HomeMy WebLinkAbout2003-10-14 City Council (2)TO: FROM: City of Palo Alto City Manager’s Report HONORABLE CITY COUNCIL 1 0 CITY MANAGER DEPARTMENT: POLICE DATE:OCTOBER 14, 2003 CMR:448:03 SUBJECT:BUDGET AMENDMENT ORDINANCE ACCEPTING LOCAL LAW ENFORCEMENT BLOCK GRANT (LLEBG) FUNDS IN THE AMOUNT OF $12,397 RECOMMENDATIONS Staff recommends that Council adopt the attached Budget Amendment Ordinance (BAO) in the amount of $12,397 that amends the fiscal year 2003-04 budget to appropriate funds received by the City from the Federal Bureau of Justice Assistance (BJA) and allocated by Santa Clara County for the continuation of the Local Law Enforcement Block Grant (LLEBG) program. BACKGROUND The Federal Bureau of Justice Assistance (BJA) has again made funds available to local agencies under the LLEBG program for the purposes of reducing crime and improving public safety. The Police Department has applied for and been awarded LLEBG funds each year since 1996. In previous years, LLEBG funds have been used to fund a coordinator and various outreach activities for the City’s Positive Alternatives for Youth (PAY) program. Last year, the funds were used to pay for an outreach specialist who assisted the PAY Coordinator in working with the schools and referrals. New criteria set forth by the BJA precludes the use of LLEBG funds for current PAY activities. The Police and Community Services Departments are working together on various funding mechanisms for the continuation of the PAY program. DISCUSSION Staff intends to use LLEBG funds this year to develop and implement an Early Identification and Intervention System (EIIS), designed to identify, intervene and follow-up on police CMR:448:03 Page 1 of 3 employees exhibiting potentially problematic behavior. The intent of the program is to be used as a management tool to ensure that the organization, as well as individuals, operates with the highest standards of ethics and integrity. Funds will be used to purchase software that will enable the department to track internal affairs investigations, citizen complaints, and other forms of questionable behavior. The EIIS will be an important tool in the department’s range of systems to increase accountability and assure integrity. Conditions for acceptance of LLEBG funds are a public hearing to approve the expenditure request and the continuation of an advisory board that was formed in 1998. A change in membership of the board was required due to a change in the use of funds. A member of the community has been added to the board, composed of representatives from the Police Department, Santa Clara County District Attorney’s Office, and County Superior Court. RESOURCE IMPACT In compliance with the BJA requirements, the City has established a Local Law Enforcement (LLE) fund in the Federal and State Grants Special Revenue Fund. LLEBG funds in the amount of $12,397 have been deposited into the sub-fund. Matching funds in the amount of $1,377 are included in the Police Department’s non-salary budget and will be transferred to the LLE sub- fund. Approximately $1,500 in annual software maintenance will be included in the Police Department’s non-salary budget beginning in 2004-05. This BAO will not impact the Budget Stabilization Reserve. POLICY IMPLICATIONS Expenditures of funds associated with the grant funds are consistent with City policy. ENVIRONMENTAL ASSESSMENT This is not a project subject to CEQA requirements. ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO TO AMEND THE 2003-04 BUDGET TO ACCEPT AND EXPEND LOCAL LAW ENFORCEMENT BLOCK GRANT (LLEBG) FUNDING IN THE AMOUNT OF $12,397 AND TO TRANSFER MATCHING FUNDS IN THE AMOUNT OF $1,377 FROM THE POLICE DEPARTMENT TO THE LLEBG SUBFUND SECTION i. The Council of the City of Palo Alto finds and determines as follows: A. Pursuant to the provisions of Section 12 of Article III of the Charter of the City of Palo Alto, the Council on June 16, 2003 did adopt a budget for fiscal year 2003-04; and B. The Federal Bureau of Justice Assistance (BJA) has again made funds available to local agencies under the Local Law Enforcement Block Grants Program (LLEBG) for the purposes of reducing crime and improving public safety; and C. Staff intends on using LLEBG funds this year to develop and implement an Early Identification and Intervention System (EEIS), designed to identify, intervene and follow -up on police officers and other employees exhibiting potentially problematic behavior; and D. City Council authorization is needed to accept and expend the grant receipts as hereinafter set forth. SECTION 2. Grant revenue is increased and funds are hereby appropriated in the sum of Twelve Thousand Three Hundred Ninety- Seven Dollars ($12,397) to the Local Law Enforcement subfund in the Federal and State Grants Special Revenue Fund, from the BJA Block Grant. SECTION 3. The sum of One Thousand Three Hundered Seventy - Seven ($1,377) is hereby transferred from the Police Department non-salary budget in the Personnel Services Functional Area as matching funds to the Local Law Enforcement subfund in the Federal and State Grants Special Revenue Fund. SECTION 4. This transaction wil! not impact the General Fund Budget Stabi!i zation Reserve and future year annual ongoing software maintenance costs of $1,500 are anticipated. SECTION 5. As specified in Section 2.28.080(a) of the Palo Alto Municipal Code, a two -thirds vote of the City Council is required to adopt this ordinance. SECTION 6. The Council of the City of Palo Alto hereby finds that this is not a project under the California Environmental Quality Act and, therefore, no environmental impact assessment is necessary.
