Article 23 of Codified Ordinance No. 5 is hereby repealed. !!,ction 2,.:. Article 24 of Cc·dified Ordinance No.. 5 is hereby repealed. Section 3. Article 35 of Codified Ordinance No., 5, the caption thereof, is hereby a~nded to read aa follows: "ARTIClE 35. rJNSAFE AND UNL.AWFUL CONDITIONS: ABATEMENT' Section 4. Section 35.03 o:: Codified Ordinance No. 5 is hereby repealed. Section 5. Section 35.04 of c:oe"fied Ordinance.No. 5, the caption thereof, is hereby amendEd tc read as foD.:o~·s: "Sec. 35. 04 NUISMCE; AUTHORITY TO ABAlE Section 6. Secf'ion 35.04 of Codified Ordinance No. 5, the unnumbered introductory paragraph thereof, is amended to read as foll.ows: "Each of the following <:onditions is hereby declared t•o constitute e1 nuisance, and whenever an enforcement off:t.cer ! hall determine that any of such conditions exist upon any premises he may require or provide for the abatement thereof pU;rsuant tt:> this article and make tha costs of abatement ,a lien upon tli e property." Subsection 5 of Sect:iLon 35.04 of Codi.fied Ordinance No. 5 is amended to read as follows~ "5. The existence withiD. the 35 foot triangle of property at the intersection of streets improved for vehicular traffic, of any tree lim, shrub or plant elc:ceeding 3 feet in height, contrary to the~ provisions of Section 32.13(c). Section 9. SE~ctior.. 33.02 of Codified Ordinance No. 5 is amended to read as follows: "SEC. 33.02 MAINTENANCE OF SIDEWALKS, DRIVE'W'AYS AND DRIVEWAY APPRolcYEs The provisions of the 5treets and Highways Code of the St.:.te of California, shall be an alternative proctdure governing the n.aintenance and the collection of the cost of repair of sidewalk!!, driveways and driveway ~pproaches in tr.e City of Palo Alto. For the purposes of this ordinance~ "side~~alk" as defined in Section 5600 c,f said Code, shall also include a "driveway'' and a "driveway approac:h."
