HILL ROAD, TWO AREAS ALONG THE SOUTH ..SIDE OF
QUARRY ROAD AND THE NEW PASTEUR DRIVE AND
ADJACENT LAND BETWEEN SAND HILL ROAD AND WELCH
ROAD
RECOMMENDATION:
Staff recommends that the Council adopt the attached revised resolutions approving the
annexation of:
¯the edge portion of a segment of the south side of the new Sand. Hill Road
(annexation 02-01) --Attachment I;
¯the relocated Pasteur Drive and adjacent land (annexation 02-02)--Attachment
II; and
¯two edge portions of Quarry Road between Arboretum Road and E1 Camino
Real (annexations 02-03 and 02-04)--Attachments III and IV.
DISCUSSION
On May 6,..2002, the Council approved resolutions annexing four areas in the Sand Hill
Corridor (CMR 232:02). Santa Clara County Local Agency Formation Commission
(LAFCO) has since informed City staff that those resolutions lacked required language
detaching the annexed areas from the Santa Clara County Library Services area. The
attached resolutions have been revised to include the language required by LAFCO.

RESOLUTION OF THE COUNCIL OF THE CITY~ OF PALO
ALTO MAKING DETERMINATIONS AND APPROVING THE
REORGANIZATION OF TERRITORY DESIGNATED "SAND
HILL ROAD RIGHT-OF-WAY 02-01",PROPERTY LOCATED
ON SAND HILL ROAD BETWEEN SAN FRANCISQUITO CREEK
AND APPROXIMATELY 275 FEET WEST OF ¯ PASTEUR
DRIVE; APPROXIMATELY 3.192 ACRES
[ASSESSOR PARCEL NUMBER 142-05-019]
~WHEREAS, a petition for the annexation of c~rtain
territory to the City of Palo Alto and detachment of said
territory from the County of Santa Clara, consisting of 3.192
acres on Sand Hill Road. (APN 142-05-019) has been ~filed by
Stanford University;
WHEREAS, on April 15~ 2002, the City Council adopted
Resolution No. 8144 initiating proceedings for annexation ofthe
area designated as ~Sand Hill Road Right-of-way 02-01";
WHEREAS, said territory is uninhabited and the owner of
the land included in the proposal consent to this annexation;
and
WHEREAS, section 56757 of the California Government coda
states that the Local Agency FormatiOn Commission shall not
review any annexation proposal to any City in Sant~ Clara County
of unincorporated territory which is within the urban service
area of the city if initiated by resolution of the legislative
body and therefore the City Council of the City of Palo Alto is
now the conducting authority for said annexation;
WHEREAS, Government Code Section 56663(a) provides that
if a petition for annexation is signed by all owners of land
within the affected territory, the City Council may approve or
disapprove the.annexation without public hearing.; and
WHEREAS, evidence was presented to the City Council;
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Palo Alto does find and determine that:

to Section 56757 of the Government code for the
annexation of property designated ~Sand Hill Road

Right-of-way 02-01", more particularly described in
Exhibits "A and B";
That said territory is uninhabited and comprises
approximately 3.192 acres.
That the annexation is consistent with the orderly
annexation of territory within the City’s urban
service area and is consistent with the City policy
of annexing when providing City services.
The City Council has certified, on June 30, 1997,
an Environmental Impact Report evaluating the
provision of a widened Sand Hill Road.
That the Territory is within the city urban service
area as adopted by the Local Agency Formation
Commission of Santa Clara County.
That annexation to the City of Palo Alto will
affect no changes in special districts.
That the County Surveyor has determined the
boundaries of the proposed annexation to be
definite and certain, and in compliance-with the
Commission’s road annexation policies and the City
shall reimburse the County for the actual cost
incurred by the County Surveyor in making this
determination.
That the proposed annexation does not create
islands or areas in which it would bedifficult to
provide municipal services.
That the proposed annexation does not split lines
of assessment or ownership.
That the proposed annexation is consistent with the
City’s General Plan.
Thatthe territory to be annexed is contiguous to
existing City limits.
In that no conditions were imposed by LAFCO on
inclusion of the area within the urban service
area, the City has complied with State Government
Code section 56757(c) (7) regarding compliance with
provisions imposed by LAFCO.

