It is the purposie of the proYisions of this Chapter to
protect and promote the p1..1blic h&llth, safety, peace·. comfort,
or general w·elf:are and specifically to provide. for the system
atic execution. of the Circulation Element of the General Plan
for the City of .Pal.o Alto, by designating the precise location
,:>f planned r·ights of. way and limiting the location of buildings
a.nd other improvement:s with res pee t to p tanned rights of way,
and to. provide an, authentic sourc£! of informatlon as to the
developmen.t of the City of Palo Alto. This division is
adopted pursu,cint to Sections 6560(1 to 65659, b1clusive, of
the C..overnme,nt Code of California and shall be cited and referred
to as the Of'fi.cial :rlan Line Regulations of the City of Palo Alto.
SEC~ 36.403 CONSTRUCTION OR ENl.ARGEMENT OF IMPROVEMENTS . PROHiiffTm -¥ •
No building~ structure:, or other improvement, shall here
after be erc:'.cted) constructed, enlarged, or pl.aced within the
1offi.cial plan lines establi.shed by this division, or amendments
t:hie:reto, exc::ept that this section shall not apply to garden and
.agricultural crop planting or ferwes and a.gricultur~tl irrigation
:systems in conne~tiot:i therewith, 1;tree:, curb, gutter and side
r..,i·alk improvE'!!Dents, public utility poles, pipelines or .a temporary
building or structure having a va:.ue of not more than i::>n:e
:thousand Dollars ($1,000). Provided, however, that pr:lor to the
constructior1 of any temporary bui:.ding or structure th~ owner
,of. the prop111!rty on which it is to be located shall execute an

SEC. 36.406 RECOMMENDATIOU TO COONCIL ,..._ ......
Afte.r rhe public hearing the Planning Commission shall subtuit
its recommendation to. the Cit:y Co;.:ncil.
SEC. 36.407 HEARING BY CI'~OUNCIL
Upon recei:pt of t:he Pla:·:ming Commiss.ion' s recommendation the
City C<>uncil shall set the m.iltter for a public hearing and shall
give nc:>tice _of s:uch hearing ln the same nianner as that provided
herein. for hearfa.tga by the Planning Commi . .ssion. After the hearing
the City Council may either reject or adopt the Official Plan
Line _as submitted. . The City Council shell not make a change in
any proposed or existing Off:ici.al Plan Ll.ne until the proposed
change has been ref erred to the Planning CO\lltliss:lon for a report
and a ·Copy of the report has been filed with the City Council.
Fail~re of the Planning Coimission to report within forty (40)
days after transmittal shall be deemed t.o constitute approval of
the change. -·

Official Plan Line Map! may be amended or rescinded in the
same m1anner as that provide(.. for their orlginal adoption.
