IN AN AMOUNT NOT TO EXCEED $474,290 FOR CONSTRUCTION OF HARBOR POINT AND BYXBEE PARK PARKING LOT IMPROVEMENTS RECOMMENDATION Staff recommends that Council: ~ 1. Approve and authorize the Mayor to execute the attached contract with Bragato Construction Inc. in an amount not to exceed $474,290 for construction services to implement Harbor Point and Byxbee Park parking lot improvements. 2.Authorize the City Manager or his designee to negotiate and execute one or more change orders to the contract with Bragato C’onstruction Inc. for related, additional but unforeseen work that may develop during the project, the total value of which shall not exceed $47,000. DISCUSSION Proiect Description The work to be performed under this contract consists of landscape improvements at Harbor Point and Byxbee Park parking lots in the Baylands Nature Preserve including: regrading, compacting and resealing parking lot surfaces with decomposed granite and non-petroleum based stabilizer, storm drainage improvements, restriping of parking areas, installation of wheel stops and bike racks, installation of bollard and chain fencing around parking lot perimeters and improvements to pedestrian pathways. Bid Process A notice inviting formal bids (IFB) for Harbor Point and Byxbee Park Parking Lot Improvements was sent on February 26, 2002 to eleven contractors. The bidding period was 28 days, and there were no responses to the IFB on the designated date of March 26, 2002. Reasons given by contractors for not submitting bids included heavy ongoing workload, failure to secure required performance bonds by the bid deadline, and CMR:218:02 Page 1 of 3 prohibitive travel distance to the job site from the sole local supplier of the non-petroleum CMR:218:02 Page 2 of 3 based binding agent specified for use on the parking lot surface. Pursuant to the provisions for "No Bids Received" contained under Paragraph 2.30.130 (f) of the Municipal Codb, staff contacted two plan holders who did not submit bids by the original deadline but who indicated an interest in completing the project. Staff received one bid in response, from Bragato Construction Inc. in the amount of $474,290. City Council approval for this service is requested without further competitive bidding. The bid is 25 percent above the engineer’s estimate of $360,000. Staff checked references supplied by the contractor for previous work performed and found no significant complaints. Staff also checked with the Contractor’s State License Board and found that the contractor has an active license on file. RESOURCE IMPACT Funds for this contract are included in the City Manager’s proposed 2001-2003 budget. Approximately $40,000 will initially be borne by the Infrastructure Reserve. Staff has applied for a grant of $179,000 from the Roberti-Z’berg-Harris Urban Needs Basis grant program of the Safe Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection Bond Act of 2000 (Proposition 12). Should this grant be approved as expected, the money will be used to offset the Infrastructure Reserve funding. POLICY IMPLICATIONS The proposed Harbor Point and Byxbee Park Parking Lot Improvements is consistent with existing City policy including the 1991 Baylands Master Plan. ENVIRONMENTAL REVIEW This project is Exempt as defined by the California Environmental Quality Act (CEQA).
