HomeMy WebLinkAbout2003-09-15 City Council (3)TO: City of Palo Alto City Manage Report HONORABLE CITY COUNCIL FROM:CITY MANAGER DEPARTMENT:ADMINISTRATIVE SERVICES DATE:SEPTEMBER 15, 2003 CMR: 426:03 SUBJECT:APPROVAL OF A BUDGET AMENDMENT ORDINANCE AMENDING THE 2003-04 MUNICIPAL FEE SCHEDULE TO CORRECT FOR AN INACCURATE FEE CHANGE RECOMMENDATION Staff recommends that the City Council adopt the attached Budget Amendment Ordinance (BAO) that amends the 2003-04 Palo Alto Municipal Fee Schedule to correct five fees that were inadvertently entered incorrectly (Attachment B). These fees must be correctly restored to retain full cost recovery of the services offered by the Development Center. A two-thirds vote of the City Council is required to amend the 2003-04 Municipal Fee Schedule. DISCUSSION With the adoption of the 2003-04 Municipal Fee Schedule, Council approved various cost recovery increases to development-related fees in the Planning Department. The affected fees are located on page 33 of the Fee Schedule related to building permits. These fees are collected by staff at the Development Center and are cost recovery. Inadvertently, these fees were entered incorrectly into the fee schedule that Council adopted on June 16, 2003. The correct fees are presented in Attachment B. In accordance with state law, the fee corrections will go into effect sixty (60) days after Council adoption. RESOURCE IMPACT The impact of the change to the development fees is minimal and already included in estimated revenue figures in the 2003-04 Budget. This correction as presented in the attached BAO has no impact on the General Fund Budget Stabilization Reserve (BSR) and no future year General Fund ongoing costs are anticipated as a result of this BAO. DRAFT ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO TO AMEND THE 2003-04 MUNICIPAL FEE SCHEDULE TO CORRECT FOR AN INACURATE FEE CHANGE SECTION I. The Council of the City of Palo Alto finds and determines as follows: A. Pursuant to the provisions of Section 12 of Article III of the Charter of the City of Palo Alto, the Council on June 16, 2003 did adopt a budget for fiscal year 2003-04; and B. In the adopted 2003-04 Municipal Fee Schedule, certain Planning Department building inspection fees were entered incorrectly; and C. These fees must be correctly restored to retain full cost recovery of the services offered by the Development Center; and D. The impact of the change to the development fees is minimal and already included in estimated revenue figures in the 2003-04 Budget and no further impact to the General Fund Budget Stabilization Reserve is anticipated as a result of this change; and E. City Council authorization is needed to amend the 2003-04 Municipal Fee Schedule as hereinafter set forth. SECTION 2. The Municipal Fee Schedule is hereby amended to reflect the changes shown in Attachment B, which is attached hereto and incorporated herein by reference. SECTION 3. As specified in Section 2.28.080(a) of the Palo Alto Municipal Code, a two-thirds vote of the City Council is required to adopt this ordinance. SECTION 4.
