RECOMMENDATION
Staff recommends that the City Council approve the attached amendment to contract
S05111053 with Kutzmann and Associates to add $40,000 for additional building code
plan check services and $36,000 for building inspection services for a total not-to-exceed
amount of $310,804.
DISCUSSION
The Building Division maintains several contracts with plan check consultants to check
construction plans for Building Code compliance. Building Division staff refers plans to
these consultants during periods of peak workload. The contracts also contain provisions
for building inspection services, which have not been exercised before this year.
However, because of unusually high workload associated with several current and
pending large projects, the Building Division exercised this provision in April 2007 with
Kutzmann and Associates for one experienced contract building inspector.
Without the building inspector provided by Kutzmann and Associates, the Building
Division would not have been able to maintain service levels to major construction
projects. Due to those projects, as well as an increase in construction activity in general,
the Building Division’s inspection wor’k!oad is currently at its highest level since 2000.
Even so, the Division has met its target goal of providing more than 90% of requested
inspections within twenty-four hours.

Because the authorized contract limit for Kutzmann and Associates was only sufficient
for plan check services, but has recently been used for both plan check and inspection
services, staff recommends increasing the contract limit so the Building Division may
continue to retain the plan check and inspection services necessary to provide current
service levels to major construction projects currently in profess.
POLICY IMPLICATIONS
This contract amendment does not represent a change to City policies.
RESOURCE IMI~ACT
No resource impacts will result from this contract amendment. All services obtained
through the contract are budgeted in FY 2007-08 and are fully reimbursed by building
permit revenues.
ENVIRON1VIENTAL REVIEW
This action is not considered a project under the California Environmental Quality Act.

R E C I T A L S:
WHEREAS, the Agreement was entered into between the
marries= for the provision of Plan Checking S=~--~v-ces; and
inspection Services.
WHEREAS,-the parties wish to amend the Agreement;
NOW, THEREFORE, in consideration of the covenants, terms,
conditions, and provisions of this P~.en6ment, the parties agree:
SECTION 4. The section entitled "COMPENSATION" is
hereby amended, to read as follows:
As-COMPENSAT!ON for the full merformance of this
Agreement: C!TY shall pay "CONTKhCTOR": For Plan Checking
Services; A not to exceed amount of two hundred and
twenty four thousand eight hundred and four dollars,
$224,804.00), and for Building inspection Services; A
not to exceed amount of eighty six thousand dollars,
($86,000. Total Compensation under this Agreement shall
not exceed: $310,804.00.

Agreement, including any exhibits and subsequent amendments
