HomeMy WebLinkAbout2003-11-10 City Council (4)City of Palo City Manager’s Repo TO:HONORABLE CITY COUNCIL FROM:CITY MANAGER DEPARTMENT: HUMAN RESOURCES DATE:NOVEMBER 10, 2003 CMR: 493:03 SUBJECT:APPROVAL OF AN ORDINANCE AMENDING THE MUNICIPAL CODE TO CREATE A NEW LIBRARY DEPARTMENT AND TO CREATE A NEW DEPARTMENT HEAD POSITION RECOMMENDATION Staff recommends the Council adopt an ordinance amending the Municipal Code to create a new Library Department and to create a new department head position, Library Director. Staff also recommends Council authorize a reclassification of a Staff Secretary position to an Administrative Assistant to support the new Library Director. DISCUSSION The City Manager proposed, in the 2003-05 Budget process, the creation of a Library Department and a new department head, Library Director. The Library has been a division of the Community Services Department. The Library Director position is currently vacant. The Palo Alto library system is undergoing a series of changes including reviewing the building and maintenance needs, support for the Library Advisory Committee, significant staffing concerns and a review of the number of branches and hours of operation. The vast majority of cities the size of Palo Alto that operate library systems have a separate library department. Staff believes it is in the City’s best interest to be organized in this manner. The benefits of creating a new department include: 1. Direct connection with City Manager and membership on the executive team. 2.Direct interaction and impact with the Library Commission to address the current library issues. 3.The Library budget will be independently reviewed as opposed to being incorporated into a larger department CMR: 493:03 Page 1of 2 4.It will be more attractive to prospective Library Directors and other professional candidates. The Municipal Code needs to be changed to create a new and separate department, making the Library Director an executive staff position reporting to the City Manager. The ordinance, which accomplishes this, is attached to this CMR. RESOURCE IMPACT The establishment of the Library Department will not impact the 2003-04 Adjusted General Fund Budget. The department will utilize the already approved resource levels as allocated to the Library Division within the Community Services Department (CSD). Any additional resources allocated to the new department will be drawn from other divisions within CSD. In the 2003-04 midyear report to Council, staff will amend the Table of Organization to reclassify a Staff Secretary to an Administrative Assistant for the new department. A separate department budget will be presented to Council for review during the 2004-05 interim-year budget process. POLICY IMPLICATIONS The action recommended by this report is consistent with City Council direction. ENVIRONMENTAL REVIEW This is not a project under the California Environmental Quality Act (CEQA). ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO AMENDING CHAPTER 2.08 OF TITLE 2 OF THE PALO ALTO MUNICIPAL CODE TO REVISE SECTIONS 2.08.020 [APPROVAL OF CITY MANAGER’S APPOINTMENTS],2.08.210 [DEPARTMENT OF COMMUNITY SERVICES]AND ADD SECTION 2.08.230 CREATING A NEW DEPARTMENT OF LIBRARIES The Council of the City of Palo Alto does ORDAIN as follows: SECTION i. Chapter 2.08 (Officers and Departments) of Title 2 (Administrative Code) of the Palo Alto Municipal Code is hereby amended by revising Section 2.08.020 to read as follows: 2.08.020 Approval of City Manager’s Appointments. Appointments to the following positions shall be made by the city manager with the approval of the council: (a) (b) (c) (d) (e) (f) (g) (h) (i) Assistant city manager; Director of administrative services; Chief of police; Fire chief; Director of human resources; Director of planning and community environment; Director of utilities; Director of public works - city engineer; Director of community services; and Director of libraries. SECTION 2. Chapter 2.08 (Officers and Departments) of Title 2 (Administrative Code) of the Palo Alto Municipal Code is hereby amended by revising Section 2.08.210 to read as follows: 2.08.210 Department of Community Services. (a) The community services department shall be under the direckion of the director of community services, who shall be accountable to the city manager. The duties of the director of community services shall be as follows: (i) To formulate for approval plans and programs as they relate to the identified social needs of the community 031104 syn 0091389 1 either directly or in cooperation with the resources of the community; (2) To provide staff advisory and technical assistance to the human relations commission, the public arts commission, and such similar groups that may be created or established; (3) To maintain landscaped areas including district and neighborhood parks, miniparks, athletic fields, fire stations and utility grounds in a safe and aesthetic manner; (4) To manage the use, scheduling, and operation of municipal playgrounds, swimming pools, community centers, camps, athletic centers and fields, golf courses, theaters, cultural centers, museums, interpretative centers, libraries, parks, and activities connected therewith; (5) To provide and develop programs for increased knowledge, artistic expression, physical activity, social help, and enjoyment of the outdoors; (6) To perform or cause to be performed all duties required by this code or other law of the director of arts and culture, director of human services, ~~ ~ i~~ director of parks and golf, and the director of recreation, open space and sciences; and (7) To perform other such duties as may be required. (b) For organizational purposes, the department of community services shall consist of the following divisions: arts and culture; human services, parks and golf’, =~~~ ..... services; and recreation; open space and sciences. SECTION 3. Chapter 2.08 (Officers and Departments) of Title 2 (Administrative Code) of the Palo Alto Municipal Code is hereby amended by adding Section 2.08.230 to read as follows: 2.08.230 Department of Libraries. (a) The department of libraries shall be organized and administered under the direction of the director of libraries who shal! be accountable to the city manager. The duties of the director of libraries shall be as follows: (i) To manage, operate, direct, and control a continuing municipal library system providing reading, 031104 syn 0091389 2 reference, and related informational services for the residents of Palo Alto; (2) To provide administrative support for the library advisory commission on matters relating to the department; (3) To generate appropriate reports as may required by county, state and federal agencies or by law; be (4) To review and approve adult, adolescent, and children’s service programs and activities, library publications and publication schedules, material selection policies, and all material purchase requests; (5)To review and approve technical services activities,including material selection, purchase and maintenance standards and procedures, insuring that materials meet the criteria of the American Library Association Bill of Rights and are available in sufficient quantity; (6) To recommend and monitor annual operating and capital improvement budgets, reviewing and exercising fina! approval authority over all library expenditures; establish and monitor inventory control systems for all library furnishings and material; and review and analyze fee structure and fee collection; (7) To perform or cause to be performed all duties required by this code or other law of the director of libraries and the department of libraries; and (8)To perform such other duties as may be required. (b) For organizational purposes, the department of libraries shall consist of a single division. SECTION 4. The City Council finds that this project is exempt from the provisions of the Environmental Quality Act ("CEQA") because it can be seen with certainty that there is no possibility that this project will have a significant effect on the environment.
