RECOMMENDATION
Staff requests that the City Council confirm the process outlined in the staff report for
Council selection of a police auditor.
BACKGROUND
On May 23, 2006, the City’s purchasing staff sent out a request for proposal (RFP) to
potential applicants for the Police Auditor position. RFPs were sent to two retired judges,
a retired police chief, two retired police commanders, the Police Assessment Resource
Center (PARC) and the United States Ombudsman Association. Information about the
position was also conveyed to the County Police Chief’s Association. The deadline for
submittal of the proposals was June 13. Three proposals were received by the deadline
and one was received a day later. Only the three that were received on time were
reviewed. Staff then received word that one of the three was withdrawing from the
process. As a result, the two remaining proposals are attached for your review.
DISCUSSION
Staff has scheduled a special Council meeting on July 11 for Council to interview the two
candidates. At the Council meeting on Ju!y 17, Council will make a selection. Staff
would then return the contract to the Council for approval at the July 24 or August 7
Council meeting. Staff has made the assumption that the interviews and Council
discussion of the selection will occur as agendized items in public.
ALTERNATIVES TO STAFF RECOMMENDATION
The City Attorney had advised that the interviews and selection of the successful
candidate for the Police Auditor could be done in closed session.

OBJECTIVE
To be hired as the City of Palo Alto, contract Police Auditor. In that capacity, I
would draw upon my years of experience in police management, administration
and specifically as a prior Internal Affairs investigator and Professional Standards
Unit administrator to promote, maintain and insure complete, professional, and

Chapter I -Proposal Summary
As the initial contract Police Auditor for the City of Palo Alto my responsibility, would
include, but not be limited to, the establishment of a respected, qualified and professional
position within the City capable of independently reviewing, evaluating and reporting on
the scope, accuracy and veracity of citizen complaints and internal affairs investigations.
Additionally, after reviewing the complaints and investigations, an analysis and
evaluation would be made of the process and practices used insuring that the
investigators used "best practices" known at the time with respect to pertinent laws
effecting such investigations.
Furthermore, discussions with and reports to the Chief of Police, City Manager and City
Council would include a comprehensive evaluation of the quality of the investigations,
the identification of personnel trends and an evaluation of issues causing the complaints,
such as; training issues, officer conduct issues, policy and/or procedure deficiencies, or
community/police communication failures.
And finally, I would propose that the reports submitted by the Police Auditor would be in
a spreadsheet format with statistical data displayed in a manner that would easily.identify
trends. This spreadsheet report would be accompanied by a narrative report with detailed
explanations of the data. Personal discussions with the Chief of Police to explain and
clarify any identified issues would also be an integral part of the process.

Chapter 3 - Qualifications of the Firm

In addition to the attached resume, may I add:
I served with the San Mateo Police Department for 5 years working as a Field Training
Officer, motorcycle traffic officer and patrol officer.
I then laterally transferred to the Santa Clara Police Department in October of 1980. At
Santa Clara PD I worked patrol, was the Hit and Run Investigator, and then became a
motorcycle traffic officer.
Upon promoting to the rank of sergeant in 1993 and after a year in patrol, I became the
Department’s Training Sergeant and one of three Internal Affairs Investigators. My I.A.
investigations varied and ranged from unnecessary and excessive use of force, drug use
allegations, and conduct unbecoming an officer.
After two years, I became the Department’s first Commtmity Policing Sergeant and was
responsible for the Department’s transition from a reactive and traditional policing style
to a proactive community policing philosophy and practice. In addition, I chaired a
committee that re-wrote our department’s evaluation process and format to better
evaluate and ingrain the philosophies and practices of commtmity policing.
I then promoted to the rank of lieutenant in 1996 and took charge of the Community
Services Unit. This unit was responsible for the department’s School Resource Officers,
the DARE program, Crime Prevention, Permits Unit, Neighborhood Watch and Business
Watch programs. I then transferred to patrol as the weekend, swing shift Watch
Commander until my promotion to Captain in 2000. I served as the patrol division
Captain until 2001 when I was promoted to Assistant Chief.
As the Assistant Chief I directed the day-to-day operations of the police department and
it’s three divisions, managed and administered the Professional Standards (I.A.) unit and
managed the development and building of the City’s first police substation.
Specifically as it relates to the Police Auditor position, as Assistant Chief I was involved
in the management of the Professional Standards Unit including, but not limited to
upgrading the unit’s complaint tracking system, overseeing the development of a
comprehensive "I.A." manual for all police supervisors and managers, the managing of
an internal affairs investigation of a police officer, the officer’s termination and, after
lengthy hearings, the subsequent confirmation of the termination by the City’s Civil
Service Commission.
As evidenced above, I have a clear knowledge and understanding of police organizations,
responsibilities, functions, policies and procedures. As the police department’s training
sergeant I remain very familiar with training techniques and was a POST facilitator for
the annual Training Needs Assessment conferences.
I am a graduate of the San Jose State University’s, Internal Affairs Investigations course
and have recently been asked to teach at SJSU on the subject of Internal Affairs
Investigations and/or Police Management.
You will find, in talking with the people I have worked for and with, I have a reputation
for the highest standards of integrity and professionalism.
I have worked effectively with most every department within the City of Santa Clara and
was responsible for establishing and chairing the first citywide inter-departmental,
problem-solving task force.
I have a proven la-ack record of effectively speaking to special interest groups, city staff,
council members and was one of three City emergency services managers that developed
and implemented what the City Manager characterized as the "best" city emergency
operations training in years.
I retired in December of 2003, having served in local law enforcement for 28.5 years.

