Tae follow.ing words and phrases, whenev(::r. used in this article,
shall be construed a:s defined i.n this se.:tion:

a.~ "Excavationu shall mean any .ac't by which earth, sand,
gravel,· rock or ,aity other similar. material. is cut /into,
dug; quarried, uncovered, removed, displaced, relocated
or bull-dozed, and shall include the conditions resul-cing
therefrom.·
b: ''Fill" .shall mean any act 'Jy which earth, san.d, gravel, rock
or any other_similar material is deposited, placed, pushed,
pulled or transported) and shall include the conditions
resulting .ther·efrom.
c. "Grading" shall mean excavation or fill or any combina
tion thereof. a;nd shall-. include the conditions resulting
from any exca·v:ation or fill.
d. "Per Cer.t Compaction" shall mean th~ dry density of the
material at present :f.n the fill divided by the maximum
·d:ry:density as determined in accordance .with A.A.S.H.O.
,with A. S. T .M. designation ~ 1557-SST with a ten pound
hammer. falling free from an eighteen inch (l8n) height
above the soil at least 25 blows per layer.
e. '}Quarry" shall mean any site or parcel of land used for
obtaining, ext·racting or producing rock, crushed stone,
building stone, slate, limestone or similar material
products on either a commercial basis or for private use.
f. "Site" shall mean a lot or parcel of la:nd or a series of .
::lots or parcels of land joined together under one own.er.·sh:lp
where grading i.s to be pe-cformed and is being performed.
g . nsupervised Grading" shall mean grading done under the
supervision of a Soils Engineer. . .
h.. •HSoils Enginee·r" shall mean a Civil Engineer licensed by
the. Scat:e and experienc.ed in soil mecha:nics and slopft
stabilities whose qualifications shall be acceptable to
the C.i ty Engi:1eer..
SEC. ,·34.02 PERMIT -WHEN· REQUIRED

a. No person shall .do any grading without a permit therefor
from. the City Engineer if such grading '~ill result in any
of. the following: ·
1. An excavation or fill in excess t).f 100 cubic yards;
· '2. An excavation three feet or more !:>•~low a two
{horizontal) to one (vertical) descending slope from
arry prc:pe~rr.y line, or a fill three feet or more abcve
a two· (ho:dzontal) to one (vertical) ascending slope
fromany property line"

A separate permit: shall be required for E~ach separ.·ate
non-contiguous site. On.e permit may covE!r both .. ~ail:
excavation and a f:Ul on the same site m21de wit-t1···
excavated materials. · ·
PERMIT -W'H.El~ NOT REQUIRED
No permit shall be .. req1;,;ired by virtue of this Article for
a.ny o·f t:he following: · . ··
a. Grading pursuant 1:o a permit .for excavation in. public ·
streets;
b. Grading in connection with a public improvement or
public work for which inspection is provided by the
City;
c. -~::.,~:Ar.tY:.~r~clamation or rubbish disposal site .operated by
1 the'Clty; .
· ·. d-. Grading by a public utility or a mutual w.ater company
in private easements;
·e. A ... -, excavation belo·w finished grade for ba:sements and
footings. of a building, swimming pool or 11nderground
structure au-thoriz,ed by a valid building permit where
the cost of such e:tcavation is included ill the building
permit valuation. This exception shall n<>t aff~ct the
applicability of this Article to, nor the requirement
of a grading permit for, any fill made with the material
from such excavation.
SEC. 34.04 PERMIT -lSSWI.NCE BY BUILDING INSPEC1:-QR IN
CONNECTION t:tn::Y BUILDING ti!R!'UTS w
· When~ver grading .is performed ott a lot or parcel of land in
connectio~.>with t.he construct:ion of a buj~lding or st:ructure on
such lot or parcel. of land fc·r ~1hich a permit has be~en issued
by the Building Inspector, the. Buildi·ng Inspector shall perform
.all of the duties specified by t:his Article to be pE·rformed by
the City Engin.eer, except supervision and inspectiOI1: of :work
performed on public property or work on drains, dams or revetments,
which shall be performed by the City Engineer. All walls or other
similar s.tructures on private property required by the Ci.ty
·Engineer in connection with permits issued by him shall be·
· constructed under a permit fr.om and inspected by the Building

. Every. s~h. application shall contain the following information:
a. The P'U~ose of the work, an,d a statement as to whether
the purpo-se of the excavation is to prep.::lre the site
fo~ subdivision under the state Subdivis:f.on Map Act;

When the· grading is to be done on a site which is intended
·to be subdivided into twc· or more p,:;~rcels or which inv<>lve~:

adjoining property or property at a higher or J~ower level~ or any public sewer, storm drain, watercourse,
street~ street imorovement or any other public
property, the app·licat.ion shall be denied. If, in
the opinion of the City Engineer, the danger of
hazard can.be eliminated by the erection or installa
tion of walls, cribs or other devices, or by a

SEC. 34.10 DESIGNATION OF ROUTES
