Recommendation
Staff requests the Finance Committee recommend that the City Council approve changes to the
Fiscal Year 2012 Municipal Fee Schedule.
Background
Local governmental operations are primarily funded from taxes, user fees, fines and grants.
“User fee services” are those services that are performed or provided by a government agency
on behalf of a private citizen or group. The starting assumption underlying most fee
recommendations is that services benefiting specific individuals – as opposed to the community
as a whole – should be paid for by the individual(s) receiving the benefit. However, there are a
number of factors that influence cost recovery levels, including elasticity of demand, economic
incentives (or disincentives) and the extent to which a particular service benefits the
community at large as well as specific individuals or groups.
Best practices and professional guidelines indicate that a comprehensive analysis of all user
fees and recovery levels should be conducted at least every three to five years. The City
recently retained MGT of America (“MGT”) to conduct a detailed cost of services study of user
fee activities. MGT will also survey comparable fees charged by other cities as part of their
analysis. We anticipate that MGT will complete their review in June and we will then schedule
time to bring this to the Council for discussion and direction. Given that the information will
illustrate the extent to which certain services are being subsidized by taxpayers’ funds, we
expect one area of focus will be the question of who benefits from – and who should pay for –
any given service. MGT will provide industry guidelines and suggestions in regard to this matter
as well.
Discussion
Fiscal Year 2013 fee adjustments are being forwarded to the Council for review in two stages.
In the initial stage, staff is proposing a 3% increase to most fees as well as implementation of a
5% technology fee to fund technology projects (more discussion on this follows in the report).

Once the Council has reviewed and discussed the cost of services study, additional changes may
be made to the budget and fee schedule.
The FY 2012 Municipal Fee Schedule included only minor fee changes that resulted in a
projected total revenue increase of approximately $100,000. Other fee increases were
deferred pending completion of the cost of services study. Due to a delayed start date, MGT’s
analysis could not be finalized prior to completion of the FY 2013 Proposed Budget document.
Therefore, given significant increases in pension and other benefit costs in the past few years,
we asked departments to include an overall increase of 3% in fee revenues in their FY 2013
budget submittals. Some of the benefit cost trends the City has experienced include the
following:
Between FY 2004 and 2012, average medical cost per employee increased 74%,
from $609 per month to $1,059 per month
Between FY 2002 and 2012, total citywide health care expenditures grew 126% -
from $6.6 million to $14.9 million
Between FY 2002 and 2012, total citywide pension expense increased 529% -
from $3.8 million to $23.9 million
The City’s latest retiree medical actuarial valuation stated the City’s unfunded
liability had grown by $30 million, or 29%, since the previous valuation in 2009.
That meant the City had to set aside an additional $2.8 million in FY 2012 – a
total of $12.6 million- towards its retiree medical liability. In FY 2013, that
number will grow by an additional to $12.8 million.
The 3% increase to most fees is expected to generate an additional $570,000 in FY 2013 in
order to partially offset the increasing employee benefit costs associated with departmental
fees. Based on prior years’ fee analyses and rising benefit costs, the fees will still remain below
full cost recovery levels (in some cases, far below). Once the cost of services study is complete,
additional fee modifications can be discussed. All changes proposed at this time are shaded on
the fee schedule.
Please note that development-related fees are proposed to increase by slightly more than one
percent based on the Engineering News Record (ENR) building and construction index for the
San Francisco Bay Area. A review of the City’s development impact fees is underway and the
results of that analysis will be reported to the Council in the fall.
Technology Fee
In addition to the 3% increase in departmental fees and revenues, the FY 2013 Proposed Fee
Schedule reflects a 5% increase to cover the anticipated cost of technology components related
to Citywide solutions. Prior to the arrival of the Chief Information Officer (CIO), the Office of

Management and Budget introduced the expansion of the technology fee to other General
Fund fees (i.e. beyond the existing 5% technology enhancement fee added to building permit
fees). This was done to dedicate revenues to technology initiatives and to lessen the fiscal
burden on the General Fund. All City departments currently receive “allocated charges” from
the Information Technology Department and these costs are reflected in the full cost of services
for each department. However, the allocated charges do not reflect full costs for technology
CIPs. These new revenues will be segregated and utilized specifically for technology projects.
The FY 2013 Proposed Budget Document includes $724,000 from technology fee revenues in
the Technology Fund (IT Department). The funds will be used to partially offset the cost of
projects such as the citywide telephone upgrade and enhancements to the employee self-
service (ESS) system. Future projects will be vetted through the IT governance process and
brought to the Council for consideration.
Financial Impact
Actual General Fund fee revenues for the past three fiscal years were as follows:
FY 2009 $15.9 million
FY 2010 $16.1 million
FY 2011 $18.9 million
The FY 2013 Proposed Budget includes $20.1 million in General Fund fee revenues. The
majority of the increase is not due to fee increases proposed for FY 2013 but, rather,
development related fee revenue that has increased substantially in recent years. The table
below depicts the growth in user fee revenues since 2009. PCE fee revenue is segregated to
illustrate the growth in all other (i.e. non-PCE) fees. The first table reflects what is included in
the FY 2013 Proposed Budget. Since Animal Services revenue was not included in the Proposed
Budget, the second table reinstates that revenue in order to provide an “apples and apples”
comparison of fee revenue growth since FY 2009.

The $1,265,501 increase in “all other fee revenues” (second table) can be further broken down
as follows:
A 68% in the Fire Department’s plan check fee revenues: $392,251
A 9% increase in the Fire Department’s paramedic fee revenues: $369,021
A 5% increase in CSD’s fee revenues: $337,926
Net increase of all other fees $166,303
Increasing all fees by 3% would provide approximately $570,000 in additional funding.
Department budget submittals included an additional $367,000 in revenue increases. To
reconcile the difference between the $570,000 projected revenue increase and the $367,000
included in departmental revenues, staff included approximately $200,000 in the non-
departmental budget. Further, an additional $185,000 of “placeholder” revenue was included
in the non-departmental budget in anticipation of additional fee increases that may be made
after reviewing the cost of services study. The Information Technology Department budget
includes $724,000 in technology enhancement revenues.

Classifications of Use and Fees
Class II - 501(c)3 Non-Profit Organizations: IRS recognized non-profit 501(c)3 organizations may receive a 50 percent reduction on basic
facility rental rates upon verification. Only facility rental rates may be reduced and all other fees, such as staffing and equipment, are
charged at the full rate. Non-profit organizations charging or collecting fees or raising funds are not eligible for reduced rates and basic fees
will apply. This does not apply to class registration fees.

Class III - Individuals, Groups, Organizations, and Businesses not charging fees: Basic rental fees apply.
Class I - City Use and City-Sponsored Activities: No charge for facility rental for events or activities, however, fees for attendants,
equipment rental, and special uses may apply. (Note: City facility use for City co-sponsored groups will be considered on a case by case
basis.)
Class IV - Business or Commercial Use: Individuals, groups, organizations, and businesses charging, collecting, or raising funds may rent
facilities and equipment at the basic rate plus 75 percent. The Art Center is not available for CLASS IV usage.