Based on the nature of this position, I would request that the City’s Risk Manager waive

Chapter 8 -Proposal Cost Sheet
I propose a $100/hour consultant fee. Using the five-year average of 7.5 internal affairs
investigations and 19 citizen complaint investigations I calculate a total of 28.5
investigations for review annually. On average, I have found that 4-hours of time are
generally required for a comprehensive review and evaluation of such investigations.
Adding in an hour of travel time the total is 5-hours per review.
Five hours of total time per review multiplied by the 28.5 average investigations per year
calculates to $14,250. With the additional reports/meetings with the Chief of Police and
the "N-annual" reports to the City Manager and City Council I estimate an additional 30
hours of time at $100/hour or $3,000.
Based on the above calculations, my annual estimated cost for services would be
$17,250.

CHAPTER 1: PROPOSAL SUMMARY
Dr. Alan Kalmanoff, (doing business as California Planners, "CP") is pleased to submit
this proposal to provide Contract Police Auditor Services to the City of Palo Alto.
Dr. Alan Kalmanoff, as the Auditor, is a nationally recognized authority on law
enforcement issues. As an expert on police complaints and grievances, he has trained law
enforcement officers for every police agency in the California over ten years for the
California Department Justice’s Advanced Training. He first developed grievance and
complaint procedures for. the Oakland Police Department in 1972..He has since directed
numerous studies that featured complaint processes, (e.g., San Diego Field Interrogation
Project, sponsored by the Ford Foundation) and investigations of police departments,
(Livermore, UC Berkeley, etc.) and directed law enforcement and criminal justice
projects in over 300 jurisdictions nationwide.
In the late 70’s he directed at Sexual Assault Investigation Training Study in Santa Clara
County, based in the Palo Alto Police Department (PAPD). Dr. Kalmanoff has designed
police complaint review procedures, reviewed thousands of complaints against police,
sheriff, and corrections personnel, worked for courts to review such complaints, and is
authoritative and widely respected as neutral and unbiased.
California Planners offers both extensive experience, superb objectivity, and proximity to
this project, with the capabilities and resources to provide comprehensive reviews of
investigations as needed and routine reports to keep the police department and city
informed on trends of complaints and internal investigations. The CP staff values
communication and mutual understanding of objectives and results of projects with
stakeholders.
This proposal highlights a nearby accessible expert, with staff, widely acquainted with
criminal justice and community organizations, experienced in stakeholder relationships

CHAPTER 2: PROFILE OF PROPOSING FIRM
California Planners (CP) is a nationally recognized, independent firm specializing
specifically in investigations and audits of law enforcement agencies and providing law
enforcement and corrections training and expert witness services.
CP has extensive experience in providing corrections training and has had thirty years of
experience in working with large and small groups in law enforcement and jail
management groupings, correctional administration, and judges. The small organizational
structure is composed of the Executive Director and Project Coordinator, who would
work directly under the City and the Palo Alto Police Department for the duration of the
contracted one year trial period.
CP is financially stable and selective with the projects that it chooses to take on, as it is
usually approached by state and local agencies seeking sensitive independent audits or
investigations. This selectivity ensures that CP has the adequate resources to provide
exceptional services for the selected projects. CP is fully capable of fulfilling all
requirements stated in the work plan for the review of investigations on an as-needed
basis, and for all requested reports and meetings with city and police department
representatives.

