Portel~ (203 ACA 330) at the culmination of which the District Court of Appeal affirmed the order of. the Superior Court of Santa Clar<!l County for the issuance of a peremptory writ of mandate directing the City ClE=rk to exam:l.ne the si~ttatures on said petition for sufficiency and if foun.d sufficient further direct:ing the City Council to adopt :he ordinance or submit the same t:o thE! people at a special election; and ¥1HEREAS~ the City Clerk has exantined said pet:it:ion and by her CE!rtificate filed with the City Council on J'.1ly 23~ 1962 has certified that it: is signPd by q.1alified and registE!red electors equal in number to twenty per •::e'J.tum of t.h2 vote r:asc at the last preceding general municipal election held in Ms:y 1959; NOW, I'HEREFCIRE, the Counc.il of thH City of Palo, Alto does ORDAIN' as fc,llows: ~;ection 1. Suc:'l plan may contain basic recommendations as to the dist:ribution of land use areas within the Cit:y, each logically and prop<arly related ·:o each other, standards for population distrib,Jtiott and de:n:;ity, and standards and recom­ mendations fox: cir~:ulation ro~.:ttc~s as between the various land use areas and t:hro;Jgh and arottnd the City. In addition to the· above:, the ger.t~~ral plan may cc•"l.·:ain other elements including a recre:ation plan, a transportation plant a community design plan, a housing plan and such additi.onal plans which in the C:ODID.ission' s judgn1ent relate~ to the physic.stl development of the City. The compreher.s:ive g:;:neral plan may •:omprise any~ all, or any combination of these plans. (b) the provi.sior.s of Article:s 7 and 8, ChaptE~r 3 of Title 7 of the Government Code of the s::ate of California, as enacted in 1953, as amended through 19~·9, and entitled '''Local Planning", are hereby expressly adopted as part of this Code. (c) The Planning Commission soh:~.ll annually review the General Plan and recotmnend to the Ci.ty :ouncil such extensions, changes or additions to the Plan as the Commission may consider necessary in the view cf any change in 'coJ.iaitions. (d) The General Plan shall bE! the guide for the Capita~ Improve­ ment Program insofar as said Ca?ital Improvement Program affects the ·physical development of the city. The Planning Comm:f.ssion shall submit an annual report t:> the Council rl..!gerding the Capital Improvement Program, l-1hich shall review each project fer its c:onformity ·to the !-taster Plan; review the program as a whole in order to suggest any im:provenent in economy o·r efficic::!ncy which might be effected through the CC'mbining of various projects; and suggest any needed improvE~ments which do not appear :ln the program. (e) All matters aftecting t'n~~ physical development of the City shall be submi.tted to the Planning Commission for a report to the City Cou.ncil as to conforcxlty to the Master Plan. Such repo1:t shall be made tc::> the Co•Jncil within thirty (30) d<!:lys afte11: presentat:lon of the mattcer to the Planning Commiss:f.on, prov:lded said time may be extm:1ded by the Council. If s.;Lid repo:rt is not sllbmitted to the Council within said th·Lrty (30) day period or al:'I.Y extension thereof, the matter shall be deemed apprc:>ved by the said Planning Cotmnission . .. AUTHORITY FOR AND SCOPE OF MASTER OR GENERAL PLANS (Heading amended by Stats. 1955, ch.1644) 65460. Each commission or planning department shall prepare and the commission shall adopt .a comprehensive, long-tertt ;general plart for thE! physical developa:~~mt of tbe city, county, are.a, or reg:lon, and of any lar~d outside its boundaries whtch in the comrnission' s judgment bears relation to its plannj.ng. 'rtle plan may be referrE~d to as the master or general plan and shall be off:icialy certified as the master or general plan upon !ts adoption by the planning commission and the legislative body ... 65401. Thte master or general plan shall be so prer>ared that all or portions of it ma.y be adopted by the legisl.ati·le body as a basi:s for the development of the city, county, area, or :region. The m,aster or gener.al plan shall consist of a map and a statement dE!s<eribing it and a statement covering objectives, principles, attd standards use•c to develop ,:t; and shall include all of the following elements: (a) A land use element 1~hich designates the proposed. gen~ral distribution and general location and extent of the uses of the land for hcusing, business, industry, rec·reatic,n, education, :p:~.blic buildings and grounds, .and <'ther categories of public and private uses of land . (b) A circulation element consisting of the general location a!nd extent of ,e:.;isting and proposej major thoroughf:a:res, transport;::tion routes, terminals, and other loc:al public utility and facilities, all correlatt::d with the. land use element of· the plan. (c) A statement of the :!:tandards of population density and builcl!i1r1g intensity :r1::commended for the various districts. and other terrJ.torial units, and estimates of future population gro~1th, in the territory covered by the plan, all correlated with the land use elemen.t of the plan. A master or general plan may include a conserva'tJ:on element of the plan fo:c the conservation, development, and utilization of natural resources, including water and its hydraulic force:, forests, soi:~s, rivers and other waters, harbors; fisheries, wild life, mineral::;, and other natural resources. Ihe ~onservati.on element of the plan may also cover: (a) The r~~clamation of land and waters. (b) Floa·d control. (c) Prevention and cont·::-o 1 of the pollution of streatllS and othe:r· ""aters. (d) Regulation of the u:;e of land in stream. cham.1els and· other arf',as required for the accomplishment of the conservation plan. A master or general plan tMY include a recreation element of the plan, showing a compr~~he:nsive system of areas and p,ubli 1: · sites for re,::reation~ including the following and, when practil-:able. the:f.r locati•:>ns and proposed development: (a) Natural reservatiO'·lS. (b) Parks. (c) Pa rk\ll·ays. (d) Beaches. (e) Playgrounds . (f) Other recreation areas. (Amendedl by Stats. 