Temporarily Extend Ineligibility of Certain Uses to Participate in the

This was first heard on the consent calendar on December 7, 2020 where it passed 4-2 with
Mayor Fine and Council Member Tanaka voting no, and Council Member Cormack absent.

TheCounciloftheCityofPaloAltoORDAINSasfollows:
SECTION1.Findingsanddeclarations.TheCityCouncilfindsanddeclaresasfollows:
A. TheCityofPaloAlto(City)isajobcenterwithamongthehighesthousingpricesand
greatestjobstohousingimbalancesintheBayArea,resultinginahousingshortagethat
threatensthecity’sprosperity,diversity,stability,environment,qualityoflife,and
communitycharacter.
B. Avarietyofpoliciesresultinincentivesforofficedevelopmentoverhousing,including
theavailabilityoftheUniversityAvenueInͲLieuParkingProgram.
C. OnApril1,2019,thePaloAltoCityCounciladoptedOrdinance5460,whichincludeda
temporarybanonparticipationintheUniversityAvenueInͲLieuParkingProgramfor
certainuses,pendingfurtherstudyandrecommendationfromthePlanningand
TransportationCommission(PTC).
D. AdditionaltimeisrequiredfortheCitystaffandthePTCtodeveloparecommendation
regardingpermanentchangestotheUniversityAvenueParkingInͲLieuProgram.
E. OnMarch4,2020,CaliforniaGovernorGavinNewsomdeclaredaStateofEmergency
duetothethreatofCoronavirusDisease2019(COVIDͲ19).
F. OnMarch16,2020,thepublichealthofficersforthesixBayAreacounties,including
SantaClaraCounty,tooktheunprecedentedanddramaticstepofissuing“shelterͲinͲ
place”ordersdirectingcountyresidentstoshelterathomeforthreeweeksbeginning
March17(theShelterͲinͲPlaceOrder).TheOrderlimitedactivity,travel,andbusiness
functionstoonlythemostessentialneeds.
G. OnMay11,2020theCityCouncilintroduced,andonOctober5,2020adopted,
Ordinance5506toextendthetemporarybanuntilFebruary1,2021.
H. TheprolongednatureoftheCOVIDͲ19pandemichasprecludedthecollectionofdata
andfurtherstudyofparkingstrategiesintheUniversityAvenuedowntownarea.

I. PursuanttoPaloAltoMunicipalCodesection18.80.090,thepublichealth,safety,and
welfarerequirethatthetemporarybanonparticipationintheUniversityAvenueInͲLieu
ParkingProgrambefurtherextendedtomaintainthestatusquo.
SECTION2.Subdivision(d)ofSection18.52.070(ParkingandLoading)ofChapter18.52
(ParkingandLoadingRequirements)ofTitle18(Zoning)isherebyamendedtoreadasfollows:

(d)InͲlieuParkingProvisions
InconnectionwithanyexpansionofthesupplyofpublicparkingspaceswithintheCD
commercialdowntowndistrict,thecityshallallocateanumberofspacesforuseas"inͲ
lieuparking"spacestoallowdevelopmenttooccuronsiteswhichwouldotherwisebe
precludedfromdevelopmentduetoparkingconstraintsimposedbythischapter.OffͲ
siteparkingonsuchsitesmaybeprovidedbypaymentofaninͲlieumonetary
contributiontothecitytodefraythecostofprovidingsuchparking.Contributionsfor
eachrequiredparkingspaceshallequaltheincrementalcostofprovidinganetnew
parkingspaceinanassessmentdistrictprojectpluscostfortheadministrationofthe
program,allasdeterminedpursuanttoChapter16.57ofTitle16ofthiscode,bythe
director,whosedecisionshallbefinal.Onlysitessatisfyingoneormoreofthefollowing
criteria,asdeterminedbythedirector,shallbeeligibletoparticipateintheinͲlieu
parkingprogram:
(1) ConstructionofonͲsiteparkingwouldnecessitatedestructionorsubstantial
demolitionofadesignatedhistoricstructure;
(2) Thesiteareaislessthantenthousandsquarefeetanditwouldnotbe
physicallyfeasibletoprovidetherequiredonͲsiteparking;
(3) Thesiteisgreaterthan10,000squarefeet,butofsuchanunusualconfiguration
thatitwouldnotbephysicallyfeasibletoprovidetherequiredonͲsiteparking;
(4) Thesiteislocatedinanareawherecitypolicyprecludescurbcutsorotherwise
preventsuseofthesiteforonͲsiteparking;or
(5) Thesitehasotherphysicalconstraints,suchasahighgroundwatertable,which
precludeprovisionofonͲsiteparkingwithoutextraordinaryexpense.

OfficeusesabovethegroundfloorshallnotbeeligibletoparticipateintheinͲlieu
parkingprogramfromtheeffectivedateofOrdinanceNo.5460throughFebruary1,

SECTION3.Ifanysection,subsection,sentence,clause,orphraseofthisOrdinanceisforany
reasonheldtobeinvalidorunconstitutionalbyadecisionofanycourtofcompetent
jurisdiction,suchdecisionshallnotaffectthevalidityoftheremainingportionsofthis
Ordinance.TheCityCouncilherebydeclaresthatitwouldhavepassedthisOrdinanceandeach
andeverysection,subsection,sentence,clause,orphrasenotdeclaredinvalidor
unconstitutionalwithoutregardtowhetheranyportionoftheOrdinancewouldbe
subsequentlydeclaredinvalidorunconstitutional.
SECTION4.TheCouncilfindsthatthepotentialenvironmentalimpactsrelatedtotheHousing
WorkplanOrdinance,includingtheamendmentsenactedhereinwereanalyzedintheFinalEIR
fortheComprehensivePlanUpdate,whichwascertifiedandadoptedbytheCouncilby
ResolutionNo.9720onNovember13,2017.ThisOrdinanceisconsistentwithandimplements
theprogramevaluatedintheEIR.
