HomeMy WebLinkAbout2003-03-31 City Council (2)TO: FROM: HONORABLE CITY COUNCIL CITY MANAGER DEPARTMENT: PLANNING AND COMMUNITY ENVIRONMENT DATE: SUBJECT: MARCH 31, 2003 CMR:210:03 COUNCIL REVIEW AND ADOPTION OF REPORT ON MEASURES TAKEN TO ALLEVIATE CONDITIONS LEADING TO ADOPTION OF INTERIM ORDINANCE PROHIBITING ESTABLISHMENT OF NEW GROUND FLOOR OFFICE USES IN THE CHA~ESTON CENTER AND MIDTOWN SHOPPING DISTRICT RECOMMENDATION Staff recommends that the City Council review and adopt this report as an official report describing the steps that are being taken to alleviate the conditions that led to the adoption of interim Ordinance No. 4781 prohibiting the establishment of new ground floor office uses in the Charleston Center and Midtown Shopping District. BACKGROUND On March 3, 2003 the City Council, by a four-fifths vote, adopted Ordinance 4781 prohibiting the establishment of new ground office uses in the Charleston Center and Midtown Shopping District. This ordinance was adopted on an interim basis, and will expire on April 17, 2003. State law requires that, 10 days prior to the expiration of the interim ordinance, the City Counci! issue a report describing the measures taken to alleviate the conditions leading its adoption. DISCUSSION In January 2001, the City Council, concerned about excessive pressure from office tenants on neighborhood shopping centers, approved interim ordinances preserving retail uses in the Charleston Center and Midtown Shopping District. These ordinances were extended twice on an urgency basis, and expired on March 2, 2003. On February 12, 2003, the Planning and Transportation Commission recommended that these ordinances be adopted on a permanent basis. On April 14, 2003, the City Council is scheduled to hold a public hearing on the permanent adoption of the ordinances, which will alleviate the conditions that led to the adoption of Ordinance No. 4781. This ordinance will need CMR:210:03 Page 1 of 2 to be extended in order for it to apply through the effective date of the permanent ordinances. By adopting this report the City Council will fulfill the requirements of Government Code §65858(d), which requires the Council, when it adopts an interim ordinance, to issue a report 10 days prior to its expiration describing the measures taken to alleviate the condition that led to its adoption. This report will fulfill that requirement for both Ordinance 4781 and for the extension of that ordinance, if adopted.
