DISCUSSION The Palo Alto Municipal Code (PAMC) authorizes the City Manager to award contracts for the purchase of supplies (materials and equipment), regardless of the dollar amount. The PAMC authorizes the City Manager to award contracts for services up to $65,000. Quarterly reports are required for supply contracts awarded by the City Manager over $65,000, and for service contracts awarded from $25,000 to $65,000. The attached report lists service contracts from $25,000 to $65,000 (Attachment A) and Attachment B provides blanket order supply contracts over $65,000 from September 2002 through December 2002. (Blanket orders are service or material contracts established for multiple purchases with a specific vendor for a specified length of time and dollar amount.) For items where no bids were received, awards were made in accordance to the Municipal Code. Revisions to the Code are being chafted by the City Attorney’s office to clarify the solicitation processes that are necessary to obtain these services. (a) Continuing Contracts. The city manager is authorized to enter into continuing contracts, not exceeding a value of $65,000.00 per year for any contract, for period of up to three years, provided that funds are budgeted and encumbered for the entire amount due over the term of the contract, or the contract is made subject to appropriation by the city council of amounts to become due in fiscal years subsequent to the contract’s execution, said appropriation occurring at a time when said funds are needed for expenditure for the current service or supplies being rendered or purchased, and provided that the initial transaction has been subject to the applicable bidding requirements of Section 2.30.130. (b) Continuing Software Maintenance. Notwithstanding subsection (a), the city manager is authorized to enter into continuing contracts for maintenance of licensed computer software, not exceeding $65,000.00 per year for any contract, for any period of time during which the city maintain licenses for the software, provided that the contracts are made subject to appropriation by the city council of the amounts necessary to fund the contract. (c) Cooperative Purchases. The manager of purchasing is authorized to participate with other public agencies in purchasing supplies, services, or a combination thereof, including contracting thereof, provided at least one participant therein substantially follows the bid and award requirements in this chapter, and the contract is executed on behalf of the city by the appropriate official. Page 1 of 2 2.30.140 Exceptions to competitive bidding. The restrictions and provisions of Section 2.30.130 requiring competitive bidding shall not apply to the following contracts, purchases, or transactions: (1) To contracts involving the obtaining of professional or specialized services such as, but not limited to, services rendered by architects, attorneys, accountants, auditors, engineers, information technology consultants, and other specialized or professional consultants; (2) Where calling for bids on a competitive basis is, in the opinion of the city manager, impracticable, unavailing or impossible; (3) Where the city’s requirements can be met solely by a single patented article or process; (4) Placement of insurance coverage; (5) When the public work is preformed by the city with its own employees; (6) Purchase of utility commodities for resale; (7) Rewards offered pursuant to Section 2.30.076.