CHAPTER 4 - WORK PLAN
To accomplish the scope of work set out in the RFP, CP would make arrangements to
meet with all key stakeholders to clarify objectives, schedule, and project tasks. This will
facilitate the successful completion of the one year trial period for the Contract Police
Auditorship. After establishing the routine for receiving investigations for review
(including relevant documentation and proper file maintenance) and the procedures for
submitting reviews and thorough recommendations to the Police Chief, CP will regularly
review the citizen complaint investigations and internal affairs investigations as needed.
The reviews presented to the Chief will establish the appropriateness, objectivity, and
depth of inspection, and make detailed recommendations regarding the necessity of
further investigation on the case, if any, and investigation and disposition procedure
overall. All recommendations will be made first in the context of procedures and policies
established by the Palo Alto Police Department, and then based objectively on "best-
practice" guidelines on police conduct and proper investigation procedures observed both
in California and nationally. Current litigation relating to law enforcement misconduct
will also be serve as a guide for recommendations.
CP will meet the four-day deadline for reports on investigations through establishing a
detailed database of investigations to be reviewed and subsequent results of the reviews.
Dates will be carefully recorded and turn-around monitored to ensure timely results. This
database will also be the basis of summaries submitted to the Police Chief and city
officials, providing a simpte breakdown of the types of complaints and internal affairs
issues, dispositions, and recommendations. This database will also track issues that may
arise during the project period, providing vital information for quarterly and bi-annual
discussions.
Needless to say, Dr. Kalmanoff will be available for meetings, presentations, and report
production, as needed.

citizens as needed.

breakdown of types and dispositions.
6. Meet with the Police Chief, City Council, and City Manager as scheduled at the
beginning of the project, and as needed, with reports and issues arising during the
project.

CHAPTER 6 - PROJECT STAFFING
Alan Kalmanoff, JD, PhD, MSW - Project Director
Dr. Kalmanoff will be the only auditor on the project, conducting the reviews of the
investigations, generating reports and recommendations, and engaging in the scheduled
meetings. He will manage every aspect of the project, providing leadership, for each task.
Coordination, provided by Ms. Alice Lin, will ensure that Dr. Kalmanoff’s efforts and
time are expended most efficiently.
Dr. Kalmanoff is eminently qualified as a police auditor, as noted in attached table of
experience and various reference letters. His record includes the following appointments:
Director of an LEA Study of Police Investigative Function in 1974, Expert Consultant in
Narcotics and Dangerous Drugs for the US Department of Justice in 1980, and
Investigator for the Arkansas Office of the Governor looking at a serious corruption
scandal. He has conducted numerous additional investigations for jurisdictions including
Livermore, CA and UC Berkeley Police Departments, and was a Special Consultant for
the San Diego Police Department Field Interrogation Project (Ford Foundation), the San
Jose Police Department and the Alameda County, CA Sheriffs Department. He has
served as a Lead Trainer for the California Department of Justice Advanced Training
Center, and as a consultant for Police Departments in Salt Lake City, Omaha,
Birmingham, West Palm Beach, Tampa, Orlando, and Minneapolis, among many others.
He has also been solicited as an expert witness in Use of Force cases.
Dr. Kalmanoff was appointed Special Master by the Federal Court of Appeals to monitor
California state prison compliance with a major Federal settlement decree (of 600 pages).
Dr. Kalmanoff is also the Executive Director of the Institute for Law and Policy Planning
(ILPP), a non-profit agency dedicated to helping counties improve public safety while
" finding systemic solutions to relieving crowding in jails. His extensive work at the county
level includes projects in half the counties in California, police training in all the counties
in California, and projects in a wide range of counties, nationwide. ILPP has designed
data-based system action plans saving money in counties by making better use of
resources, for several hundred counties. I~PP is a national planning, research and policy
institute specializing in law enforcement and criminal justice, organizational needs
assessments, and program evaluation.
Dr. Alan Kalmanoff is educated as a lawyer, MSW, and PhD in City and Regional
Planning, all from the University of California, Berkeley. This is also where he has taught
in five departments, most recently at the Boalt School of Law at UC Berkeley, and he
authored "Criminal Justice Enforcement and Administration" (Little Brown). His
specialized law enforcement experience includes the use of force, field interrogation, and
training of potice officers in all aspects of dealing with the public. His analyses of how
law and justice agencies work and how they can be changed have resulted in improved
police and case processing, reduced costs, planning for development, and often include
ways to make better use of existing resources instead of new ones, (including better ways
to allocate staffing). His views on law and justice have been featured on "60 Minutes," as
well as in many newspaper, magazine, and journal articles.

