Cl131960 WITH DES ARCHITECTS AND ENGINEERS IN AN AMOUNT OF $13,460 FOR SERVICES ASSOCIATED WITH ADDITIONAL DESIGN DEVELOPMENT,CONSTRUCTION DOCUMENTATION,BID ASSISTANCE AND CONSTRUCTION ADMINISTRATIONFOR I_MPROVEMENTS TO THREE BAYLAN~S PARKING LOTSAND HARBOR ROAD (CW OS-00003) RECOMMENDATION Staff recolranends that Council approve and authorize the Mayor or his designee to execute Amendment No. 2 to contract C 1131960 with DES Architects and Engineers, expanding the scope of work and increasing maximum compensation by an amount of $13,460 for a total contract amount not to exceed $134,966. BACKGROUND In Max, 2001, Council approved a consultant services contract with DES Architects and Engineers to provide design development and construction drawing services for surfacing improvements to three parking lots and Harbor Road in the Baylands Nature Preserve. Final design plans and specifications were generated for all components of the project, mad the two parking lots at Harbor Point and Byxbee Hills were packaged together as Phase One in a single Invitation For Bid in 2002. This first phase of the project was then postponed for a 3’ear in order to complete an extensive site and desig~ review process that would also be necessary for a!l subsequent phases of the project. The expanded site and desig-n review process was not included in the consultant’s original scope of work, and Amendment No. 1 to the contract was approved in December 2002 to coyer these additional services as the3’ pertained to the two parking lots in Phase One. Construction for this phase was finally completed in October 2003. DISCUSSION Compensation for the additional site and design review process, bid assistance and construction support for Phases Two and Three was not included in Amendment No. 1 due to that fact that construction of these phases was predicated at the time on future funding. That funding is now available for Phase Two: renovation of the Evans Interpretive Center Parking CMR:161:04 Page 1 of 2 Lot. Therefore, the site and design review process can comrnence for that phase of the project as soon as the contract is amended to include this additional work, which has resulted in an increase in the number of public meetings and staff conferences attended by the consultant as well as several revisions to the plans and specifications that are outside the original scope of work. The expanded scope of work covered by the proposed amendment wi!l include preparation of design alternatives and a revised set of construction documents based on the final approved design for the Evans Interpretive Center. It will also cover the additional time and materials associated with the increased public meeting demands of the Site and Desi~ Review process. It is not anticipated that sufficient funding for construction of Phase Three, Harbor Road Widening, will become available at any point in the immediate future and therefore additional tasks associated with that phase of the project will not be incorporated into the consultant’s scope of work at this time. RESOURCE IMPACT Funds for this amendment are available in the Capital Improvement Program, Project OS- 00003 for open space road and parking lot repair. POLICY IMPLICATIONS This recolrunendation does not represent an?, change to existing Cib, policies. The improvement projects further Policy N- 1 and Pro~am C- 19 of the Comprehensive Plan, and are in conformance with the Baylands Master Plan. ENVIRONMENTAL REVIEW This project is categorically exempt under Section 15301 of the California Enviroranental Quality Act. FOR CONSULTING SERVICES This _Amendment No. Two to Agreement No. C!131960 ("Agreement") is entered into , by and between the CITY OF PALO ALTO ("CITY"), and DES ARCHITECTS & ENGINEERS, INC., a California corporation, located at 399 Bradford Street, Redwood City, California 94063 ("CONSULTANT"). RECITALS: WHEREAS, the Agreement was entered into between the parties for the provision of design services for improvements to three Bay!ands parking !ots and improvements to Harbor Road; and WHEREAS, the Agreement was amended to expand the scope of services to include preparation of conceptua!-design alternatives and a revised set of construction documents for Phase One and to increase the amount of compensation by an additional $21,720; and ~SEREAS, the parties wish to amend the scope of services to include site and design review process, bid assistance and construction support for Phase Two and to increase the amount of the compensation by an additional $13,460. NOW, THEREFORE, in consideration of the covenants, terms, conditions, and provisions ~f this .Amendment, the parties agree: SECTION !.Paragraph 5.1.1 of Section 5 entitled "COMPENSATION" is hereby amended, to read in its entirety as follows: 5.1.1 In consideration of the full performance of the Basic Services, including any authorized reimbursable expenses, CITY will pay CONSULTANT a fee not to exceed One Hundred T%-enty-Four Thousand Nine Hundred Sixty-Six Dollars ($124,966.00). The amount of compensation will be calculated in accordance with the hourly rate schedule set forth in Exhibit ~B", on a time and materials basis, up to the maximum amount set forth in Exhibits ~B-!" and "B-2" for each phase of the work. The fees of the consultants, who have direct contractua! relationships with CONSULTANT, will be approved, in advance, by CITY. CITY reserves the right to refuse payment of ,such 040305 sdl 7060766 fees, if such prior approval is not obtained by CONSULTANT. SECTION 2. Paragraph 5.1.2 of Section 5 entitled Co~mensation is hereby amended to read in its entirety as fol!ows: 5.1.2 The amount of com_mensation for Additiona! Services, if any, shall not exceed Ten Thousand dollars ($i0,000.00). Payment for Additional Services, if any, shall be based on the rate schedules in Exhibits ~B-I" and "B-2"In no event shal! tota! compensation payable under this contract for both Basic and Additional Services exceed One Hundred Thirty-Four Thousand Nine Hundred Sixty-Six Dollars ($134,966). SECTION 3. The scope of services attached as Exhibit "A" to the contract is hereby amended to include the tasks described on Exhibits "B-!" and "B-2", a copy of which is attached hereto. SECTION 4. Exhibit "B~ to the contract is hereby amended to include Exhibits ~B-!" and "B-2", a copy of which is attached hereto and is incorporated in full by this reference. Exhibit "B- 1H and "B-2" shall supercede in its entirety the single page in Exhibit "BH entitled "Exhibit B: Rate Schedule.
