STAR® PROGRAM CREATED BY THE ENVIRONMENTAL
PROTECTION AGENCY AND DEPARTMENT OF ENERGY.
ANNUAL COST $4,000.
REPORT IN BRIEF
This report recommends that the City Council authorize the City Manager or her designee
to sign the attached ENERGY STAR® License Agreement and adopt a resolution
acknowledging City partnership in the program. This voluntary program is intended to
educate and inform the residential and business community of the benefits of using energy-
efficient equipment and appliances, to save on their utility cost and to help to curb
greenhouse gas pollution.

RECOMMENDATION
Staff recommends that Council authorize the City Manager or her designee to:

U.S. Environmental Protection Agency and the U.S. Department of Energy, and
Approve the attached resolution supporting the City’s participation in the ENERGY
STAR® Program.
BACKGROUND
The ENERGY STAR® Program was created by the Environmental Protection Agency (EPA)
and the Department of Energy (DOE) as mandated by the President and Congress to reduce
the national rate of greenhouse gas emissions and consumer energy consumption and cost.
The EPA and DOE award the ENERGY STAR® label to products that are energy efficient.
The Federal agencies involved in the program set the energy efficiency criteria for specific
consumer and commercial products. These criteria exceed the minimum national efficiency
standards where such standards exist. Manufacturers volunteer to place the ENERGY
STAR® label on models that meet or exceed the criteria set by EPA and DOE.
This voluntary Program is a collaborative effort between retailers, manufacturers and utilities
to educate the public about purchasing and using high efficiency appliances, consumer
electronics, office equipment, windows and lighting.
DISCUSSION
The key requirement for participating in the ENERGY STAR® program is to sign and
execute the License Agreement between the EPA, DOE, and City of Palo Alto. The License
Agreement (LA) outlines each signatory’s responsibilities and requirements, and provides
guidelines for proper use of the ENERGY STAR® name and logo. The Agreement is valid
from the date of its signature through December 31, 2000 but may be extended beyond that
date.
UtilityPartner Responsibilities are:
a. Designate a contact person,
b. Develop a local program plan within two months of signing the LA,
c. Promote one or more product classification, such as appliances, lighting fixtures
or office equipment, that meet or exceed the ENERGY STAR® target levels,
d. Use the ENERGY STAR® logo in accordance with the LA, and
e. Provide the DOE and EPA with sales information, where such exists, that can be
used to evaluate the national ENERGY STAR® program.

The ENERGY STAR® program provides several benefits to CPAU and the City’s
customers. The ENERGY STAR® program would complement the current Electric Public
Benefits Program. Criteria for future utility rebate programs would be that products
purchased be part of the ENERGY STAR® approved list, where applicable. In addition,
encouraging residents and businesses to purchase ENERGY STAR® products in fact sheets,
through bill inserts, etc., the City is able to educate utility customers about savings
opportunities through lower utility costs.
RESOURCE IMPACT
Actions taken to support the ENERGY STAR® Program are included within the budget for
the Electric Public Benefits Program and are estimated to be a maximum of $4,000 annually.
POLICY IMPLICATIONS
The recommendation is consistent with Cou.ncil direction and past policy regarding energy
efficiency, conservation of natural resources" and the City’s Comprehensive Plan.

This is not a project under the California Environmental Quality Act (CEQA).

