RECOMMENDATION
Staff recommends that Council adopt the attached resolution (A~achment A) authorizing
the Ci~ Manager or his designee to submit an application to the Santa Clara Valley
Transportation Authority (VTA) for a grant of $557,949 from the third cycle of federal
Surface Transportation Pro~am (STP) funding for local streets and roads rehabilitation
projects on segments of Newell Road and California Avenue through the City’s Street
Maintenance Capital Improvement Program project.
BACKGROUND
The Metropolitan Transportation Commission’s (MTC) 2003 smwey of local streets and
roads maintenance needs showed that region-wide, over the next 25 years, the cost of
maintaining and replacing the street system that exists today exceeds the revenues
expected to be available for that purpose. In Santa Clara Count,, the total local
maintenance shortfall is projected to be $1.7 billion. Approximately $500 million of that
is on federal aid-eligible roads.
The MTC 2005 Regional Transportation Plan (T-2030) directed $990 million in future
federal transportation revenues over 25 years to address the shortfall on the Metropolitan
Transportation System (MTS) roads region-wide. The goal of this program is to assure
that federal aid-eligible arterial and collector streets and roads in the MTC region are in
good repair. MTC delegated the responsibili~~ to select the projects in each coun~ to the
local Congestion Management Program. MTC previously programmed some of the funds
in two cycles in 2005/06. Palo Alto received a total of $787,000 in these first two
funding cycles for the resurfacing of segments of University Avenue, upper Page Mill
Road, and Embarcadero Road.

The VTA Congestion Management Program issued a new call for projects on December
5, 2005 for a third cycle of STP funding for roads rehabilitation projects in 2006/07,
2007/08, or 2008/09. The funding in this third has been split between projected shortfall
of funding for local streets (85 percent) and for county expressways (15 percent). A total
of $16 million in STP funds is available for pro~amming in Santa Clara County. Palo
Alto’s pro rata share is $557,949 (Attachment B). The funds can only be used for
rehabilitation of federal aid-eligible streets with a classification of minor collector or
higher. The street must have a Pavement Condition Index (PCI) of be~veen 0 and 70 on
the Pavement Management SYstem list in order to qualify for funding.
DISCUSSION
Public Works engineering staff has reviewed the list of eligible streets and their pavement
conditions, and recormnends that the funding be requested for two streets that meet the
required PCI threshold: Newell Road from Hamilton Avenue to Embarcadero and
California Avenue from E1 Camino Real to the Caltrain righ~-of-way. Both streets are
designated on the CiD;’s adopted School Commute Corridor Network. These streets are
scheduled for resurfacing in FY 2006/07.
Staff submitted a written request for grant funds to VTA by the submittal deadline on
January, 5, 2006. The resolution of the CiD~ Council, opinion of counsel, and letter of
assurances must be submitted to VTA by March 10, 2006. If the City Council decides not
to pursue the grant, staff wil! advise VTA staff to withdraw the City. ’s application from
consideration.
RESOURCE IMPACT
The total cost of resurfacing the ta¥o streets is estimated to be $705,000. The ~ant will
cover up to $557,949 of the project cost. A minimum local match of 11.47 percent is
required by the VTA. Palo Alto’s local match of $148,000 is a 21 percent match, and
will be provided from the annual Street Maintenance Program budget of approximately
$1.9 milliorv’year.
Since the STP grant funds are disbursed on a reimbursement basis, City funds will be
reimbursed by the grant funds.Staff will notify Council when the grant is formally
approved.
POLICY IMPLICATIONS
STP funds are federal funds, which will require that the Ci)" comply with the Caltrans
Local Assistance project delivery policies and procedures. The Public Works Department
has implemented several projects in recent years using federal ~ant funds and staff is
familiar with the procedures, schedule, timing, and reporting requirements.

ENVIRONMENTAL ASSESSMENT
These proposed street resurfacing projects are minor alterations and repairs to existing
facilities with no expansion of use and are categorically exempt under the California
Environmental Quality Act section 15301 (c) of the CEQA guidelines.

