SUBJECT: 1999 SHORELINE CONCERT SEASON
The purpose of this report is to provide the Council with information regarding the 1999
Shoreline concert season. This is an information report and no Council action is required.
BACKGROUND
In June 1993, the City of Palo Alto and Bill Graham Presents (BGP) entered into a
settlement agreement with regard to Shoreline Amphitheatre. Under that agreement,
BGP agreed to operate Shoreline Amphitheatre subject to certain noise and hours
restrictions. The City of Palo Alto and BGP also agreed to meet at least twice a year to
discuss Shoreline Amphitheatre operations, with one meeting occurring before the season
and another during the season.
During the concert season, the Palo Alto Police Department is responsible for monitoring
complaints regarding noise from Shoreline concerts. According to the agreement with
BGP, if more than 4 Shoreline events in any year result in 45 or more complaints from
different Palo Alto residential addresses, Palo Alto and BGP will reopen discussions and
negotiate in good faith to identify mitigation measures to reduce noise impacts in Palo
Alto. In addition to Police Department monitoring of complaints, City of Palo Alto
Public Works staff monitors noise levels from Shoreline Amphitheatre concerts from a
sound monitoring station at the Palo Alto Main Library.
DISCUSSION
The 1999 Shoreline concert season started on Mary 9, 1999 and ended on October 31,
1999. The Police Department received a total of 99 valid complaints. No concert
resulted in over 45 complaints. Below is a history of Shoreline complaints since Palo
Alto began accumulating information under the settlement agreement:

The City of Mountain View registered 48 complaints during the 1999 season, compared
to 134 in 1998, 55 in 1997 and 306 in 1996. In a report prepared as part of a study session
for the City of Mountain View Council, staff indicated that a new policy regarding early
start times for events will be initiated on a one-year trial basis for the 2000 season. The
policy pre-approves Shoreline Amphitheatre for nine early concert start times (four early
starts for weekend events such as New Orleansby the Bay and KMEL All Star Jam); four
early start times for weekday concerts, between the hours of 11 a.m. and 4 p.m.; and one
weekday early concert start time between the hours of 4:30 p.m. and 6:30 p.m. Under the
lease with the City, BGP has been required to get the City’s permission for early concert
start times, but this permission is often acquired after the event has been publicized and
planned, due to BGP’s need to respond quickly to performers’ availability. BGP would
be required to get City of Mountain View’s permission for any early start times beyond
the nine specified, and will also be required to provide the City of Mountain View with at
least 21 days notice regarding the specifics of the events, to allow planning for mitigation
of traffiC, crowd control, etc.
On December 17, 1999, Council Member Rosenbaum and staff from the City Manager’s
Office and City Attorney’s Office are scheduled to meet with representatives from
Shoreline and BGP to review the 1999 season.
RESOURCE IMPACT
The cost of maintaining the sound monitoring equipment at the Palo Alto Main Library is
approximately $5000. The Police Department estimates its cost at $2000.