ENERGY STAR~ License Agreement
An Agreement between The City of Palo Alto Utilities and the U.S. Environmental Protection
Agency and the U.S. Departmeht of Energy
THIS MEMORANDUM OF UNDERSTANDING (MOU) is a voluntary agreement
between the U.S. DEPARTMENT OF ENERGY (DOE), the U.S. ENVIRONMENTAL
PROTECTION AGENCY (EPA), and The City of Palo Alto Utilities, the Utility Partner, in
conjunction with the Partner’s involvement in the ENERGY STAR® Program. This agreement is
valid from the date of its signature through December 31, 2000, but may be extended beyond that
date. In addition, the above parties agree to establish an individual implementation plan, which
must be completed within two months after the MOU has been signed by all parties.
The primary purpose of this MOU is to create a public/private partnership to educate consumers
about hi~,gch-efficiency ENERGY STAR products that save energy, lead to reductions in
combustion-related air pollution, and reduce constwner energy bills.
BACKGROUND
EPA and DOE have been directed by the President and the Congress to establish
programs to help reduce the national rate of greenhouse gas emissions and consumer energy
consumption and costs. DOE and EPA established the ENERGJ"STAR program, a voluntary
partnership with retailers, manufacturers and utilities who work together to increase the purchase
of highly efficient appliances, consumer electronics, office equipment, windows and lighting
through educational and promotional programs.
Under this agreement, the above parties will work together in promoting ENERGYSTAR
qualifying products in the following ~vays:
1. EPA and DOE will provide The City of Palo Alto Utilities with information to help The
Cib’ of Pa!o Alto Utilities promote the purchase of highly energy efficient products. Product
categories covered in this program include refrigerators, clothes ~vashers, dishwashers, room air
conditioners, computers, monitors, printers, fax machines, scanners, multi-function devices,
televisions, video cassette recorders, ,,vindows and residential lighting fixtures that are marketed
for use primarily in residential buildings. Products are considered to be highly efficient if they
meet or exceed the ENERGY STAR Target Levels, as established and designated by DOE or EPA.
Please refer to Appendix A for a list of ENERGY STAR qualifying products.
2. DOE and EPA wilt work with The City of Palo Alto Utilities to develop a plan that
describes the measures that each party will take in cooperatively promoting the purchase of
E.NERGY STAR-qualifying pi-oducts. The City of Palo Alto Utilities may choose to participate
by promoting any or all ENERGYSTAR products. See Appendix C for a sample of a plan that
The City of Palo Alto Utilities would enter into with EPA and DOE. This plan must be

completed within two months of signing the license agreement that allows The City of Palo Alto
Utilities to place the ENERGYSTAR logo on qualified products.
3. The City of Palo Alto Utilities agees to use the ENERGYSTAR label to promote
highly efficient products that meet or exceed the ENERGYSTAR qualifying levels found in
Appendix A. ENERGYSTAR and the ENERGYSTAR label are service marks of the U.S.
Environmental Protection Agency, which holds the trademark rights to these marks and has
licensed them to DOE. This MOU also constitutes a license agreement between EPA, DOE and
2"he City of Palo Alto Utilities for using the label in the promotion of ENERGYSTAR qualifying
products. Please see Appendix B for label use and reproduction guidelines.
4. Definitions
a. ENERG..YSTAR Oualified Products: Products that meet DOE’s or EPA’s
ENERGYSTAR specifications and appear on the lists provided in Appendix A.
b. Utility Partner: An utility company who wishes to use the ENERGYSTAR label
and the promotional material developed by DOE and EPA to market qualified high-efficiency
products and who is willing to enter into a voluntary agreement with DOE and EPA to do so.
c. Retailer: A company that buys products, and then resells them to the ultimate end-
user. A Retailer also maintains a public store in which it showcases and sells its available
merchandise to consumers.
d.Retailer Partner: A Retailer who wishes to use the ENERGI"STAR label and the
promotional material developed by DOE and EPA to market qualified high-efficiency products
and who is willing to enter into a voluntary agreement xvith DOE and EPA to do so. A Retailer
Partner must also assure that a reasonable number of labeled products be found on showroom
floors and readily available to consumers,
e. Target Levels: DOE and EPA have selected the product types and models listed in
Appendix A for inclusion in the ENERGYSTAR Program. Target levels for ENERGYSTAR
appliances are set as a function of percentage better than the prevailing minimum efficiency
standards set by DOE.
5. Effective Date and Duration. This agreement is not binding until sig-ned by DOE,
EPA and The City of Palo Alto Utilities. The agreement can also be terminated by EPA, DOE or
The City of Palo Alto Utilities at any time, and for any reason, with no penalty. Please see
Section 9 for language regarding termination due to noncompliance.
6. EPA!DOE Responsibilities. DOE and EPA agree:
a. to designate a single liaison for The City of Palo Alto Utilities’ program, and to
notify The City of Palo Alto Utilities within one month of any change in liaison responsibilities.
b. to provide The City of Palo Alto Utilities ~vith electronic file or camera-ready
versions of the ENERGY.STAR logo and of other graphic material that can be used in The City of
Palo Alto Utilities promotional, advertising, and sales training activities.
c. to work on their own to promote highly efficient products and to inform
consumers about its ENERGYSTAR Program by writing articles and cooperating with the ne~vs
media by sharing information, where appropriate.
d. to work with The City of Palo Alto Utilities individually and in conjunction with
other ENERGY. STAR program partners (such as manufacturers or retailers) to facilitate
coordinated promotion of highly efficient products ~vhich will benefit all parties, and ~o provide

