HomeMy WebLinkAbout1999-09-21 City Councilof Palo Alto REVISED City Manager’s Report 5 TO:HONORABLE CITY COUNCIL FROM:CITY MANAGER DEPARTMENT:COMMUNITY SERVICES DATE:SEPTEMBER 21, 1999 CMR: 347:99 SUBJECT:APPROVAL AND ADOPTION OF PARK IMPROVEMENT ORDINANCES ASSOCIATED WITH THE INSTALLATION OF MEMORIAL BENCHES IN FOOTHILLS AND BYXBEE PARKS RECOMMENDATION Staff recommends that Council approve and adopt the attached Park Improvement Ordinances for Foothills and John Byxbee Parks. The ordinances allow for the installation of memorial park benches in each of the parks according to a bench site plan. BACKGROUND In 1997 the Open Space and Science Division established a Public Trust and Donation Account, entitled Adopt-A-Park, which is intended to provide supplemental funds for open space park amenities such as benches, informational kiosks, and educational exhibits. One component of the Adopt-A-Park program is to solicit donations for memorial benches. These superior quality benches either replace damaged facilities or add new benches in suitable locations. DISCUSSION In 1997, after the Adopt-A-Park program was started, staff began installing new park benches along trails and roads in Foothills Park and John Byxbee Baylands Park. After a donation is received for a memorial bench, staff works with the contributor and suggests sites that will best serve park visitors. Locations for placement in the parks are chosen to provide both easy access and scenic vistas without disturbing the aesthetic appeal and natural landscape. The attached site maps for Foothills Park and John Byxbee Park identifies 12 sites that are appropriate for benches. It is anticipated that two or three memorial benches will be installed annually. The City Charter and Municipal Code require that a Park Improvement Ordinance be approved and adopted prior to construction on land held by the City for park purposes. Until recently, the installation of replacement and new park benches had not been considered as construction work for park purposes. After discussion with the City Attorney, staff determined a Park Improvement Ordinance was needed. The attached bench site plans for Foothills Park and John CMR: 347:99 Page 1 of 2 Byxbee Park indicate the location of benches previously installed as part of the Adopt-A-Park program, as well as sites for furore installations. RESOURCE IMPACT The full cost of the bench, including its purchase, installation and a bronze plaque, is covered by the requested donation to the Adopt-A-Park fund. A portion of the requested donation is set aside for the maintenance of the benches. POLICY IMPLICATIONS Installation of park benches is consistent with City policies and the Baylands Master Plan. This was not initially apparent because the mile markers on the original color map were red, while the park bench numbers were black. On the copy reproduced for Council, both numbers appeared black and white. On the corrected map, an "x" within a box represents the mile markers: [Yl. The total of twelve benches mentioned in the staff report was incorrect. There are a total of fourteen benches proposed: six in Byxbee Park, and eight in Foothills Park. ORDINANCE NO. Code require that, before any substantial building, construction, reconstruction or development is commenced or approved, upon or with respect to any land held by the City for park purposes, the Council shall first cause to be prepared and by ordinance approve and adopt a plan therefor; and WHEREAS, Byxbee Park and the City-owned Baylands are dedicated to and for park purposes under Section 22.08.020 of the Palo Alto Municipal Code; and WHEREAS, since 1997, the Open Space and Science division of the City of Palo Alto’s Department of Community Services has established a Public Trust and Donation Account, entitled the "Adopt A Park" fund, to solicit donations for memorial benches; and WHEREAS, the City has received donations for memorial benches in city parks, and the City wishes to identify several locations at Byxbee Park and the City-owned Baylands as sites for these memorial benches; and WHEREAS, the Council desires to approve the plan governing the installation of memorial benches ("Plan") and to adopt it as part of the official plan pertaining to the approved sites for the installation of memorial benches at Byxbee Park and the City-owned Baylands; NOW, THEREFORE, the Council of the City of Palo Alto does ORDAIN as follows: SECTION i. The Plan, a copy of which is on file in the office of the Division of Planning, Department of Planning and Community Environment, and to which copy reference is hereby made concerning the full particulars thereof, is hereby approved and adopted.
