HomeMy WebLinkAbout2004-01-12 City Council (6)City of Palo Alto C ty Manager’s Rep r TO:HONORABLE CITY COUNCIL FROM:CITY MANAGER DEPARTMENT: PUBLIC WORKS 1 DATE: SUBJECT: JANUARY 12, 2004 CMR:124:04 SUPPLEMENTAL MEMO TO REVISE STAFF RECOMMENDATION IN CMR:101:04 TO INCLUDE THE ADOPTION OF A RESOLUTION ADOPTING THE MITIGATED NEGATIVE DECLARATION FOR THE MOUNTAIN VIEW / MOFFETT AREA WATER RECYCLING FACILITY This supplemental memo is not a substantive change to Council action on CMR:101:04 that is on the Council’s agenda tonight. RECOMMENDATION Staff recommends that Council adopt a resolution (Attachment A) adopting the Mitigated Negative Declaration (MND) for the Mountain View / Moffett Water Recycling Facility Project. This recommendation replaces recommendation 1 on CMR: 101:04. DISCUSSION The recommendation for the Council to adopt the Resolution for the MND was inadvertently omitted from the project CMR:104:04. The California Environmental Quality Act guidelines section 15074 requires the City Council to consider the negative declaration on the project and to find that there is no substantial evidence that the project will have a significant effect on the environment before approving the project. The resolution will document the Council’s finding of no significant impact and the actions adopting the MND and the mitigation monitoring and reporting plan. The MND identified the potential environmental effects of the Project. Mitigation measures have been incorporated into the project to reduce the potentially significant ¯ impacts to a less-than-significant level. These measures are described in the mitigation summary and monitoring and reporting plan that is part of the MND to be adopted (MND at page 3-1). The MND also contains the comments received on the draft MND and the project modifications made as a result of the comments. (IvIND, appendix C). The Council has already received copies of the MND with the CMR that also discussed the environmental analysis for the project. The City Council Resolution adopting the CMR:123:04 Page 1 of 2 MND references an Exhibit A. The Exhibit A is the same document as Attachment B in CMR:104:04. There has been no additional environmental analysis subsequent to that report. RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO ADOPTING A MITIGATED NEGATIVE DECLARATION FOR THE MOUNTAIN VIEW-MOFFETT AREA RECYCLED WATER RECYCLING FACILITY PROJECT PURSUANTTO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (03-D-07; 03-EIA-07) WHEREAS, the Mountain View-Moffett Area Recycled Water Recycling Facility Project (~Project") would replace a deteriorated recycled water pipeline to restore recycled water service from the Pa!o Alto Water Quality control Plant to Mountain View (Shoreline Area) and extend the pipeline to serve up to 1,200 acre-feet per year of recycled water for landscape irrigation in the Shoreline Area, the City of Mountain View North of Highway i01 and the Moffett Field Area. The Project is an expansion of the existing Regional Water Quality Control Plant Water Reuse Program; and WHEREAS, the City as the lead agency for the Project has prepared a Mitigated Negative Declaration for the Project. A Draft Mitigated Negative Declaration was released for a 30-day public comment period on October 31, 2003. A public meeting to hear public input on the Draft Mitigated Negative Declaration was held on November 19, 2003; and ~%~EREAS, the Mitigated Negative Declaration was prepared pursuant to the California Environmental Quality Act, Public Resources Code section 21000 et seq. ("CEQA") and the State CEQA Guidelines, California Code of Regulations, Title 14, section 15000 et seq. The Mitigated Negative Declaration including the project description, environmenta! checklist form, mitigation summary and monitoring and reporting plan, and appendices is attached as Exhibit ~A" to this Resolution and by this reference incorporated herein; and WHEREAS, the City Council has reviewed and considered the info_~mation contained .in the Mitigated Negative Declaration, including comments received and the responses to those comments; and WHEREAS, the Mitigated Negative Declaration was prepared by the City and the city environmental consultants and reflects their independent judgment and analysis. There is no substantial evidence on the basis of the record as a whole that 1340110 sm 0100181 ! NOT YET APPROVED the Project will have a significant effect on the environment; and NOW, THEREFORE, the Council of the City of Palo Alto does RESOLVE as follows: SECTION i. Mitigation Monitoring and Reporting Plan. The Mitigation Summary and Monitoring and Reporting Plan included in the Mitigated Negative Declaration attached as Exhibit A is hereby approved and adopted. SECTION 2. Adoption. The City Council finds that the Mitigated Negative Declaration has been completed in compliance with CEQA and adopts and approves it. The City Council has reviewed and considered the information contained in the Mitigated Negative Declaration, staff reports, oral and written testimony given at public meetings on the proposed Project and all other matters deemed material and relevant before considering the Project for approval. SECTION 3. No Recirculation Required. The City Council finds that no new significant information has been received that requires recircu!ation of the Mitigated Negative Declaration.