e. to provide training material on energy use and efficiency in the covered products,
as defined in Appendix A, for use in the The City of Palo Alto Utilities’ training pro~ams for sales.

f. to encourage financial institutions to offer low-interest consumer loans for covered
products, as defined in Appendix A.
7. Utility Partner Responsibilities. The City of Palo Alto Utilities agrees:
a. to appoint a responsible representative of the company as ENERGY STAR
Progam liaison to DOE and EPA, and to notify the federal contact liaison within one month of
any change in liaison responsibility.
b. to develop a program plan, within two months of the signing of this MOU, for
utilizing the ENERGY. STAR logo in promoting, advertising, or providing financial incentives for
ENERGY. STAR-qualifying products.
c. to promote one or more product classification, e.g., refrigerators, room air
conditioners, dishwashers, televisions, video cassette recorders, office equipment and/or light
fixtures, that meet or exceed the ENERG¥STAR Target Levels.
d.to use the ENERGYSTAR logo only in accordance with the terms of Appendix B.
e. to work with EPA and DOE to provide sales information that can be used in
evaluating the efforts of the ENERGY’STAR Pro~am, as detailed in the pro~am plan. All
rePorted results will be masked to protect the confidentiality of each partner’s records.

8. Conflict Resolution.
a. Each party agrees to assume good faith as a general principle for resolving
conflicts under the ENERGY’STAR Program.
b. Each party agrees to informally notify each other if any problems or issues arise
and to work together to provide public confidence in the program.
c. If DOE or EPA receives information that The City of Palo Alto Utilities is
improperly using the ENERGYSTAR logo or name, or not meeting the terms of this
memorandum, then EPA and DOE will immediately notify The City of Palo Alto Utilities and
attempt to address and resolve the problem informally.
d. If these informal discussions do not produce a mutually agreeable resolution, The
City of Palo Alto Utilities shall be notified in writing that The City of Palo Alto Utilities shall be
terminated from the program unless it undertakes the specific corrective actions. The Program
Partner agrees to reply to the government Program Liaison in ~vriting within 20 business days of
receiving such letter. At that time, The City of Palo Alto Utilities shall agree to do one of the
following: (1) undertake in a timely and effective manner, the corrective actions; or (2)
voluntarily terminate this agreement. If The City of Palo Alto Utilities does not respond to the
government letter within 20 business days, or responds but does not agree to either (1) or (2),
then this. agreement is terminated.
e. If The City of Palo Alto Utilities believes that DOE and/or EPA is not meeting all
of its commilynents, The City of Palo Alto Utilities shall notify the federal liaison in writing. EPA
and/or DOE agrees to respond in writing within 20 business days of receiving The City of Palo
Alto Utilities’ letter. At that time, DOE/EPA will do one of the following: (!) undertake the
corrective actions sought by The City of Pato Alto Utilities, or (2) explain why such corrective
actions cannot be undertaken, or (3) terminate this agreement.
9. This agreement is not binding except with respect to the use of the ENERGY
STAR logo. Although this agreement is voluntary, the label use guidelines laid but in Appendix B
are mandatory.

