.thin which such poles and
overhead lines and associated overhead struct''-l:res shall be re
moved and within which affected property own.el·s must be re.e1dy to
receive underground service. The Council shall allow a reason~
able time for. sut:h removal having due regard for t:he availability
of ne.:eor;.ssry labor, materials and equipment for ~:uch removal and
for the i.nstallation. of such undErground facil.iti4!S as may be
occasioned thereby.

The provisions of this Cha?ter shallnot apply to the
following t:ypes of facilities:
a. Poles used exclusively for police and fj.re alarm bo:..:es,
traffic control facilitie.s, or any similar rm.micipal equip
ment installed under the supervisi,on and to the satis
faction of the Chief Electrical Engineer of City.
b. Poles used ex•:::lusively fc•r street lighti~ng,
c. A1.1 electric distribution c r transmission system in l~xcess
of 15 kilovolts unless th(~ Chief Electrical Engineer of the
City determines that und~n·ground installation of such
transmission system is fectsible and practicable. His deci
sion in such matters sha1: be final.

SEC. 37.206 SPECIAL EXCEPTIONS GRANTED BY THE CITY
COUNCIL -
Notwithstanding any other provisions of this Chapt:er the
City Council ·may grant speci.c;l exceptions on a permanent or

us.u.al circumst:ances to any person to erect, construct, install,
maintain, use or operate IH'les ao.d overhead lines and associated
overhead struc:t·ures with'ln any Uii.derground Utility District pro
vided that priot· thereto 1::.he City Council shall have made a
finding that granting of such special exception does not violate
the general purposes of tl:-c.s Chapter, will not be detrimental
to the pu.bli.c interest, w,s·~fare, . safety, peace or health and
that .such acti.on .will not 1:onstitute a grant of special privi
lege incc.msistent with the limitations upon other properties in
the U.nde:r·ground Utility Di,.trict.
SEC. 37. 2:07 TUfE: EXTENSIONS
In t:he event that any act hereby required. by any parties
hereir. re:ferreci to cannot be performed within the tj,me herein
provided on account of s·hortage of materials, war, t:estraint by
public a-w:thorities, st:rh.~s, or by any circumstances beyond the
control c·f the: parties or-by unusual hardships, then the time
within wh:tch such acts shall be acco;nplished ::nay be extended by
the Chief Electrical Engiteer for a ~e~iod not exceeding one
year .
SEC. 37.208 NOTIFICATION TO AFFECTED PROPERTY OWNERS

Within thirty (30) d<1ys after the establishment of the
Undergrm.md Utility Dist1::-:.ct the Chief Electrical E:ngineer shall
so notify all affected uc.lities and all persons owning real
property within the affecr:ed area. Said Chief Electrical Engi
neer sha.l 1 fu.rther notify such affected property owners that
overhead polf~S, lines or .1ssociated overhead structures are to
be remove:cl al1:d that if sa Lei property o'W!'lers, the tenants or
occupants. of their proper :y desire to continue to receive
utility serv::i.ce or servic::!s they shall make .all necessary
facility changes on their premises so as to receive· service
from the utility at a n.ew location subject to the applicable
rules, rE~g·ulations and tariffs of the respecti.ve utilities 01:1
file with thE~ Public Utilitit!s Commission and the Utility Rules
and Regulations of the City of Palo Alto .
