FROM:CITY MANAGER DEPARTMENT: COMMUNITY SERVICES DATE: SUBJECT: SEPTEMBER 22, 2003 CMR: 337:03 AMENDMENT NO. 1 TO CONTRACT $2140023 BETWEEN THE CITY OF PALO ALTO AND JEFFERY REED IN THE AMOUNT OF $2,000 FROM CAPITAL IMPROVEMENT PROGRAM PROJECT 18617,ART IN PUBL~[C PLACES,FOR THE SUNFLOWERS PROJECT LOCATED AT 440 CAL]~FOP~NIA AVENUE RECOMMENDATION Staff recommends that Council authorize the Mayor to execute an amendment to the contract with Jeffrey Reed to increase the compensation by $2,000 for a total of $66,600 due to related additional but unforeseen work that developed during the project. BACKGROUND At its July 19, 2001 meeting, the Palo Alto Public Art Commission (PAC) approved the installation of Sunflowers, created by artists Jeffrey Reed and Jennifer Madden. Sunflowers has been installed and is located at 440 California Avenue. The prqiect is intended to serve as a demonstration of the viability of aiternate energy resources. Inspired by nature and powered by wind and sun, the sculptured seating area combines art, function, and energy efficiency. During the day, the sun charges solar panels hidden within the blossoms, while the wind rotates their petals. At night, the sculpture is lit by energy-saving diode lights, powered by a long-lived gel battery, for dining al fresco. Solar panels and lights will help to create an energy independent environment for decades to come. The public art project is funded in large part by the City of Palo Alto Utilities Department ($40,000), with additional support from California Avenue Area District Association (CAADA) ($5,000), Country Sun ($12,500), and the City of Palo Alto’s Art in Public Places program ($7,100). DISCUSSION The proposed cost of the PAC-approved project was originally $60,000. Prior to the completion of the prqject, the artist brought forward an additional change to the PAC that CMR:337:03 Page 1 of 2 changed the material of the seating from anodized steel to cast aluminum. Cast aluminum has greater durability, the seating wil! be sturdier, and the finish will be more dramatic and provide for an aesthetic contrast between the seaing and the bronze colored sunflower petals. At its November 21, 2002 meeting, the Public A~¢ Commission agreed to pay the artist aa additional 52,000 to cover unanticipated cost overruns, and an additional unbudgeted i 70 prqject hours the artist worked on designing, engineering and constructing the curved bench wall, bringing the total project cost to $66,600. Because this cost exceeds the $65.000 limit for City.’ Mana=er approval. Council approval is required for a contract change order. For Fabrication ~ Sb.zdio: 4 months ’After we have finalized the design and construction details, we need approximately four months to buy supplies and fabricate the bronze ta:~!es, kinetic sculptures, lighting and solar panels. For ~rnstallation on L~e Site: 5-4 weeks The first part of the site i~sta!!ation is the concrete slab, bench-wall and table footings. Then we udll i~stall the table-sculptures. Lastly we will install the plantings and trash cans.
