HomeMy WebLinkAbout2001-07-16 City Council (7)City of Palo Alto City Manager’s Report TO:HONORABLE CITY COUNCIL 4 FROM:CITY MANAGER DEPARTMENT:ADMINISTRATIVE SERVICES DATE:JULY 16, 2001 CMR: 311:01 SUBJECT:APPROVAL OF A BUDGET AMENDMENT ORDINANCE AMENDING THE 2001-02 MUNICIPAL FEE SCHEDULE TO CORRECT FOR AN OMITTED FEE CHANGE RECOMMENDATION Staff recommends that the City Council adopt the attached Budget Amendment Ordinance (BAO) that amends the 2001-02 Palo Alto Municipal Fee Schedule to restore a fee that was inadvertently omitted (Attachment C). DISCUSSION With the adoption of the 2001-02 Municipal Fee Schedule, Council approved various cost recovery increases to development-related fees in the Planning Department. These changes are projected to increase revenue by $233,000 in 2001-02. The Real Property Research Fee is one of the development-related fees in the Planning Department that was to increase, from $25 to $50, as part of the cost recovery fee increases. The fee however, was inadvertently omitted from the fee schedule that Council adopted and is therefore restored to the fee schedule as presented in Attachment C. In accordance with state law, the fee increase will not go into effect until sixty (60) days after Council adoption. The other line item that was omitted from the fee schedule is a text reference to the Record Management Fee that has no financial impact. This item is also restored as presented in Attachment C. RESOURCE IMPACT The anticipated revenue impact of the increase to the Real Property Research fee is $5,000 annually. This revenue was included in the $233,000 that was originally estimated as the overall impact of the development-related fee increases presented in the 2001-02 Municipal Fee Schedule. CMR:311:01 Page 1 of 2 This transaction as presented in the attached BAO has no impact on the General Fund Budget Stabilization Reserve (BSR) and no furore year General Fund ongoing costs are anticipated as a result of this BAO. Attachment B summarizes the BAOs approved to date in 2001-02 that impact the General Fund BSR. The attachment also estimates future year ongoing co~ts associated with BAOs approved to date to provide a projection for the future resource needs from the General Fund for those programs approved after the adoption of the 2001-02 budget. POLICY IMPLICATIONS This recommendation does not represent a change to City policy. ENVIRONMENTAL REVIEW This is not a project for the purposes of the Califomia Environmental Quality Act (CEQA). ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO TO AMEND THE 2001-02 MUNICIPAL FEE SCHEDULE AND THE BUDGET FOR THE FISCAL YEAR 2001-02 TO RESTORE FEES THAT WERE INADVERTENTLY OMITTED ~ WHEREAS, pursuant to the provisions of Section 12 of Ar%icle III of the Charter of the City of Palo Alto, the Council on jun~ ii, 2001 did adopt a budget for fisca! year 2001-02; and WHEREAS, in the adopted 2001-02 Municipal Fee Schedule the Real Property Research fee and a reference to the Record Management Fee in the Planning Department were inadvertently omitted; and WHEREAS, these items, including an increase to the Real Property Research fee, as presented in Attachment C must now be restored to the 2001-02 Municipal Fee Schedule; and WHEREAS, the Municipal Fee Schedule needs to be amended to implement these changes; and WHEREAS, the impact of the change to the Real Property Research fee is already included in estimated revenue figures in the 2001-02 Budget and no further impact to the General Fund Budget Stabilization Reserve is anticipated as a result of this change; and WHEREAS, City Council authorization is needed to amend the 2001-02 Municipal Fee Schedule and the budget as hereinafter set forth. NOW, THEREFORE, the Council of the City of Palo Alto does ORDAIN as follows: SECTION i. The Municipal Fee Schedule is hereby amended to reflect the changes shown in Attachment C, which is attached hereto and incorporated herein by reference. SECTION 4. This change will not impact the General Fund Budget Stabilization Reserve. SECTION 5. As specified in Section 2.28.080(a) of the Palo Alto Municipal Code, a two-thirds vote of the City Council is required to adopt this ordinance. SECTION 6. The Council of the City of Palo Alto hereby finds that this is not a project under the California Environmental Quality Act and, therefore, no environmental impact assessment is necessary. SECTION 7. As provided in Section 2.04.350 of the Palo Alto Municipal Code, this ordinance shall become effective upon adoption; provided, however, that the increase to the Real Property Research Fee shall be effective sixty (60) days from the date of ~doption.