Appendix B: Guidelines for Proper Use of the ENERGY STAR® Name
and International ~ogo
The ENERGY STAR® Name and Intemationa! ENERGY STAR Logo, "the Logo" (see figure #1), are
registered marks of the EPA. As such, the Name and Logo may only be used in accordance ~vith
the following guidelines and the Memoranda of Understanding (MOU) signed by Partners in the
ENERGY STAR program. Please distribute these guidelines to those who will be responsible
for preparing ENERGY STAR materials on your behalf.

EPA oversees proper use of the ENERGY STAR Name and Logo. This includes monitoring the use
of the marks in the marketplace, and directly contacting those organizations that are using them
.improperly or without authorization. Consequences to Partners of misusing the marks may
include the termination of the Partner’s participation in the ENERGY STAR program. Please also
note that under several federal statutes, including 19 USC § 1526 and 19 USC § 1595(a),
products imported into the U.S. using the marks improperly or without authorization are subject
to possible seizure and forfeiture by the U.S. Customs Service.
I. INTRODUCTION
The ENERGY STAR Name may be used for general educational purposes. The Name may be
displayed when describing the ENERGY STAR program, such as in a special educational brochure,
newsletter, annual report, or other article that provides the details of the program and the
program’s requirements. (See Section II below for more information.)
The Logo may be used as a product label to designate specific products that meet the
specifications contained in the ENERGY STAR MOUs. (See Section III below for more
information.)
II.GENERAL EDUCATIONAL USE OF THE ENERGY STAR NABIE
Energy Star is a U.S. registered mark.
Partners and other entities authorized by the EPA are allowed to include the ENERGY STAR Name
in general educational or informational materials that discuss the ENERGY STAR progam. This
includes utility bill stuffers, promotional material, brochures, newsletters, annual reports,
speeches, posters, advertisements, articles, product sales materials and packaging, Internet/world
wide web documents, and other materials in print or electronic media, etc.
III. USE OF LOGO AS A CERTIFICATION MARK
A. Using the Logo on Product Labels
The Logo is a certification mark attd may only be used to certify specific products that have
been determined to meet the E?gERGY STAR program reqttirements. For those specific products,
the Logo may be used directly on the product or on materials associated with the product, such as
packaging or product inserts. In order to maintain the integrity of the Logo, and the credibility of
the ENERGY STAR progams, it is imperative that this basic rule not be broken.
Only ENERGY STAR Partners may use the Logo in connection with a certified product. Each
ENERGY STAR Partner has si~aed an MOUma "king it responsible for the proper use of the Logo.
This includes its own use of the Logo, as well as use by its authorized representatives, e.g., ad
agencies, dealers, etc. Therefore, the Partner should make available these Logo use guidelines to
any party that ~vould be preparing materials on the Partner’s behalf.
B. Using the Logo in Product Advertisements
When preparing print advertisements or brochures, the Logo should be placed on or directly
adjacent to the compliant product. If only one product is pictured in the advertisement (and that
product is compliant) the Logo may be placed anywhere on the page. But if multiple products are
pictured, the Logo should be placed only next to those products which are compliant. The Logo
may not be placed along the bottom or side of the advertisement next to other general icons
unless every product pictured in the advertisement is ENERGY STAR compliant.
If the Logo is used in a general advertisement for a product line where only certain models are
compliant, the Partner should include language that clarifies the situation (e.g., "The [product
model name] meets the ENERGY STAR® requirements") or the Partner may include specific
language under each of the compliant models (e.g., include a bullet point "ENERGY STAR®
compliant" in a list of product attributes).
C. Using the Logo When Not Referencing a Specific Product
The only time the Logo may be used without making reference to a specific product is when it is