RESOLUTION OF THE COUNCIL OF THE CITY OF PALO
ALTO AUTHORIZING THE FILING OF AN APPLICATION
FOR FEDERAL SURFACE TRANSPORTATION PROGRAM
FUNDING FOR A STREET REHABILITATION PROJECTS ON
NEWELL ROAD AND CALIFORNIA AVENUE AND
COMMMITTING THE NECESSARY NON-FEDERAL MATCH FOR
THE PROJECTS AND STATING THE ASSURANCE OF THE
CITY OF PALO ALTO TO COMPLETE THE PROJECT
WHEREAS, the Safe, Accountable,. Flexible, Efficient
Transportation Equity Act: a Legacy for Users (SAFETEA) (Public
Law 109-59, August i0, 2005) continues the Surface
Transportation Program (23 U.S.C. § 133) and the Congestion
Mitigation and Air Quality improvement Program (CMJkQ) (23 U.S.C.
§ 149); and
WHEREAS, the SAFETEA legislation will guide STP and CMAQ
programming; and
WHEREAS, pursuant to SAFETEA, and the regulations
promulgated thereunder, eligible project sponsors wishing to
receive Surface Transportation Program or Congestion Mitigation
and Air Quality Improvement Program grants for a project shall
submit an application first with the appropriate metropolitan
transportation planning organization (MPO), for review and
inclusion in the MPO’s Transportation Improvement Program (TIP);
and
WHEREAS, the Metropolitan Transportation Commission
(MTC) is the MPO for the San Francisco Bay region; and
WHEREAS, the City of Palo Alto is an eligible project
sponsor for the Surface Transportation Program or Congestion
Management and Air Quality Improvement Program funds; and
WHEREAS, the City of Palo Alto wishes to submit an
application to MTC for funds from the Surface Transportation
Program in fiscal year 2006/07 in the amount of $557,949 for a
project to resurface and rehabilitate the following street
segments:
i.Newell Road from Hamilton Avenue to Embarcadero
Road; and
2.California Avenue from E1 Camino Real to the end at
the Caltrain right-of-way; and

¼~EREAS, MTC requires, as part of the application,
resolution stating the following:
a
i) The commitment of local matching funds of at least
11.47%; and
2) That the sponsor understands that the Surface
Transportation Program funding is fixed at the programmed
amount, and therefore any cost increase cannot be expected to be
funded with Surface Transportation Program funds; and
3) The assurance of the sponsor to complete the project
as described in the application, and if approved, as programmed
in MTC’s TIP; and
4) That the sponsor understands that funds must be
obligated by June 30 of the year that the project is programmed
for in the TIP, or the project may be removed from the program;
and
5) That the sponsor has

NOW, THEREFORE, the Council of the City of Palo Alto
does RESOLVE as follows:
SECTION i. The City Manager, or his designee, is
authorized to execute and file an application for funding under
the Surface Transportation Program of the SAFETEA in the amount
of $557,949 for a project to resurface and rehabilitate the
specified segments of Newell Road and California Avenue; and
SECTION 2. The City Council by adopting this resolution
does hereby state that:
(a) The City of Palo Alto will provide approximately
$148,000 in non-federal matching funds; and
(b) The City of Palo Alto understands that the Surface
Transportation Program funding for the Project is fixed at
$557,949, that any cost increases must be funded by the City of
Palo Alto from local matching funds, and that the City of Palo
Alto does not expect any cost increases to be funded with
additional Surface Transportation Program funds; and
(c) The Newell Road and California Avenue resurfacing
and rehabilitation project will be carried out as described in
this resolution and, if approved, for the amount shown in the
MTC’s TIP; and

(d) The program funds are expected to be obligated by
June 30, 2007 of the year the project is expected to be
programmed for in the TIP.
SECTION 3. The Counci! directs the City Manager to
transmit a copy of this resolution to the MTC in conjunction
with the filing of the application.
SECTION 4. The MTC is requested to support the
application for the project described in the resolution and to
program the project, if approved, in MTC’s TIP.
SECTION 5.The Counci! finds that the filing of an
application for grant funds does not constitute a project for
purposes of the California Environmental Quality Act (CEQA).
However, the street resurfacing and rehabilitation project is
exempt from CEQA as the repair and maintenance o~ existing
streets (CEQA Guidelines section 15301(c)).

