RECOMMENDATION
Staff recommends Council approve a resolution (Attachment A) to authorize the City Manager
or his/her designee to submit California Integrated Waste Management Board (CIWMB) tire
related and rubberized asphalt concrete grant applications and to sign related grant program
agreements and amendments.
BACKGROUND
The California Integrated Waste Management Board (CIWMB) offers funding opportunities
authorized by legislation to assist public and private entities in the safe and effective
management of the waste stream. The Targeted Rubberized Asphalt Concrete Incentive (TRI)
Grant Program provides assistance to local governments to fund rubberized asphalt concrete
(RAC) projects. It is designed to promote markets for recycled-content products derived from
waste tires generated in California and decrease the adverse environmental impacts created by
unlawful disposal and stockpiling of waste tires. Cities, counties, districts and other local
government agencies that fund public works projects are eligible to submit applications for this
grant program. Grants are distributed on a competitive basis.
DISCUSSION
Staff proposes submitting a TRI grant application to acquire the additional funds needed to
include RAC as part of the upcoming annual street resurfacing project scheduled to begin in July
2007. This resurfacing project is estimated at $1.7 million, and will include a bid add-alternate
for rubberized asphalt concrete that could replace the normal asphalt concrete used for street
rehabilitation and overlays. RAC material is more expensive than the typical asphalt concrete as
it is a recycled product, but may prove to be more durable, flexible and provide a longer life span
than the typical 20 y~ar life span of asphalt concrete. If the lowest responsible bidder provides
an RAC bid price within budget, combined with the funds supplied by the grant, the RAC bid
add-alternate will be included for Council’s consideration in awarding this contract in July.

Staff anticipates that a TRI grant of $175,000 will cover the additional cost of using RAC so the
City can maintain streets at the current level. If the RAC is more expensive.than expected, the
resurfacing project will continue with the use of asphalt concrete so as to not impact or decrease
the number of streets resurfaced. The grant funds, if awarded, can be applied for the next
resurfacing project in 2008 unless Council approves an additional expenditure to pay the
additional cost beyond the $175,000 of grant funds anticipated.
RESOURCE IMPACT
If a supplemental grant of $175,000 is awarded to the City, an Exhibit B adjustment will be
required to budget grant funds and expenditures. The grant requires City expenditures of funds
which will be reimbursed by the State. No net impact on the General Fund or Infrastructure
Reserve is expected. The remaining funds for the project are included in the proposed FY 2007-
08 Capital Improvement Program budget, PE-86070.
Staff will submit the application, administer agreements and amendments, and submit for
reimbursements periodically during the project as required by the grant conditions.
POLICY IMPLICATIONS
This grant program is consistent with the City Council’s Top 4 priority, Global Climate
Protection, promoting sustainability and the reduction of materials put intothe waste stream and
Sustainable Budget, by seeking outside funding sources for City infrastructure projects.
ENVIRONMENTAL REVIEW
Approval of the Administering Agency-State Master Agreements does not constitute a project
for purposes of the National Environmental Protection Act (NEPA) or the California
Environmental Quality Act (CEQA); therefore, no environmental analysis is required.

RESOLUTION OF THE COUNCIL OF THE CITY OF PALO
ALTO AUTHORIZING THE CITY MANAGER TO SUBMIT
GRANT APPLICATION(S) AND SIGN AGREEMENT(S)
WITH THE CALIFORNIA INTEGRATED WASTE
MANAGEMENT BOARD (CIWMB) FOR TIRE-RELATED
AND RUBBERIZED ASPHALT CONCRETE
GRANT PROGRAMS
WHEREAS, Public Resources Code Sections 42800 et seq. established the waste tire
program for the state of California and assigns responsibility for its implementation to the
California Integrated Waste Management Board (CIWMB); and
WHEREAS, CIWMB is authorized to award grants under the waste tire program as
identified in its Five-Year Plan for the Waste Tire Recycling Management Program; and
WHEREAS, procedures established by the CIWMB require each jurisdiction-
applicant to certify by resolution the approval of the jurisdiction’s governing authority for
submittal of a graut application before submission of said application to the CIWMB; and
WHEREAS, if awarded a grant, the City of Palo Alto will enter into a Grant
Agreement with the CIWMB for implementation of a tire-related grant.
NOW, THEREFORE, the Council of the City of Palo Alto does resolve as follows:
SECTION 1. The City Manager or his designee is hereby authorized and
empowered to execute in the name of the City of Palo Alto all necessary grant related
documents, including but not limited to, applications, agreements, amendments and payment
requests, necessary for the purposes of securing grant funds to implement and carry out the
program(s) specified in the grant. "
