HomeMy WebLinkAbout2001-09-24 City Council (5)TO: FROM: DATE: SUBJECT: City of Palo Alto City Manager’s Report HONORABLE CITY COUNCIL CITY MANAGER SEPTEMBER 24, 2001 DEPARTMENT: HUMAN RESOURCES CMR: 363:01 APPROVAL OF RESOLU~ON REQUESTING THE BOARD OF THE PUBLIC EMPLOYEES’ RETIREMENT SYSTEM (PERS) TO ALLOW EXTENSION OF EMPLOYMENT BEYOND 960 HOURS IN CALENDAR YEAR 2001 FOR INTERIM DIRECTOR OF PLANNING AND COMMUNITY ENVIRONMENT 4 RECOMMENDATION This report recommends the adoption of a resolution to allow the extension of employment beyond 960 hours in calendar year 2001 for Les White, to enable him to take the position of Interim Director of Planning and Community Development. BACKGROUND On September 7, 2001, Ed Gawf, the former director of Planning and Community Development resigned to take another position. Efforts are underway to recruit a permanent replacement for this position. During the recruitment process and until a permanent appointment is made, Les White has agreed to serve as interim Director of Planning and Community Environment. DISCUSSION Mr. White is a well-respected municipal manager and a PERS retiree. He has and is currently working for several other PERS agencies. Mr. White’s work for other PERS agencies, combined with the work he is to perform for the City of Palo Alto, could amount to more than 960 hours of work in a calendar year, the maximum allowed by PERS without reinstating the retiree to active status. Section 21221 (h) of the California Government Code provides that that a public agency may request that the PERS Board allow a PERS retiree working on a temporary basis to exceed the 960 hour maximum in a calendar year without reinstatement of the employee to active status. Staff expects the PERS Board to approve this request. RESOLUTION OF THE ~COUNCIL OF THE CITY OF PALO ALTO REQUESTING THE BOARD OF THE PUBLIC EMPLOYEES’ RETIREMENT SYSTEM (PERS) TO ALLOW EXTENSION OF EMPLOYMENT BEYOND 960 HOURS IN CALENDAR YEAR 2001 FOR INTERIM DIRECTOR OF PLANNING AND COMMUNITY ENVIRONMENT WHEREAS, the former Director of Planning and Community Environment has recently resigned to take another position; and WHEREAS, the position of Director of Planning and Community Environment is a crucial department head position for the City; and WHEREAS, although efforts are underway to recruit a permanent replacement for this position, filling this vacancy is expected to take several months; and WHEREAS, an interim Director is needed to provide for the effective management of the department and to continue vital work with the community on land use issues; and WHEREAS, Mr. Leslie Robert (Les) White, a well-respected municipal manager, and PERS retiree, has agreed to serve the City as the interim Director of Planning and Community Environment from October i, 2001 until such time as a permanent Director can be hired; and WHEREAS, Mr. White’s work for other communities combined with the work he is needed to do for the City of Palo Alto could amount to more than 960 hours of work for PERS agencies within the calendar year 2001; and WHEREAS, Section 21221 (h) of the California Government Code provides that the governing body of a PERS agency may by resolution request the PERS Board to allow a PERS retiree that works for the agency on a temporary basis to exceed the maximum 960 hours in a calendar year that a PERS retiree is otherwise eligible to work for PERS agencies. // // // 010912 cl 0032483 1 _ NOW, THEREFORE, the CouncLl of the City of Palo Alto does RESOLVE as follows: SECTION I. The Council hereby declares~ that Mr. Les White has special skills that are needed to continue the business of the City’s Department of Planning and Community Environment, and that it deems the appointment of Mr. White as interim Director to be of limited duration. SECTION 2. This Council hereby requests that the PERS Board allow Mr. White’s employment with PERS agencies, including his interim appointment with the City, to exceed 960 hours for calendar year 2001.
