SEC. 17.2250 DEFINI~~ION -----

1Fireworks 11 shall mean and include any combus1:ible or
explosive cmnpocition, or an) substance or combin.at:~on of sub•
stances, or article pr .... pared for the purpose of producing a

visible or ~m· audib.le €:ffect by combustion, explosi()n, deflagrat:ion
or detonation, and-shall include blank cartridges, toy pistols,
toy cannons .• toy canes, or tcy go...ms in which explosi.ves are us~!,
the type of balloons which require fire underneath to propel
the sa.r.n.e!» firecrackers .r torpedoes, skyrockets, Romar, candles,
Daygo bombs :• sparklers, or ot :1er dev1ces of like cor._struction
and any devices containing an~ explosive or flammable compound,
or any tablets or other device containing any explosive sub
stance, exc~!pt that the term 'fireworks" shall not include
·· auto flares.~ :paper caps cont.a Lning not in excess of an average
of twenty-f::l.ve hu."ldredt::ls of 1 gram of explosive content per
cap,; and toy pistols, t':>Y can·:s, toy guns or other devices for

Except: as provided in St :ction 17.2252, it shall be unlawft1l
for any person to m.anuf~~cture, possess, store, to of::er for sale~~
expos~ fl)r sale, s:ell at ret a:! l, or use or explode any fireworks:
withiri the City of Palo Alto.
SEC. 17.2252 FIREWORRS PERl-ITS
The Chief is hereby empo;..rered to grant permits to public
and quasi-public organizations who desire to sponsor supervised
public displays of fireworks. Every such display shall be con
ducted~y a campetent operator approved by the Chief, and shall
be.so located, organized and fired in such manner as in the
judgm.ent of the Chief., after p :-oper in~;pection, will not be
hazardous to. the property or: p ~rsonal ~;afety of any person. Tht!
application for any such penni: shall be made to the Chief in
writing at least fifteen (15) days in 2ldvance of the date of thE!
display and shall contain such information as may be required by
the <..ni,~f. The Chief may attach to any permit such C·)nditions
as are in hi.s judgma:nt rt~asonal·ly necessary to effect:.utt~ the
purposes of this section. After such pri.vilege shall have b~et:l
granted~ possession and \tse of fireworks for such display shall
be l?wful for purposes of that display only. No perm:Lt granted
herel..inder shall be transf:erabh.

1'h1e permittee shall fcmish a bon<! or certificate of
insuranc•e in an amount deemEd adequate by the Chief for the payment
of all d;Uilages wh.i.ch a1.ay be caused E:ither to a person or persons
or to pr•,perty by reat;:on of the pent<itted display, &:nd arising from
any acts of the permittee, tis agents, employees or subcont:ractors.
SEC. 17.2254 DISPOSAl. OF UNFIRED FIREWORKS. 'Ill----.. --~""'

SEC. 17. ~:255 EXCEPTIONS ----
Nothing in this Chapt~~r shall be construed to (•rohibtt the
use of fireworks by r•ailroa-is or other transportatior. agenc:ies
for sign~.l purposes o:r illU1dnation or the sale or us!: of blank
_cartridges for a show or th :!ater, or for signal or ceremoniLal
purposes in athletics or s ?Orts or for use by military orll&ni-
zations.
SEC. 17.2256 SEIZURE OF FIREWORKS
The Chief shall seize, take, remove, or cause to be removed
at the expense of the owner e:ll stocks of fireworks offered or
exposed for sale, stor€d~ c:r. held in violation of this Division.
