STORM DRAINAGE FEE PROTEST HEARING
REPORT IN BRIEF
At the City Council meeting of June 12, 2000 the Council adopted procedures for
consideration of an increase in the storm drainage fee. In accordance with Proposition
218, increasing the storm drainage fee requires a two step process. First, the Council
must hold a public hearing. If by the close of the public hearing, a majority of property
owners whose parcels are subject to the fee have submitted written protests against the
fee increase, then the increase cannot be adopted and no further proceedings will occur.
If a majority protest does not occur at the public hearing, and the Council desires to
continue consideration of the fee increase, the Council must call an election whereby
owners of the parcels subject to the fee increase may vote on whether to approve the fee
increase. If a majority of those voting approve the increase, then the Council may
increase the fee. If a majority of those voting do not approve the increase, then no
increase can occur.

RECOMMENDATION
Staff recommends that Council hold a public hearing and accept written and oral
testimony on the matter of the proposed storm drainage fee increase. At the close of the
public hearing, the City Clerk will count the written protests received on the matter, and
will announce to the Council whether written protests have been received from a majority
of owners of parcels subject to the fee increase.
Staff further recommends that if a majority protest does not occur, the Council adopt a
resolution calling a special mail ballot election for Tuesday, September 26, 2000 to allow
owners of parcels subject to the storm drainage fee increase to vote on whether the fee
should be increased.
BACKGROUND
On March 3, 1999, staff presented a report (CMR:147:99) to the Finance Committee
describing a proposal for financing the next phase of storm drainage improvements. The
report discussed the current financial status of the Storm Drainage Fund, the effects of
Proposition 218 on the City’s ability to raise property-related fees, and staff’s proposal
for funding storm drainage infrastructure improvements. On June 12, 2000, Council
directed staff to proceed with the process for a storm drainage fee election and to take
action to ensure that voters were well educated about the current status of the City’s
storm drain infrastructure and programs and the proposed ballot measure. On June 16,
hearing notices and informational brochures were mailed to all property owners. In
addition, staff has developed an interactive storm drain web site; coordinated a
presentation that will be broadcast on cable television; and conducted a series of public
information meetings. Finally, staff has contacted various community groups and
neighborhood associations and offered to discuss the proposed storm drainage fee
increase with their members.
Palo Alto is one of the first California cities to present a property-related fee increase to
voters for approval since the passage of Proposition 218. Proposition 218 limits the
authority of local governments to impose or increase taxes and property-related
assessments, fees or charge; and imposes procedural rules for the levy of new or
increased fees. The provisions of Proposition 218 require that a proposed fee increase
must be submitted to property owners for approval or rejection, after proper notice and
public hearing. A public hearing must be held not less than 45 days after a mailed notice.
If written protests are received from a majority of property owners at the hearing, the
proposed fee increase cannot be levied. Proposition 218 also requires that the fee be
limited to the benefit conferred on each property owner. As such, the fee must be
proportional to the cost of providing storm drain service. Monies raised by the fee cannot
be used for general governmental purposes. Approval is required by mail ballot election
in which a majority of property owners returning ballots agree to any new or increased
property-related fees.

DISCUSSION
Protest Hearing Procedures
To comply with the provisions of Proposition 218 and to ensure the integrity of the
September 26, 2000 storm drainage fee election, detailed procedures have been
developed for the public hearing and mail ballot election process. These procedures were
approved by Council on June 12, 2000, and notices and brochures were mailed to
property owners on June 16. A protest hearing is the next step in the process. Property
owners have the opportunity to appear before Council to register their concerns and
protest the fee election. The proceedings will-be governed by Council-approved
guidelines, which are highlighted below:
Written protests must be legibly signed by an eligible property owner (as determined
by the Director of Public Works’ "master list"), identify relevant parcel(s), and state
grounds for protest. Council may waive irregularities, as they deem fit.
The City Clerk must endorse each written protest to verify the date of its filing. No
protests received after the. close of the public hearing on August 7, 2000 will be
accepted.
At the hearing, Council will hear all objections and take and receive documentary
evidence pertaining to the proposed fee increase.
At the end of the hearing, Council will determine whether a majority protest has been
received.
If Council determines, at the close of the public testimony portion of the public hearing,
that written protests have been received from property owners representing a majority of
the parcels subject to the proposed fee increase, the Mayor shall declare the proceedings
closed, and the fee increase shall not be approved. If Council determines that less than a
majority of property owners have submitted written protest, the Council may adopt a
resolution calling an election.
Assuming that Council’calls an election, ballots will be mailed to eligible voters on
September 6, 2000. Ballots for the storm drainage fee election will consist of a single
question that requires a checkmark either for or against the proposed fee increase.
Ballots must be received by the City Clerk no later than 8 p.m. on September 26, 2000.
Ballots received after 8 p.m. will not be included in the vote tabulation. A postage-paid
return envelope included with the ballot ensures accurate counts and facilitates the
election process for voters. Council will certify the mail-in ballot vote on October 2,
2000.
RESOURCE IMPACT
rfproperty owners approve the fee increase, Palo Alto single-family residential property
owners will pay an average of an additional $4.75 monthly over the current monthly fee