used to inform the public of the certification purpose of the mark. For example, a Partner may
display the Logo in a brochure, manual, or other document along ~vith a statement that reads,
"Look for the Logo on our products". This means that theproduct meets the ENERGY STAR
guidelines for energy efficiency." Similar statements include the following, "The symbol for
energy efficiency" or "Placed on products that meet the energy-efficiency guidelines set by the
EPA." In addition, under no circumstances shall the Name or Logo be used in a manner that
would imply EPA endorsement of the company, its products, or its services.
D. Logo Disclaimer Statement
As described in all of the MOUs, when the Logo is used by a Partner in connection with a product
or its advertising, it shall always be accompanied by the following statement: "As an ENERGY
STAR® Partner, (your company name) has determined that this product meets the ENERGY STAR®
guidelines for energy efficiency." The disclaimer statement must accompany the Logo, but it does
not have to appear side-by-side; the phrase may be placed where normal explanatory information
is found. For example, if the Logo is placed:
On print advertisements or posters: The disclaimer statement may be placed with other
standard trademark and registration information at the bottom of the advertisement where
other companies’ products are recognized (e.g., "Product X is a registered trademark of
XYZ Corp.; As an ENERGY STAR® Partner, XYZ Corp. has determined that this product
meets the ENERGY STAR® guidelines for energy efficiency.").
On brochures and manual: The phrase must appear with the first use and!or in the front
section with the recognition of other trademarks.
Directly on a product: when the Logo is applied directly to the product, Partner may
place this statement in the user’s manual or on the nameplate.
On the product packaging: The Partner is not required to include the disclaimer
statement on the packaging; rather, the Partner may use the disclaimer statement in the
user’s manual, or in other collatera! sales and marketing materials.
As a general rule:
The type must be visible -- at a minimum, 2.5 point type size.
The disclaimer statement may be translated into languages appropriate for the intended
end market of the product.

IV. REPRODUCTION OF THE LOGO:
The Logo is available in color and in black and white on disk in two graphic formats: .EPS
(Encapsulated Postscript) and .BMP (Bitmap). These files are for distribution to your
customer graphics department. The .EPS version can be used on both PC and Mac computers.
(.TIF format is also available upon request.)
As described in all of the ENERGY STAR MOUs, the Logo shall not be altered, cut apart, or
separated in any way. Following are more detailed guidelines:

The Logo may be resized, but please maintain the same proportions.
The colors of the 4-color Logo must be reproduced faithfully (4-cotor process).
The 4-color Logo may be reproduced in black and white shading.
The simplified outline or "line art" Logo may be reproduced in the following manner:
o black or white on solid colors
o one-color version in the color of your choice
o t~vo-color version, with colors from the 4-color version, e.g., blue and yello~v,
green-and blue, yellow and blue.
V. REGISTERED MARK
As noted above, the ENERGY STAR Name and Logo are registered marks of the EPA. When
using the ENERGY STAR Name or Logo in con~’-nunications and marketing materials, you must
adhere to the following:
When referring to the ENERGY STAR program or its Partners, the ENERGY STAR Name
must always be expressed in capital letters. It is also appropriate to use a slightly larger
point size for the first letter of each ~vord, e.g., twelve point for the E and S, and ten point
for the other letters -- ENERGY STAR.
The registered status of the marks must be indicated by including the registered symbol
(®) each time the ENERGY STAR Name or Logo appears in a brochure, advertisement,
poster, product packaging, etc. (i.e., ENERGY STAR®). (Please note that in EPA-
developed materials ~vhere the phrase ENERGY STAR is used repeatedly, such as the Logo
use guidelines, the registered symbol Will only appear once so as not to distract the
reader.)
The registered mark statement "ENERGY STAR is a U.S. registered mark" may also be used
in addition to the registered symbol above to indicate the registered status of the mark.
Similar to the disclaimer statement, the registered mark statement may be placed where

