APPOINTING A COUNCIL
MEMBER TO THE BOARD OF THE SAN FRANCISCO BAY AREA
REGIONAL WATER SYSTEM FINANCING AUTHORITY
RECOMMENDATION
Staff and the Utilities Advisory Commission reconv-nend that the City Council appoint a
member of the City Council as a voting member of the board of directors of the San
Francisco Bay Area Regional Water System Financing Authority. Such appointment
shall continue at the pleasure of the Council, which resetwes the power and right to
appoint another individual at any time.
PROJECT DESCRIPTION
A complete description and background of the implementation of three pieces of
legislation pertaining to water can be found in a staff report (CMR:120:03) and its
attachment, a January 15, 2003 report to the UAC.
Each of the three bills provides value to Palo Alto and the other 27 members of the Bay
Area Water Users Association (BAWUA). Senator Jackie Speier’s bill, SB 1870, creates
a financing agency to allow the BAWUA agencies to finance their share of the San
Francisco Public Utilities Commission’s (SFPUC’s) capital improvement program (CIP)
to improve the reliability of the regional water system Palo Alto and the other BAWUA
agencies rely on. As a result of SB 1870, the San Francisco Bay Area Regional Water
System Financing Authority was created on January 1, 2003. One of the requirements of
CMR:121:03 Page 1 of 2
SB 1870 is for the g0veming bodies of the eligible public agencies, such as Palo Alto, to
appoint a director to the financing authority by March 1, 2003.
BOARD/COMMISSION REVIEW AND RECOMMENDATIONS
The UAC reviewed this recommendation and approved it by a 3-2 vote at its January 15,
2003 meeting. Dissenters felt that the pool of candidates for the director of the financing
authority should be broader than members of the City Council.

WHEREAS, the California Legislature, in enacting SB 1870
(Statutes 2002, Chapter 849), the San Francisco Bay Area
Regional Water System Financing Authority Act (the "Act"),
declared its intent to enable the local public entities that
rely on the San Francisco regional water system, acting
collectively, to secure funds necessary to implement
construction projects that wi!l improve the reliability of the
regional water system; and

SECTION 2. The Council finds that this is not a project
under the California Environmental Quality Act and, therefore,
no environmental impact assessment is necessary.
