Cl131960 WITH DES ARCHITECTS & ENGINEERS IN AN AMOUNT NOT TO EXCEED $24,220 FOR SERVICES ASSOCIATED WITH ADDITIONAL DESIGN DEVELOPMENT, CONSTRUCTION DOCUMENTS, BID ASSISTANCE AND REIMBURSABLE EXPENSES FOR IMPROVEMENTS TO THREE BAYLANDS PARKING LOTS AND HARBOR ROAD (CIP 10003) RECOMMENDATION Staff recommends that Council authorize the City Manager or his designee to execute Amendment No. 1 to contract Cl131960 with DES Architects & Engineers, increasing maximum compensation by an amount not to exceed $24,220 for a total contract amount not to exceed $124,006. BACKGROUND In May 2001, Council approved a consultant services contract with DES Architects & Engineers to provide design development and construction drawing services for surfacing improvements to three parking lots and Harbor Road in the Baylands Nature Preserve. Final design plans and specifications were generated and the two parking lots at Harbor Point and Byxbee Hills were packaged together as a single IFB in March 2002. Funding for construction of improvements to the Evans Interpretive Center parking lot and the widening of Harbor Road is included in the FY 2003-04 and FY 2004-05 budgets, and these projects will be advertised as the funding becomes available. At its June 24, 2002 meeting, Council considered a contract with Bragato Construction, Inc. for the project at Harbor Point and Byxbee Hills and decided that approval of the contract would be contingent on review and approval of the plans by the Architectural Review Board. This review process has resulted in an increase in the number of public meetings attended by the consultant as well as several revisions to the plans and specifications outside the original scope of work. CMR:438:02 Page 1 of 2 DISCUSSION The expanded scope of work covered by the proposed amendment will include preparation of conceptual design alternatives and a revised set of construction documents based on the final approved design for the Harbor Point lot. It will also include revising the drawings to allow the Harbor Point and Byxbee Hills lots to be considered separate construction projects and cover the additional time and materials associated with the increased public meeting demands of the site and design review process. RESOURCE IMPACT Funds for this project are available in the Capital Improvement Program Project 10003 for open space road and parking lot repair. POLICY IMPLICATIONS This recommendation does not represent any change to existing City policies. The improvement projects further Policy N-1 and Program C-19 of the Comprehensive Plan, and are in conformance with the Baylands Master Plan. ENVIRONMENTAL REVIEW This project is categorically exempt under Section 15301 of the California Environmental Quality Act. CI131960 BETWEEN THE CITY OF PALO ALTO AND DES ARCHITECTS & ENGINEERS FOR CONSULTING SERVICES This Amendment No. One to Agreement No. CI131960 ("Agreement") is entered into , by and between the CITY OF PALO ALTO ("CITY"), and DES ARCHITECTS & ENGINEERS, a California corporation, located at 399 Bradford Street, Redwood City, California 94063 ("CONSULTANT"). RECITALS: WHEREAS, the Agreement was entered into between the parties for the provision of consulting services; and WHEREAS, the parties wish to amend the Agreement; NOW, THEREFORE, in consideration of the covenants, terms, conditions, and provisions of this Amendment, the parties agree: SECTION i.Paragraph 5.1.1 of Section 5 entitled "COMPENSATION" is hereby amended, to read in its entirety as follows: 5.1.1 In consideration of the full performance of the Basic Services, including any authorized reimbursable expenses, CITY will pay CONSULTANT a fee not to exceed One Hundred Twelve Thousand Five Hundred Six Dollars ($112,506.00). The amount of compensation will be calculated in accordance with the hourly rate schedule set forth in Exhibit "B", on a time and materials basis, up to the maximum amount set forth in Exhibit "B- i" for each phase of the work. The fees of the consultants, who have direct contractual relationships with CONSULTANT, will be approved, in advance, by CITY. CITY reserves the right to refuse payment of such fees, if such prior approval is not obtained by CONSULTANT. SECTION 2. Paragraph 5.1.2 of Section 5 entitled Compensation is hereby amended to read in its entirety as follows: 5.1.2 The amount of compensation for Additional Services, if any, shall not exceed Eleven Thousand Five Hundred dollars ($11,500.00).Payment for Additional 021211 sdl 7060549 Services,if any, shall be based on the rate schedules in Exhibit "B".. SECTION 3.Exhibit ~B" to the contract is hereby amended to include Exhibit "B-I", a copy of which is attached hereto and is incorporated in full by this reference. Exhibit ~B- 1~ shall supercede in its entirety the single page in Exhibit ’~B" entitled ~Exhibit B: Rate Schedule. Project Title: Design Services for Improvements to Three Baylands Parking Lots and Widening of Harbor Road" which sets forth the maximum compensation for each phase of the consultant’s work. SECTION 4.Except as herein modified, all other provisions of the Agreement, including any exhibits and subsequent amendments thereto, shall remain in full force and effect.