normal explanatory information is found (e.g., at the bottom of an advertisement or
poster, at the bottom of the relevant page in a manual or brochure, or on the product
packaging). ~
VI. OTHER ENERGY STAR LOGOS
It is likely that you have seen other versions of the Logo in the marketplace. These logos are
either obsolete or are for use with other ENERGY STAR programs.
The Logo is the only logo that Partners should use in connection with their products that are sold
internationally. This version of the Logo does not include any text or acronyms. Please call EPA
if you need a diskette copy of the Logo mailed to you.
Attached you will find a chart that may be helpful in determining the correct way you should
display the logo. It also displays the logos that are either, for use with other ENERGY STAR
progams, or are obsolete.

Appendix C --The City of Palo Alto Utilities Program Plan -- Draft
This document is intended as an example of the plan which will be negotiated between US DOE,
US EPA and its partners. Specific actions will differ according to the wishes of individual
companies.
A Memorandum of Understanding (MOU) has been executed by and bet~veen the U.S.
DEPARTMENT OF ENERGY (DOE), the U.S. ENVIRONMENTAL PROTECTION
AGENCY (EPA), and The City of Palo Alto Utilities in conjunction with The City of Palo Alto
Utilities’ involvement in the ENERGYSTAR Program. The MOU, dated [], outlines the
general terms of agreement for participating in the ENERGY STAR Program.
This Program Plan is an addendum to the Memorandum of Understanding. It details the working
relationship bet~veen DOE, EPA, and its Partner for the duration of the program. Specific actions
are listed here for DOE, EPA, and The City of Palo Alto Utilities.
EPA & DOE Responsibilities
DOE and EPA ~vill provide point of purchase materials to be used by The City of Pato
Alto Utilities to promote the ENERGY STAR program and products in retail stores.
EPA and DOE agree to work with The City of Palo Alto Utilities and its Manufacturer
and Retailer Partners to establish innovative promotional programs.
DOE and EPA agree to provide a hyperlink to The City of Palo Alto Utilities’ Internet
World Wide Web site from their Internet World Wide Web sites.

EPA and DOE agree to provide camera-ready or electronic file versions of the ENERGY
STAR logo that can be used in The City of Palo Alto Utilities’ promotional and advertising
activities, such as newspaper advertisements and bill stuffers.
DOE and EPA agree to list The City of Palo Alto Utilities’ partner stores on its toll-free
hotlines and Internet web site for customer reference.
DOE and EPA will provide The City of Palo Alto Utilities copies of training material to be
used by The City of Palo Alto Utilities’ staffwhen training sales staffon the ENERGY
STAR program. DOE and EPA will provide an introductory video for retail salespeople,
copies of sales training manuals which include a list of ENERGY STAR qualifying
products, and sets of laminated cards that have sales tips for marketing high efficiency
appliances.
The City of Palo Alto Utilities Responsibilities

The City of Pato Alto Utilities agrees to pay for any customized printing of point-of-
purchase promotional materials for the retail stores in its service territory.
To help DOE and EPA recognize and highlight The City of Palo Alto Utilities’
participation in the Program, and to provide camera-ready art~vork of the company logo
and/or company name to DOE and EPA for use in media advertising, e.g., newspaper
articles.

The City of Palo Alto Utilities agrees to provide a schedule for the start of the program
that includes signature of the MOU, address which to mail any promotional materials,
program implementation date, and start date for advertising.
The City of Palo Alto Utilities agrees to periodically monitor point-of-purchase displays
to ensure the accurate placement and labeling of appliances in retail partner stores.
The City of Palo Alto Utilities agrees to provide a list by manufacturer model number of
all qualifying products it sells (includes those on the floor and those others sold but not
floored).
The City of Palo Alto Utilities agrees to direct its training staffto participate in ENERGY
STAR sales training using the training materials provided by DOE and EPA (the
introductory video, sales training manual) to train retail sales staff.
The City of Palo Alto Utilities and/or its contractor agrees to submit all marketing
materials and template designs developed for The City of Palo Alto Utilities’ ENERGY
STAR promotions to EPA and DOE for review of accuracy of ENERGY STAR logo use
and consistency of the ENERGY STAR message. The City of Palo Alto Utilities xvill
allow a minimum of five fi.fll working days for EPA and DOE to review and approve
marketing templates.

