TheCityofPaloAlto(City)isajobcenterwithamongthehighesthousingpricesand greatestjobstohousingimbalancesintheBayArea,resultinginahousingshortagethat threatensthecity’sprosperity,diversity,stability,environment,qualityoflife,and communitycharacter.  B. Avarietyofpoliciesresultinincentivesforofficedevelopmentoverhousing,including theavailabilityoftheUniversityAvenueInͲLieuParkingProgram.  C. OnApril1,2019,thePaloAltoCityCounciladoptedOrdinance5460,whichincludeda temporarybanonparticipationintheUniversityAvenueInͲLieuParkingProgramfor certainuses,pendingfurtherstudyandrecommendationfromthePlanningand TransportationCommission(PTC).  D. AdditionaltimeisrequiredfortheCitystaffandthePTCtodeveloparecommendation regardingpermanentchangestotheUniversityAvenueParkingInͲLieuProgram.  E. OnMarch4,2020,CaliforniaGovernorGavinNewsomdeclaredaStateofEmergency duetothethreatofCoronavirusDisease2019(COVIDͲ19).  F. OnMarch16,2020,thepublichealthofficersforthesixBayAreacounties,including SantaClaraCounty,tooktheunprecedentedanddramaticstepofissuing“shelterͲinͲ place”ordersdirectingcountyresidentstoshelterathomeforthreeweeksbeginning March17(theShelterͲinͲPlaceOrder).TheOrderlimitedactivity,travel,andbusiness functionstoonlythemostessentialneeds.  G. OnMay11,2020theCityCouncilintroduced,andonOctober5,2020adopted, Ordinance5506toextendthetemporarybanuntilFebruary1,2021.  H. TheprolongednatureoftheCOVIDͲ19pandemichasprecludedthecollectionofdata andfurtherstudyofparkingstrategiesintheUniversityAvenuedowntownarea. *NOTYETAPPROVED* 0160030_20201112_ay_162    I. PursuanttoPaloAltoMunicipalCodesection18.80.090,thepublichealth,safety,and welfarerequirethatthetemporarybanonparticipationintheUniversityAvenueInͲLieu ParkingProgrambefurtherextendedtomaintainthestatusquo.  SECTION2.Subdivision(d)ofSection18.52.070(ParkingandLoading)ofChapter18.52 (ParkingandLoadingRequirements)ofTitle18(Zoning)isherebyamendedtoreadasfollows:  18.18.090ParkingandLoading  [...]  (d)InͲlieuParkingProvisions InconnectionwithanyexpansionofthesupplyofpublicparkingspaceswithintheCD commercialdowntowndistrict,thecityshallallocateanumberofspacesforuseas"inͲ lieuparking"spacestoallowdevelopmenttooccuronsiteswhichwouldotherwisebe precludedfromdevelopmentduetoparkingconstraintsimposedbythischapter.OffͲ siteparkingonsuchsitesmaybeprovidedbypaymentofaninͲlieumonetary contributiontothecitytodefraythecostofprovidingsuchparking.Contributionsfor eachrequiredparkingspaceshallequaltheincrementalcostofprovidinganetnew parkingspaceinanassessmentdistrictprojectpluscostfortheadministrationofthe program,allasdeterminedpursuanttoChapter16.57ofTitle16ofthiscode,bythe director,whosedecisionshallbefinal.Onlysitessatisfyingoneormoreofthefollowing criteria,asdeterminedbythedirector,shallbeeligibletoparticipateintheinͲlieu parkingprogram: (1) ConstructionofonͲsiteparkingwouldnecessitatedestructionorsubstantial demolitionofadesignatedhistoricstructure; (2) Thesiteareaislessthantenthousandsquarefeetanditwouldnotbe physicallyfeasibletoprovidetherequiredonͲsiteparking; (3) Thesiteisgreaterthan10,000squarefeet,butofsuchanunusualconfiguration thatitwouldnotbephysicallyfeasibletoprovidetherequiredonͲsiteparking; (4) Thesiteislocatedinanareawherecitypolicyprecludescurbcutsorotherwise preventsuseofthesiteforonͲsiteparking;or (5) Thesitehasotherphysicalconstraints,suchasahighgroundwatertable,which precludeprovisionofonͲsiteparkingwithoutextraordinaryexpense. *NOTYETAPPROVED* 0160030_20201112_ay_163   OfficeusesabovethegroundfloorshallnotbeeligibletoparticipateintheinͲlieu parkingprogramfromtheeffectivedateofOrdinanceNo.5460throughFebruary1, 2021throughAugust1,2020.
