MANAGER DEPARTMENT: ADMINISTRATIVE SERVICES DATE:FEBRUARY 12, 2001 CMR: 136:01 SUBJECT:AUTHORIZATION TO VOTE AND RETURN DOWNTOWN PARKING ASSESSMENT DISTRICT BALLOTS FOR CITY PARCELS RECOMMENDATION Staff recommends that the City Council authorize the City Manager to vote and return the assessment ballots for City parcels in the proposed University Avenue Parking Assessment District (District). BACKGROUND On January 22, 2001, Council adopted Resolution No. 8035 preliminarily approving the Engineer’s Report and taking other actions with respect to the proposed Downtown Parking Assessment District, ~including setting a public hearing and directing the mailing of assessment ballots to owners of property proposed to be assessed. As part of the balloting process, the City of Palo Alto will receive assessment ballots. DISCUSSION In accordance with California Constitution Article XIIID (Proposition 218), City property within the proposed District is required to be assessed. The City owns approximately 25 parcels within the proposed District and will receive an assessment ballot for each parcel. Staff recommends that the City Council authorize the City Manager to vote and return the assessment ballots for the City parcels. This is consistent with prior direction from Council in authorizing the City Manager to vote on behalf of the City’s property in the recent storm drain election. Such authorization will allow the City to expeditiously cast its ballots. RESOURCE IMPACT Approval of the District will result in an estimated annual assessment of $76,000 for 30 years. In addition, construction of a non-parking area on the S/L lot will result in annual debt expense service that can range as high as $286,200. CMR:136:01 Page 1 of 2 POLICY IMPLICATIONS Council will delegate authority to the City Manager to cast City ballots in an assessment balloting procedure. This action is consistent with prior Council direction. TIMELINE City ballots will be cast prior to the public hearing on the University Assessment District on March 19, 2001. ENVIRONMENTAI, ASSESSMENT An Environmental Impact Report for the parking structures was prepared as part of the PC zoning application and was certified by Council on December 20, 1999, by adoption of Resolution No. 7917.