of $4.25 to fund storm drain improvements and maintenance. The exact increase would
be based on lot size.
At the current funding level, the Storm Drainage Fund continues to be underfunded,
placing an extreme burden on the General Fund through continued subsidies. Presently,
the annual cost to the General Fund is approximately $800,000. Without a resolution to
the storm drain funding issue, necessary capital improvements and repairs cannot be
undertaken. In addition, if voters do not approve the fee increase, the capital work will
have to be deferred or the General Fund will have to fund the work at the expense of
other General Fund projects and programs.
ENVIRONMENTAL REVIEW
Consideration of financial options does not require Califomia Environmental Quality Act
(CEQA) review. Individual projects will be subject to environmental review as they are
further developed.

TUESDAY,SEPTEMBER 26, 2000 FOR SUBMITTAL OF A
STORM DRAINAGE FEE INCREASE TO OWNERS OF REAL
PROPERTY SUBJECT TO THE FEE
WHEREAS, revenue from the City’s storm drainage fee is
not sufficient to support either the ongoing operations and
maintenance or capital improvements to the City’s storm drainage
system; and
WHEREAS, Article XIIID of the California Constitution
("Proposition 218") requires the City to follow certain procedural
and substantive requirements when proposing to increase "property-
related" fees; and
WHEREAS, the City has determined that the storm drainage
fee is a "property-related" fee, subject to Proposition 218; and
WHEREAS, before increasing the storm drainage fee, the
City Council must hold a noticed public hearing to consider
protests to the proposed fee increase and, if a majority protest
is not received at the public hearing, the Council must submit the
question of the fee increase to a vote of the owners of the
property subject to the fee; and
WHEREAS, pursuant to Ordinance No. 4647 and Resolution
No. 7974, the City Council authorized the use of a mail ballot
election for the purpose of submitting the proposed storm drainage
fee increase to the owners of real property subject to the fee;
and
WHEREAS, in accordance with Proposition 218 and with the
procedures established by Resolution No. 7974, the City Council
has held a duly noticed public hearing on the matter of a proposed
increase to the storm drainage fee.

NOW, THEREFORE, the Council of the City of Palo Alto does
hereby RESOLVE as follows:
SECTION I.The Council has:
(a)reviewed the written report containing a list of all
parcels to which the fee increase is proposed to
apply and the proposed fee increase for each
property, as described in Section D1 of the
procedures established by Resolution No. 7974 ("the
Report");
b)heard all persons owning real property subject to
the storm drainage fee;
c)heard all objections, protests, or other written
communications from any persons owning real property
subject to the fee;
d)taken and received oral and documentary evidence
pertaining to the proposed fee increase;
e)remedied and corrected any
informality in the Report;
clerical error or
f)
g)
corrected any minor defects in the proceedings;
revised and corrected any of the acts or
determinations of any City officers or employees, as
contained therein;
and is fully informed of the matter.
SECTION 2.The Council hereby confirms the Report
referred to in Section 1 and each of the proposed fee increases
therein.
SECTION 3.The Council determines~ that written
protests have not been received from property owners representing
a majority of the parcels subject to the proposed fee increase.
SECTION 4.The Council hereby calls a special
election, to be held solely by mail ballot, for the purpose of
submitting the fee increase to a vote of the property owners of
parcels subject to the proposed fee increase. The date of the
election shall be Tuesday, September 26, 2000. Ballots must be
received by the City Clerk no later than 8:00 p.m. on the date of
the election.