Alice Lin - Project Coordinator
Ms. Lin will be providing data analysis, research, and administrative support throughout
the project. She will be responsible for maintaining files and documentation, as well as
the database of reviews, ensuring timely communication and submission of reports.
Ms. Lin has worked as a Research Associate for California Planners since 2004. She has
actively participated in ILPP’s facilitation work and jail studies, working with numerous
police departments nationally over the course of the studies. These departments include
the numerous 138 departments in Allegheny County, PA municipalities, the Fort Pierce
and Port St. Lucie Police Departments in Florida, and several agencies in Butte County,
CA.
She has been instrumental in data analysis and report production, and will provide these
services, as well as administrative coordination for this project. Through work on prior
projects, she has been involved in a research capacity on critical law enforcement issues
such as interoperability, chronic offenders, citation in lieu of arrest, and use of force. She
has provided best-practice content for memos and reviewed the policies and procedures
of numerous police departments on these topics.

Dr. Kalmanoff is a national expert on criminal justice; his assessment of

[ am sorry it’s taken so long to finally sit down and do this, but it has taken me a while to squeeze
in the time.
When I look back at your arrival and injection into the CJCC process, I really believe the end
result was positive. I believe your infusion into our process caused all of the entities involved to have to
sit down with each other and talk plainly and honestly about issues concerning all of them, Of the
contributions you made, the major accomplishment in my mind, is the continuing collaboration between
agencies which is reflective of that effort. 1 recognize that one of your techniques, whether intended or
not, was to make the various agencies collectively agree on their criticism of you, which took their mind
off their criticism of each other. Sometimes you have to take on that roll to make such a diverse
opinionated special interest group of executive’s start talking about the truth. Even though there is a long
way to go, I believe a great start Was made by these forced meetings and structure, and I am sure that the
continuing strategic planning process will continue.
The solidarity around the information system and now some more recent issues are seeing that
affect.
All in all, 1 think you really stirred up the pot and got people thinking and moving in the right
direction. I think that the only difficult issue was the time commitment to the Department Heads, which
eventually took their toll, especially when most CEO’s look for instant issues that they can pass off to
subordinates who complete and bring back to them for approval.

I have known Dr. Alan Kalmanoff for 36 years - from his law school and graduate work,
through employment by the County Bar Association during the crises of the ’70’s, through major
police investigation and monitoring work when I was Chancellor at the University of California
at Berkeley in the ’80’s, through his work as a Special Master for the Federal Appeals Court, and
as a professional who directed hundreds of studies of law enforcement systems nationally. He is
ideally suited for complex reviewing, investigating and monitoring roles whether studying
agencies directly, or presiding over settlement agreements between police, federal agencies, and
litigants.
Kalmanoff’s early work centered on policing, as he developed collaborative Bar Association and
police agency protocols for mass arrests, fashioned policies and procedures on the use of force,
and mediated between militant minority groups and law enforcement agencies.
In 1986, as Chancellor at Berkeley, I was confronted with large demonstrations and escalating
police/community conflict. I engaged Dr. Kalmanoffto investigate a major incident of
contention involving, as he discovered, the failure of the police to follow a plan to minimize
confrontation and later to suppress that fact. He managed the investigation .in a "fish bowl" of
scrutiny from hostile factions. He excelled in discovering the truth and remarkably maintained
the respect of multiple antagonistic parties. The officers whose actions he described maintained
that his report helped all to "understand" their actions, even as they were held accountable. As a
result he was seriously considered for the position of Chief of Police in Berkeley, and later urged
by many in the legal community to run for Sheriffin Alameda County.
His credibility remained high and I later engaged him to design a police complaint procedure and
a review protocol that endure nearly twenty years later, to develop and deliver training, and to
monitor difficult public incidents that persisted for over a year. He facilitated university-wide
meetings that educated others, solved problems, and gave excellent direction to the repairs
needed in police-community relations.

