TO: FROM: DATE: SUBJECT: City of Palo Alto City Manager’s Report HONORABLE REDEVELOPMENT AGENCY BOARD EXECUTIVE DIRECTOR DECEMBER 13, 2004 DEPARTMENT: CITY MANAGER CMR: 501:04 ANNUAL REDEVELOPMENT AGENCY MEETING AND REVIEW OF REDEVELOPMENT AGENCY ANNUAL REPORT RECOMMENDATION Agency staff recommends that the Palo Alto Redevelopment Agency Board: 1.Hold the annual meeting of the Palo Alto Redevelopment Agency for the activities for the year ending June 30, 2004 activities; and, 2.Review and accept the Palo Alto Redevelopment Agency Annual Report, which will be submitted to the California State Controller’s Office. BACKGROUND On July 9, 2001, the Palo Alto City Council adopted an ordinance declaring the need for a redevelopment agency to function in Palo Alto. The Council also declared the City Council to be the redevelopment agency and made the finding that the formation of a redevelopment agency "will serve the public interest and promote the public safety and welfare in an effective manner" in accordance with the Health and Safety Code section 33200. On May 10, 2004; Article 3 of the Redevelopment Agency Bylaws were amended by the City Council, acting as the Redevelopment Agency, to state that the annual meeting of the Agency shall be held in the last quarter of each calendar year. In addition, California State Redevelopment law requires that all redevelopment agencies, including the City of Palo Alto Redevelopment Agency, file an annual report with the California State Controller’s Office. DISCUSSION During the last fiscal year, staff has taken the following steps: The Mayor’s Ad Hoc Retail Committee contained several action items indicating that the City of Palo Alto should be open to a sufficiently sized redevelopment project that meets State legal requirements and responds to City goals. Recognizing that the RDA CMR:501:04 Page 1 of 2 has already been established, the City will be ready if an appropriate project area is developed. Staff remains convinced that redevelopment is one of several essential strategies related to economic retention and revitalization. Staff has begun the process of reviewing zones that would be appropriate and ’°right sized" project areas that meet the requirements of redevelopment. Following this review, it is anticipated that staff will return to City Council within the next six to nine months with recommendations about future directions for the redevelopment agency including the possibility of identifying possible project areas for further study. The am~ual report required by California State Law Section 33080.1 of the Palo Alto Redevelopment Agency is attached to this staff report for review and acceptance by the Agency board. The report includes: Independent Financial Audit Report Fiscal Statement of Previous Year’s Achievements Activities affecting Housing and Displacements RESOURCE IMPACT The cooperative agreement between the City and the Agency will be updated to include the $9,000 in expenditures incurred for fiscal year 2003-04. Staff does not amicipate incurring any new charges this fiscal year. POLICY IMPLICATIONS There are no policy implications at this time. RECITALS A. The City Council of the City of Palo ~Alto., acting pursuant to the Provisions of 6he California Community Redeve!opment Law, Health & Safety Code section 33000, et seq. has activated the Agency and has declared itself to constitute the Agency ~y Ordinance No. 4711~ adopted on August 5, 200!. B. Pursuant to the Community Redevelopment .Law, the Agency is performing a public function of the City and may have access to services and facilities of the City. C. The City and the Agency desire to enter into this Agreement for the’following purposes: (!) To set forth actm~_~es, services and facil~ties that the City will render for and make available to the AgencZ in furtherance of the activities and functions of the Agency under the Community RedevelopmentLaw; and (2) To provide that the Agency will reimburse the City for actions undertaken and costs and expenses incurred by it for and on behalf of the Agency. (3) To provide that the Agency will adopt an annual budget describing the revenues, debt, expenditures~ and City assistance that wil! be necessary to operate. AGREEMENT !. The City agrees to provide for the Agency with staff assistance, supplies, technica! services and other services and faci!i~i~_es of the City that the Agency may requi.re in carrying out its functions under the Community Redevelopment Law. Such assistance and services may include the services of officers, ~employees and specia! consultants. 2 The ’~,¯Cm~y may but is not required to, advance necessary .funds to the Agency or expend funds on behalf of the Agency for the preparation and implementation of a redevelopment plan, including, but not limited to, the costs of surveys, planning, studies and environmental assessments for the adoption of a redevelopment plan, the costs of accruisition, of the proper%y within the project area, demolition aAd clearance of properties acquired, bui.lding and site preparation, public improvements and relocation assistance to displaced residential and nonresidential occupantsas required by law. 3. The City will. keep records of activities and services undertaken pursuant to this Agreement and the related costs so that an accurate determination of the Agency’s liability to the City can be made. The City shall at. ieast annually submit to the Agency a .statement of the costs incurred by the City in rendering activities and services of the Ci.ty to the Agency pursuant to this Agreement. The statement of costs may include a proration, of the City’s administrative and salary e::pense attributable to services of City officials, departments rendered for the Agency. emp!oyees and 4. The Agency agrees to reimburse the City for al! costs incurred for services by the City pursuant to this Agreement from and to the extent, that funds are available, to the Agency for such purpose pursuant to Health and Safety Code section 33670, or from other sources provided, however, that the Agency shall have the sole and exclusive right to pledge any such sources of funds to the repayment of other indebtedness incurred by the Agency in carrying out the redevelopment project. The costs of the City under this Agreement will be shown on statements submitted to the Agency pursuant to Section 3 above. Although the parties recognize that payment may not occur for a few years and that repayment may also occur over a period of time, it is the express .intent of the parties that the City shall be entitled to repayment of the expenses incurred by the City under this Agreement, consistent~ with the Agency[s financial ability, in order to make the City whole as soon as practically possible. 5. The City agrees to include the Agency wfthin the terms of the City’s insurance~policies, if any, to the maximum extent permitted by law. The Agency~shall pay to the City its pro rata share of the costs of insurance applicable to its activities resulting from the Agency’s inclusion in the City’s policy. The City shall incur no liability whatsoever if it fails to secure insurance for the Agency. 6. The obligations of the Agency under this Agreement shall constitute an indebtedness .of the. Agency within uh_ meaning of Health & Safety Code sections 33670, et seq. to be repaidto the City by the Agency with interest at the rate of 6 percent (6%) per annum.
