HomeMy WebLinkAbout2004-08-09 City Council (8)TO: FROM: City of Palo Alto C ty Manager’s Report HONORABLE CITY COUNCIL 1 CITY MANAGER DEPARTMENT: POLICE DATE: SUBJECT: AUGUST 9, 2004 CMR:390:04 CONFIRMATION OF RESPONSE TO SANTA CLARA COUNTY GRAND JURY REPORT ON PROPERTY AND EVIDENCE ROOMS IN SANTA CLARA COUNTY RECOMMENDATIONS Staff recommends that Council confirm the attached response to the Santa Clara County Grand Jury report on property and evidence rooms. DISCUSSION In May 2004, the Santa Clara County Civil Grand Jury transmitted its final report, Inquiry into Police Evidence Rooms in Santa Clara County. California Penal Code Section 933 (c) requires that the governing body of a public agency which has been subject of a Grand Jury report provide a response to the .Presiding Judge of the Superior Court on the findings and reconamendations associated with the report within 90 days. Staff has prepared the response and requests that the Council approve it according to the statute. POLICY IMPLICATIONS This response is consistent with City policy. California Penal Code Section 933(c) requires that a governing body of the particular public agency or deparm~ent which has been the subject of a Grand Jury final report shall respond ~dthin 90 days to the Presiding Judge of the Superior Corot on the findings and recormnendations pertaining to matters under the control of the gove~aing body. California Penal Code Section 933.05 contains guidelines for responses to Grand Jm3’ findings and reconm~endations and is summarized in the attached form, which should be filled out and renamed.