Call for Projects: Federal Surface Transportation Program (STP)
Funds For Local Streets and Roads Rehabilitation Projects in 2007/08
and 2008/09
Federal STP Funds Available
This memorandum serves as the Call-for-Projects for the Federal Surface Transportation
Progam (STP) for Local Streets and Roads Rehabilitation for the funding cycles of FY
2007/08 and FY 2008/09. A total of $16,010,000 is available for progamming. The goal
of this prouam is to assure that Federal Aid eligible streets and roads in Santa Clara
County are in good repair.

Funding Targets
Funding for the progmn was split into two categories: (1) Needs based and (2)
Count~vide Expressways. The needs based prod’am would cover 85 percent (or
$13,622,109) of the total funds available. This target amount is based on each agency’s
percentage of MTC’s T-2030 projection of countywide street maintenance and
reconstruction needs. Attachment A shows each city and the Comaty’s target amount for
the funding cycles. The second part of the progam would cover 15 percent (or
$2,387,891) of the available funds. The Capital Improvement Program (CIP)
subcommittee of the TAC recomlnended proN’amming the 15% funding to the County
Expressway system for this period. You may program your funds in either FY
2007/08 OR FY 2008/09.
Pro,iect Screenin~ Criteria
All Projects must be generated by the agency’s Pavement Management System
Average pavement condition index (PCI) on the roadway must be projected to be
between 0 and 70 (0<PCI<70) in 2007/08 and 2008/09.
Roadway must be federal-aid eligible (functional classification of minor collector
or higher).
The project must provide preventive maintenance, rehabilitation and!or
reconstruction treatment that extends the life of the roadway for five or rnore
years.
Projects must submit obligation request no later than April 1, and obligate funds
no later than June 30 of the year in which they are progranvned.
There is no Maintenance of Effort (MOE) requirement for this pro~am.
Federal funding requires a minimum 11.47% cash match. Additional matching
funds are voluntary.
Pavement and incidental non-pavement expenses are eligible. "Incidental" non-
pavement items should be no more than 20% of the total project cost. Attaclmaent
C shows eligible project costs.
Bike facilities will be included in the final striping wherever feasible and
consistent with local plans.
Pedestrian facilities will be included wherever feasible and consistent with local
plans.
Fiber optic cable installation and other ITS elements should be instalIed in
conjunction with these projects.
Council Resolution and Legal Compliance
An authorizing resolution stating the sponsor’s commitnaent to complete the projects as
scoped, and an Opinion of Legal Counsel MUST accompany all local projects included
in the Pro~am. Project sponsors and implementing agencies need to submit the
documents by March 10, 2006.
An agency with multiple projects can submit one Resolution of Support and Opinion of
Legal Counsel that encompasses all of the projects. However, individual Certifications of
Assurances accompanying the Resolution of Local Support must be submitted for each
project. A sample Resolution of Support and Opinion of Legal Counsel is provided
herein as Attaclvnent D and E.
Other Requirements
The regional project delivery policy (MTC Resolution No. 3606) establishes funding
deadlines for STP and CMAQ Program fnnding to ensure timely project delivery against
state and federal funding deadlines. Resolution 3606 establishes a standard policy for
enforcing project funding deadlines and project substitutions for these funds. Projects
programmed in LSRS Pro~am are subject to the provisions of MTC Resolution No.
3606, as amended (located on the interact at:

California Avenue is a four-lane collector street and Newell Road is a two-lane
collector street. The project will include minor curb and gutter replacement, sidewalk
and driveway replacement, Portland Cement concrete base failure repair, milling of all
existing asphalt concrete to the PCC base, crack sealing, interlayer membrane along
longitudinal and transverse cold joints, a leveling course of 3/8" asphalt concrete,
placement of a Petromat equivalent paving fabric and a final 1 ~/:" asphalt concrete
overlay.