Nearly thirty years ago I read a five volume planning study
on California[s prisons, a document for the California
Legislature by Alan Kalmanoff. It demonstrated a real mastery
over what I knew to be complex topics, unusual courage in
its truthfulness, and great diplomacy in its tact.
As Director of the National Institute on Corrections, I
enwawed his services to train all the court appointed masters
in the U.S.; a task that further proved his skills, legal
acumen, and ability to work with strong egos in conflict.
He then helped me staff the Reagan Violent Crime Task Force.
Later, I recomended him for a corruption investigation of
a friend of the then governor over a southern prison system,
and again he showed courage, clarity and tact in bringing
the truth constructively to light. His extensive background
in police work enabled him to overturn a flawed police in-
vestigation, and his recommendations rescued a difficult
situation.
I am aware of his long list of police agency studies and
plans including investigations of police incidents, that
demonstrated skill and diplomacy, and resulted in construc-
tive change. He documented cover-ups in several agencies
and recommended improvements that resulted in widespread
support, evidence by his being called back to implement
many of his recommendations.
Dr. Kalmanoff was recently a Special Master for the Federal
District Court (Judge Karlton) in the nations’ largest
prison litigation, managing a half-dozen major California
prisons and a series of complex court orders, tremendous
pressures from all sides, and major new substantive learn-
ing (about mental health, pharmacy, program auditing, etc.).
I was a Special Master in a parallel case, and know how
challenging his assignment was. He excelled and earned
praise fmmm all sides (the prisons, the plaintiff and de-
fence, and various other interests). Thiswas no mean feat.

Dr. Kalmanoff has trained police in nearly every law enforce-
ment agency in California, a statement that demonstrates his~ -
great energy, that he is easily accepted in a variety of
settings, and holds a high value for police professionalism.
He was early involved in community based and problem solving
policing~, advanced training, and development of policies
on force and field stops that balanced his well-established
appreciation of patrol work with his expertise in constitutional
law (he still teaches at the UC Berkely Law School). As a

and Associates on the problems facing Douglas County and the City of Omaha in regard to criminal

I can say with all honesty that Dr. Kalmanoff’s approach was fair, open-minded, and designed to iden-
tify criminal justice problems which were costing the county more money every year. Dr. Kalmanoff’s
approach was to confront issues head on and, yet, to provide the individual agencies with the oppor-
tunity to correct perceived or identified deficiencies before any final report was issued. This ensured
that no agency received any "surprises" when the final report was issued.
Dr. Kalmanoff delivered exactly what was promised in his original presentation to the selection
committee, which was to give a fair and unbiased recommendation to the county concerning criminal
justice issues and recommendations on how to improve efficiencies, reduce backlog, free up jail
space, and develop a quality criminal justice system which will ensure fair and equitable treatment ofvictims and offenders. Dr. Kalmanoff’s recommendations, if fully implemented by Douglas County,
could have a significant impact on reducing criminal justice expenditures in the county while
improving the quality of our entire criminal justice system.
Therefore, I would, without reservation, recommend the Institute for Law and Policy Planning and Dr.

Caddo Parish (County) is currently 18 months into the process of
planning and constructing a new detention facility for our community.
At this juncture, the design phase is’ almost completed. To date, all
aspects of the project have met or exceeded our expectations. This has
not happened by accident.
In a joint effort, the Caddo Parish Commission and the Caddo
Parish Sheriff’s Office committed to a systematic and planned approach
toward making a new jail facility a reality. The key part of our
strategy would involve conducting a correctional facilities master plan.
The results of the plan would be delivered to the architectural firm for
their use.
The Caddo Parish Commission contracted with the Institute for Law
and Policy Planning out of Berkeley, CA, to provide the parish with a
needs assessment, master plan, and pre-architectural program. Dr.