That all affected local agencies that will gain or
lose territory as a result of this reorganization
have consented in writing to a waiver of protest
proceedings.
That the property owner has been provided written¯
notice of this proceeding and no opposition has
been received.
SECTION i. That said annexation is hereby ordered
without any further protest proceedings pursuant to Government
Code section 56663.
SECTION 2. That upon completion Of these reorganization
Proceedings, the territoKy annexed shall be detached from the
County of Santa Clara Library Services area.
SECTION 3. That upon completion of these reorganization
proceedings, the territory reorganized will be taxed on the
regular county assessment roll, including taxes for existing
bonded indebtedness.

The City Council has certified, on June 30, 1997,

Pasteur Drive and creation of a new developable
parcel resulting from the Pasteur Drive relocation.
The City Council on August 14, 1997 enacted an
ordinance pre-zoning the subject territory with the
Public Facilities (PF) and Multiple Family
Residential (RM-40) zoning designations
That the Territory is within the city urban service
area as adopted by the Local Agency Formation
Commission of Santa Clara County..
That annexation to the City. of Palo Alto will
affect no changes in special districts.
That the County Surveyor has determined the

WHEREAS, on April 15, 2002, the City Council adopted
Resolution No. 8146 ting proceedings for annexation of the area
designated as "Quarry Road Right-of-way 02-03";
WHEREAS, said territory is uninhabited and the owner of
the land included in the proposal consent to this annexation;
WHEREAS, Section 56757of the California Government code
states that the Local Agency Formation Commission shall not
review any annexation proposal to any City in Santa Clara County
of unincorporated territory which is within the urban service
area of the city if initiated by resolution of the legislative
body and therefore the .City Council of the City of Palo Alto is
now the conducting authority for said annexation;
WHEREAS, Government Code Section 56663(a) provides that
if a petition for annexation is signed by all owners of land
within the affected territory, the City Council may approve or
disapprove the annexation without public hearing; and
WHEREAS, evidence was presented to the City Council;
NOW, THEREFORE, BE IT RESOLVED that the City Council of
the City of Palo Alto does find and determine that:
a.o The Council is the conducting authority pursuant, to
Section 56757 of the Government code for the
annexation of property designated ~Quarry Road
Right-of-way 02-03", more particularly described in
Exhibits "A and B";

That said territory is uninhabited ahd comprises
approximately 0.061 acres.
That the annexation is consistent with the orderly
annexation of territory within the City’s urban
service area and is consistent with the City policy
of annexing when providing City services.
The City Council has certified, on June 30, 1997,
an Environmental Impact Report evaluating the
provision of a widened Quarry Road.
That the Territory is within the city urban service
area as adopted by .the Local Agency Formation
Commission of Santa Clara County.
That annexation to the City of Palo Alto w~ll
affect no changes in speclal districts.
That the County Surveyor has determined the
boundaries of the proposed annexation to be
definite and certain, and in compliance with the
Commission’s road annexation policies and the City
shall reimburse the County for the actual cost
incurred by the County Surveyor in making this
determination.
That the proposed annexation does not create
islands or areas in which it would be difficult to
prowide munlcipal services.
That the proposed annexation does not split lines
of assessment or ownership.
That the proposed annexation is consistent with the
City’s General Plan.
That the territory to be annexed is contiguous to
existing City limits.
In that no conditions were .imposed by LAFCO on
inclusion of the area within the urban service
area, the City has complied with State Government
Code section 56757(c) (7) regarding compliance with
provisions imposed by LAFCO.
That all affected local agencies that will gain or
lose territory as a result of this reorganization

have consented in writing to a waiver of protest
proceedings.
That the property owner has been provided written
notice of this proceeding and no opposition has
been received.
SECTION i. That said annexation is hereby ordered
without any further protest proceedings pursuant to Government
Code section 56663.
SECTION 2. That upon completion of these reorganization
proceedings, the territory annexed shall be detached from the
County of Santa Clara Library Services area.
SECTION 3. That upon completion of these reorganization
proceedings, the territory reorganized will be taxed on the
regular county assessment roll, including taxes for existing
bonded indebtedness.

~WHEREAS, a petition for the annexation of certain
territory to the City of~ Palo Alto and detachment of said
territory from the County of Santa Clara, consisting of 0.250
acres on Quarry Road (APN 142-04-014) has been filed byStanford
University;
WHEREAS, on April 15, 2002, the City Council adopted
