BACKGROUND On November 8, 1999, Council directed staff to develop a plan to provide art in all City capital projects, to be integrated as part of the project proposal. The policy was not to be a "percent for art" proposal, but an effort to incorporate art into appropriate City projects via Council policy. DISCUSSION As developers come forward with projects it has become colmnonplace for the ARB or the Planning Commission to impose a requirement that developers include art as a public benefit to mitigate the impacts those projects may have on the aesthetic environment. Although the City has had an Art in Public Places program since 1977, which is funded annually through the Capital Improvement Program (CIP); the current CIP does not address the impact that City projects may have on the surrounding environment. The purpose of this proposal is .to correct the imbalance between what is required of developers and what is imposed on City projects. This proposed policy (Attachment 1) intends that artists be included in projects at the initial stages of design, thereby ensuring that art dements become an integral part of the overall design. The proposed policy will not apply t6 CIP projects that have minor or no visual impact. Appropriate City staff will make such determination in cooperation with the City’s Director of Arts and Culture. The Public Art Commission has reviewed and a~pproved this new policy. Departments in the City that will be affected by this policy change have also reviewed it. Implementation will require coordination between the Public Art Commission, the Division of Arts and Culture, the City Manager-appointed CIP Committee and appropriate departments. CMR:240:00 Page 1 of 2 RESOURCE IMPACT This policy will not replace; but instead~ augment the existing annual CIP allocation to the Art in Public Places project, which is budgeted at $60,000 for FY 2001-02. This new policy will have an impact on the Capital Improvement Program budget although the exact impact is unknown. Most cities that have adopted similar policies have been able to predict the impact to their capital improvement budgets by assessing a .percent of the total construction costs of a project. Attachment 2, prepared by the California Arts Council, provides examples of public art .programs in the State of California. Attachment 2 records forty-three cities throughout California that have adopted art in public places programs. Of those, 20 cities (46 percent) employ a percentage mechanism to determine an appropriate cost to adding an art element to a project. ,/ POLICY IMPLICATIONS This recommendation is consistent with and in response to Council direction.
