HomeMy WebLinkAboutStaff Report 447-07City of Palo Alto City Manager’s Report TO:HONORABLE CITY COUNCIL FROM:CITY 5~-~NAGER DEPARTMENT: CITY MANAGER’S OFFICE DATE: DECEMBER 17, 2007 CMR: 447:07 SUBJECT: 2007 SHORELINE CONCERT SEASON RESULTS This is an informational report and no Council action is required. BACKGROUND In June 1993, the City of Palo Alto and Bill Graham Presents (BGP) entered into a settlement a~eement with regard to Shoreline Amphitheatre. Under that agreement, BGP a~eed to operate Shoreline Amphitheatre subject to certain noise and hours restrictions. The City of Palo Alto and BFP also a~eed to meet at least ta¥ice a year to discuss Shoreline Amphitheatre operations, with one meeting occurring before the season and another after the season. BGP was subsequently acquired by Clear Channel Entertainment. In December 2003, the City Council approved the recommendation of staff and the Council Shoreline subcommittee to replace the Council subcommittee with an annual staff informational report summarizing the complaints received during the season, and the meeting with Clear Channel. If the noise problems become acute again, staff will recommend the Council reconstitute the Council Subcommittee. During the concert season, the Palo Alto Police Department is responsible for monitoring complaints regarding noise from Shoreline concerts. According to the a~eement with Clear Channel, if more than four Shoreline events in any year result in 45 or more complaints from different Palo Alto residential addresses, Palo Alto and Clear Channel will reopen discussions and negotiate in good faith to identify mitigation measures to reduce noise impacts in Palo Alto. Details on the complaints received during the entire season are summarized on Attachment A. Staff has shared these results with City of Mountain View staff. There are no other significant issues to report related to the 2007 concert season. RESOURCE IMPACT The Police Department estimates its costs of monitoring complaints at $2,000 almually. POLICY IMPLICATIONS This report is consistent with prior Council direction regarding armual monitoring of noise complaints at Shoreline Amphitheatre. ENVIRONMENTAL REVIEW This is not a project requiring environmental review under the California Environmental Quality Act.