1955, Ch. 1644.) 65466. The circulation element -,f the master or general plan as set forth in subdivision (b) of Section 65462 may also include stuc.ies and. recommendations :::oncerning parking facilities and · building setback lines and the delineations of such systems on the land; a system of street naming, house and building numbering; and such other matters as may be related to the. improve!ilEmt of circulation of traffic. A master or general plan may include a transportation elentent of the plan, showing a comprehensive transportation syst:em, inc1udi.ng 1oca1tions c•f rights of ~~y, terminals, viaducts, and grade separations. This element of the plan may also include port:, harbor, aviatio~1, and r·elated facilities . (~~ended by Stats. 1955, Ch. 1644.) 65468. A mas.ter or general plan may include a transit element of the plan, showing .:1 propcsed system of transit lines, including rapi .. d transit, streetcar, me tor coach and trolley coach lines, and rel~ted facilities. A ma:ster or gen:eial plan may include a redevelopment element of t:he plan compt'ising surveys, plans, procedure, and reports fer the elimi1n.ati.ot1 of slums and blighted areas and for community rE:developme1n.t, i1"1cluding housing sites, business and industrial sit•:!s, public building sites, and for other purposes al.lthorized by law. The adoption .of the master or general plan, or of any amendment, extension, or addition to it, shall be by resolution of the coumi.:ssion carried by tbe affirmative votes of not less than a majority of its total vottng members. When changed conditions or further studies by the com­ mission r,equire, the commission :nay amend, extend~ or add to all or part of thE~ master or general plan in the manner provided in this article for its adoption. A cc>py of any part, amendment, e.xtendion of, or addition to the master or general plan adopted by a county or city planning colmlission shclll be certified to the legisl ~tive body of the city or county. A cc>py of any part, amendment, extension of, or .addition to, the maste1: or general plan adopted by an area or regional plan­ ning conrnissic>n shall be certified to each county and city planning coxm:Dission and to the legislative bodies of each county and city within the arE~a or region. Notice of the time and place of the hearing shall be published putsuant to · Section 6061 in the city or county at least 10 days before the hearing. (An:lended by Stats. 1957, Ch. 357.) 65510. In adopting all or any part cf, or amendment or addition to, a tnaste·r or general plan adopted by the planni.ng cOtmli.ssion, the legislative body shall nc:>t make any chs.mg!f! or addition until the pr1::>posecl change or addition has been xeferred to the planning commission for a report and a copy of the report has been filed with the· legislative body. (Amended by Stats. 1955, Ch. 1644.) 65511. When it deems it to be for the public interest, the legislative body may change or add to all or part of an adopted master or general plan. (Amended by Stats. 1955, .. ch. 1644.) 65512. The legislative boc~ shall first refer the proposed chat~e or addition to the planning commission for a report. Before making a repc1rt, the planning commi~.sion shall hold at least one hearing on thE~ proposed change or adc it.ion. It shall give notice of any such heari11g, pursuant to the procedure prescribed by this article for the adoption of the maste:r or general plan or any part, amend­ ment, or addition by the planning commission. (Amended by Stats. 1955, Ch. 1644.) 65513. :Failure of the planning commission to report to the legislativ.e· body on .a proposed change or addition within 90 days after the reference or such l,n.ger period as may be designated by the l~?gisl.:~tive body, shall b.~ deemed to be approval of the pro­ posed change or addition by tl1e planning commission. 65514. After the receipt o:: such report, the legislative body shall hold at least o~ pul:>lic hearing on the proposed change or addition. Notice of the time and place of the hearing shall be published pursuant to Section 6061 in the city or county at least 10 days be::ore the hearing. (Amended ty Stats. 1957, Ch. 357.) 65515. 'l'he master or gener.sl plan or any part, amendment, or addition shall be endorsed to show that it has been adopted by the legislative body. (Amended by Stats. 1955, Ch. 1644.) 65516. Any master or general plan of a county, or o£ any metro­ politan or urban o'jrea of a -:ou:1ty shall be certified to all city planning c:''mmissions and said plan or any portion thereof may be adopted as a part of the ci~y master ~~ general plan.