ENERGY STAR~ License Agreement
An Agreement between 77~e City of Palo Alto Utilities and the U.S. Environmental Protection
Agency and the U.S. Departmeht of Energy
THIS MEMORANDUM OF UNDERSTANDING (MOU) is a voluntary agreement
bet~veen the U.S. DEPARTMENT OF ENERGY (DOE), the U.S. ENVIRONMENTAL
PROTECTION AGENCY (EPA), and The City of Palo Alto Utilities, the Utility Partner, in
conjunction with the Partner’s involvement in the ENERGYSTAR’~ Program. This agreement is
valid from the date of its signature through December 31, 2000, but may be extended beyond that
date. In addition, the above parties agree to establish an individual implementation plan, which
must be completed within two months after the MOU has been signed by all parties.
The primary purpose of this MOU is to create a public/private partnership to educate consumers
about hio~:ch-efficiency ENERGY STAR products that save energy, lead to reductions in
combustion-related air pollution, and reduce constmaer energy bills.
BACKGROUND
EPA and DOE have been directed by the President and the Congress to establish
programs to help reduce the national rate of greenhouse gas emissions and consumer energy
consumption and costs. DOE and EPA established the ENERGYSTAR program, a voluntary
partnership with retailers, manufacturers and utilities who work together to increase the purchase
of highly efficient appliances, consumer electronics, office equipment, windows and lighthag
through educational and promotional programs.
Under this agreement, the above parties will work together in promoting ENERGY STAR
qualifying products in the following ways:
1. EPA and DOE will provide The City of Palo Alto Utilities with information to help The
City of Palo Alto Utilities promote the purchase of highly energy efficient products. Product
categories covered in this program include refrigerators, clothes washers, dishwashers, room air
conditioners, computers, monitors, printers, fax machines, scarmers, multi-function devices,
televisions, video cassette recorders, windows and residential lighting fixtures that are marketed
for use primarily in residential buildings. Products are considered to be highly efficient if they
meet or exceed the ENERGYSTAR Target Levels, as established and designated by DOE or EPA.
Please refer to Appendix A for a list of ENERGY STAR qualifying products.
2. DOE and EPA will work with The City of Palo Alto Utilities to develop a plan that
describes the measures that each party will take in cooperatively promoting the purchase of
ENERGY STAR-qualifying pioducts. The City of Palo Alto Utilities may choose to participate
by promoting any or all ENERGYSTAR products. See Appendix C for a sample of a plan that

SUPPORTING THE U. S. DEPARTMENT OF ENERGY’S ENERGY
STAR® PROGRAM
WHEREAS,. the Environmental Protection Agency ("EPA") of the
United States Department of Energy ("DOE") has created a
collaborative program supported by retailers, manufacturers and
utilities to educate the general public about the use of high
efficiency consumer and office appliances, equipment and lighting;
WHEREAS, the City of Palo Alto ("City") has supported
programs that promote energy efficiency and conservation, and has
funded several programs through its Public Benefits Program; and
WHEREAS, the EPA, DOE and the City wish to enter into a
memorandum of understanding in furtherance of the goals and
objectives of the ENERGY STAR® PROGRAM;
The Council of the City of Palo Alto does hereby RESOLVE as
follows:
SECTION i. The City of Palo Alto hereby authorizes the
City’s participation in the federal government’s ENERGY STAR®
PROGRAM, and further authorizes the City Manager to execute the
memorandum of agreement entitled "ENERGY STAR® License Agreement"
on behalf of the City.
SECTION 2. The Counci! finds that the adoption of this
resolution does not constitute a project under the California
Environmental Quality Act.