Dr. Kalmanoff along with Mike Mc Namara, consulting architect, quickly
developed a relationship with key system players and were always
available to help guide us through this complicated but necessary
p roces s.
The Caddo Parish taxpayers have set aside 31 million .dollars to
construct a new detention facility. The $57,000 contact fee for ILPP
has been the essential ingredient for making those public construction
dollars well spent. Accordingly, and without reservation, I recommend
the expertise and professionalism of the Institute for Law and Policy
Planning.

The Institute for Law and Policy Planning (ILPP), under Alan
Kalmanoff’s direction, recently (1991) c~]pleted a difficult jail
overcrowding study for San Francisco County. The study was commissioned
by the City Attorney and involved the coordination of all principle
participants in the San Francisco criminal justice system. The
recomnendations developed in the study were su~nitted to the Federal
Court as part of the .City’s response to a jail overcrowding law suit.
ILPP’s research, findings and recom~endations were extremely
helpful. I feel much was accomplished because of the effectiveness
of ILPP in workingwell with all criminal justice elements, particularly
when there were confli.cting goals or philosophies. Without the consensus
building skills of ILPP, I doubt that we could have accoa~plished nearly
as much.
ILPP has also conducted several other projects for the San Francisco
Sheriff’s Department which have helped us obtain capital project construction
grants and which have been directed at improving our peace officer training.
In each of these cases, my experience with ILPP was productive and of
great benefit to my department.

TO WHOM IT MAY CONCERN:
ILPP, represented by Executive Director Alan Kalmanoff, came to Orange County on
a contract from the Board of Commissioners to assess the entire criminal justice
system. I admit to a certain amount of apprehension relative to our law enforcement
agency being fairly treated and in some way hindered from maintaining and enhancing
our service level now as well as in the future.
Eight months later upon the project’s completion, I would now say that ILPP’s team
completed a surprisingly comprehensive and data based inquiry into our local system,
overcame some resistance from certain managers, and in the end won our trust and
respect because of changes that are now taking place in Orange County.
I hasten to add that as head of the largest law enforcement agency in the County, I do
not agree wholeheartedly with all of ILPP’s findings or recommendations. I do,
however, believe that ILPP’s work for Orange County is solid, well documented, and
overall a worthwhile investment by the county. Even on those issues where I disagree
with ILPP, it is accompanied by respect and the realization that only history will
determine the quality of the recommendations.
ILPP’s team briefed my office on their findings before publishing a final report, giving
us an ample and private opportunity to respond, disagree and provide input.
The final report recommendations should save the county millions of dollars in future
operating costs, and my office is currently involved in a multi-agency effort to implement
many of the report’s recommendations. I would go further in indicating that an
automated fingerprint identification system will probably take the final steps in becoming
a reality, as I write this assessment, as a direct result of an ILPP Study
recommendation.

Dr. Alan Kalmanoff and all of the Staff at ILPP
are to be commended for their professionalism while
undertaking the study of the criminal justice system in
Hillsborough County. It is to be expected that an
inquiry of this kind can sometimes cause apprehension
for those being evaluated. The IIPP staff made it less
so by the cooperative demeanor exhibited throughout the
entire process.
Although we naturally did not agree on all of the
findings and recommendations in the report, I
appreciated the opportunity to confront and discuss all
of the issues with Dr. Kalmanoff or his staff.
Whenever we questioned the methodology used, or the
conclusions drawn, we were treated fairly and given an
opportunity to respond. Our perspective was presented
and included in the body of the report.
All of the recommendations in the final report are
being reviewed by sub-committees of the Public Safety
Coordinating Council. Many of the recommendations are
in various stages of implementation. An Ad-Hoc
committee is being formed to monitor the progress being
made here in Hillsborough County. The report has
become an integral part of improvements in our criminal
justice system. I welcome any inquiry as to my
assessment of the study or the final report.