FREQUENTLY ASKED QUESTIONS
RE: PROPOSED STORM DRAIN FEE INCREASE
Issue Why is the City proposing to double the current fee?
Response:There has not been a fee increase since 1994. To cover the
current cost of the storm drain program, fees must be
increased. To make capital improvements that will improve
flooding and ponding conditions and contribute to the initial
Joint Powers Authority effort for San Francisquito Creek, the
fee must increase to $9.00. The fee is proposed to rise from
$4.25 to $9.00 in the first year and second years. In the third
year the fee will increase to $10, and each succeeding year
the fee may increase by the Consumer Price Index (CPI).
Staff further explained that should the increase not be
required during any given year, the Council can defer the CPI
increase for that year.
Issue:There is no sunset provision to the proposed fee increase.
What happens to the money raised when the project is
completed?
Response:Currently, there are no sunset provisions to end the proposed
fee. Ongoing maintenance, water quality and capital
improvements will still be necessary in the year 2031.
Futhermore, the provisions of Proposition 218 would require
voters to approve an increase if the fee was ever abated. To
avoid further deterioration of the storm drain system,
scheduled maintenance, rehabilitation, improvements, and
replacement of pipes and equipment are necessary.
Issue:Why is the proposed rate structure for residential properties
divided into six categories and why has the City not taken
into consideration the actual impermeable area of a specific
residential lot?
Response:Under Proposition 218, the law that mandates how the fee can
be implemented, the fee charged to residents must be
proportional to the cost of delivering the service. The current
fiat rate for all residential properties did not meet the
"proportional tO use" requirement. A tiered rate based on lot
size and the amount of impermeable area on the lot was
developed. A 5 percent random sample of properties using
actual measurements of impermeable area was used to
develop the proposed rate structure. The sampling represents
a pragmatic and cost -efficient method of developing a rate
system that is equitable and fulfills Proposition 218
requirements.

The Master List for the Storm Drainage Fee Increase will be available for Council review
at the City Council meeting on Monday August 7, 2000 or, in advance, in the
Administrative Services Department. The Master List contains the proposed fee for each
parcel for which a fee is charged. The List is approximately 1,500 pages long. Due to the
length of the Master List, we are attaching sample pages from the List, which show the

Background Information
This MASTER LIST serves as the written report to the City Council to accompany the
PROCEDURES FOR THE CONDUCT OF A PROTEST HEARING AND
ELECTION RELATING TO A PROPOSED STORM DRAIN UTILITY FEE
INCREASE (procedures). These Procedures are to be brought before City Council for
adoption on June 12, 2000. This MASTER LIST was prepared in accordance with the
guidelines contained in Section D, paragraph 1 of the Procedures.
The MASTER LIST was assembled from information provided by the Santa Clara
County Assessor’s Office, and the City of Palo Alto Customer Information System
(CIS). The MASTER LIST is comprised of 4 parts to accommodate the different ways
in which the storm drainage fee is paid. Each part of the MASTER LIST is sorted in
ascending order by the Assessor’s ParCel Number (APN). A parcel will appear only
once within the MASTER LIST.
;fhe fee for the majority of parcels is paid under one CIS utility account that is
exclusively for the individual parcel listed (PART 1). The MASTER LIST specifically
identifies the CIS utility account number and the payee in this case.
The fee for some parcels which have multiple tenants or multiple owners is split
between multiple utility accounts (PART 2). The MASTER LIST includes the number
of accounts that are charged a portion of the fee shown, but does not identify the CIS
utility account numbers or the payee(s) for these multiple utility accounts.
The fee for some parcels is consolidated with the fee for other parcels into a single CIS
utility account (PART 3). Examples include condominium complexes. Each
condominium within the complex is a separate parcel. The storm drainage fee for the
complex is based on the impervious area of the entire complex and is typically paid by
the condominium homeowners association or "house" account. Another example of a
consolidated fee is a large corporation that operates on multiple parcels. For
convenience, the storm drainage fee has been consolidated into one account for these
parcels. The MASTER LIST specifically identifies the CIS utility account number and
the payee in this case.
A small fraction of parcels are covered by multiple storm drainage utility accounts
which also cover other parcels (PART 4). The MASTER LIST includes the number of
accounts that are charged a portion of the fee shown, but does not identify the CIS
utility account number or the specific payee(s) of these multiple utility accounts.
The fee listed for each parcel in PART 3 and PART 4 will show up in the MASTER
LIST as many times as the number of parcels listed under "Utility Account
Information". For example, if "Utility Account Information" states that "Fee covers

74 parcels", then the current and proposed fees shown will be listed 74 times within the
MASTER LIST.
In addition to the APN, CIS utility account information and the current and proposed
fees, the MASTER LIST includes the street address of the parcel, the parcel size in
square feet (sq. ft.), the name of the Owner/Assessee, and the mailing address of the
Owner/Assessee. The following tables and keys explain how to read the information
contained in the MASTER LIST.
