HomeMy WebLinkAbout2000-06-19 City Council (16)City of Palo Alto City Manager’s Report TO:HONORABLE CITY COUNCIL FROM:CITY MANAGER DEPARTMENT: PUBLIC WORKS 3 DATE: SUBJECT: JUNE 19, 2000 CMR:287:00 RESOLUTION AUTHORIZING .THE CITY OF PALO ALTO TO SUBMIT A BEVERAGE CONTAINER RECYCLING AND LITTER CLEANUP FUNDING REQUEST TO THE DIVISION OF RECYCLING OF THE STATE OF CALIFORNIA DEPARTMENT OF CONSERVATION RECOMMENDATION Staff recommends that Council approve a resolution authorizing the City Manager to submit a funding ~request for beverage container recycling and litter ’ cleanup to the State of California’ Department of. Conservation Division of Recycling (Division) for distribution of funds for beverage container recycling. DISCUSSION The California Beverage Container Recycling and Litter Reduction Act requires a deposit be paid on all soft drink cans and bottles purchased in California. The Division then distributes these funds back to eligible cities and counties for beverage container recycling and litter cleanup activities. This year the Division will be distributing. $10.5 million back to eligible cities and counties. Each city may receive a minimum of $5,000, or an amount calculated by the Division on a per capita basis, whichever is greater. The City of Palo Alto is projected to receive $17,889, using the per capita basis formula. The funds must be used for beverage container recycling and/or litter, reduction activities which educate the public, collect recyclable materials and/or provide recycling at large venues, public areas, residential communities or schools. City staff has created a list of planned activities totaling $341,000; the $17,889 would support these expenses. The Division may withhold payments if the city has prohibited the siting of a supermarket site recycling center, caused a supermarket site recycling center to close its business, or adopted a land use policy that restricts or prohibits the. siting of a supermarket site recycling center within its jurisdiction. .CMR:287:00 Page 1 of 2 In order to qualify for this funding, the attached resolution must. be passed postmarked to the Division no later than June 30, 2000. and RESOURCE IMPACT Funds for beverage container recycling are included in the FY 2000-2001 Refuse Fund Operating Budget. POLICY IMPLICATIONS This recommendation does not represent any change to existing City policies. ENVIRONMENTAL REVIEW This project is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15308 (Action by Regulatory Agencies for Protection of the Environment) of the CEQA guidelines. RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO AUTHORIZING THE CITY OF PALO ALTO TO SUBMIT A BEVERAGE CONTAINER RECYCLING AND LITTER CLEANUP FUNDING REQUEST TO THE DIVISION OF RECYCLING OF THE STATE OF .CALIFORNIA DEPARTMENT OF CONSERVATION WHEREAS, the people of the State of California have enacted the California Beverage Container- Recycling and Litter Reduction Act that provides funds to cities and counties for beverage container recycling and litter cleanup activities; and WHEREAS, the Division of Recycling of the California Department of Conservation has been delegated-the responsibility for the administration of the program within the State, setting up necessary procedures for -cities and counties or their designees under the program; and WHEREAS, Section 14581(a) (4) (E) of the California Beverage Container Recycling and Litter Reduction Act requires the eligible participant to submit the Funding Request Form by June. 30, 2000 in order to request funds from the Division of Recycling of the Department Of Conservation. NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION i. The City of Palo Alto authorizes the City Manager to submit the beverage container recycling and litter cleanuP Funding Request Form to the Division of Recycling of the Department .of Conservation. The City Manager or his designee, including but not limited to the Solid Waste Manager, is hereby authorized and empowered to execute in the name of the City of Palo Alto all necessary forms hereto for the purposes of securing payments and to implement and carry out the purposes specified in the Section 14581(a) (4) (A) of the California Beverage Container Recycling and Litter Reduction Act and provide information regarding this program to the Division upon request. // // 000607 sdl 0052531 SECTION 2. The Council finds that this is not a project under the California Environmental Quality Act and, therefore, no environmental impact assessment is necessary.
