SUBJECT:Receipt of Outside Funds to Augment Capital Improvement Project
Budget, Art in Public Places (18617) -Budget Amendment
Ordinance
The purpose of this report is to request Council’s approval of an ordinance amending the
Capital Improvement budget for fiscal year 1996-97, to reflect the receipt of outside
contributions in the amount of $12,200 to the City’s Art in Public Places program.
RECOMMENDATIONS
Staff recommends that Council approve the attached Budget Amendment Ordinance, which
recognizes the receipt of outside funding contributed to the City of Palo Alto to augment the
City’s Art in Public Places program.
Funds have been received in support of two projects: Replacement of the Greg Brown mural
Roofhoppers (contribution of $6,500 from Restoration Hardware); and the California Avenue
project (received a combined contribution of $5,700 to date from twelve California Avenue
merchants).

This staff report indicates no policy implications.
The Public Art Commission identified two Public Art projects that they agreed to fund in
part, provided that outside funds be sought to support the two projects. The first project was
the restoration of the popular Greg Brown Mural The Roofhoppers, commonly referred to
as "The Burglars." Located at the former Wiedeman’s store at 281 University Avenue since
1975, the mural was scheduled to be destroyed as the property was remodeled to become
Restoration Hardware. Public Art Commissioners approached the owners of Restoration
Hardware for funding the commission of a replacement mural. Restoration Hardware agreed
to support the commission and presented a check to the Art in Public Places Capital
Improvement Account for $6,500. The total commission to Greg Brown for the replacement

mural, now located at ~ J0 Hamilton Avenue, was $10,0001~ ~2xpenditures for the mural
project were incurred in fiscal year 1996. The remainder of the costs was funded by the Art
in Public Places Capital Improvement account (18617).
The second project entailed commissioning an artist to provide for Califorhia Avenue. The
Public Art Commission entered a partnership with the California Avenue Area Development
Association (CAADA) to fund an artist competition and to commission an appropriate artist.
CAADA agreed to provide up to $7,500 to support the competition and artist commission.
The Public Art Commission will provide the balance. The remainder of the costs will be
funded by the Art in Public Places Capital Improvement account (18617). Contributions of
$5,700 have been received from twelve California Avenue merchants and CAADA, and
deposited in the Art in Public Places CIP account (18617). The Public Art Commission and
CAADA ultimately selected two artists; each will receive a commission of $15,000 (for a
total expense of $30,000). It is expected that both projects will be installed by mid-
November.
There is no fiscal impact. Funds have been received and placed in the Art in Public Places
CIP (18617) revenue account. These funds have been given to augment the Art in Public
Places program. To expend these funds appropriately, an adjustment for $12,200 needs to
be made to the Art in Public Places CIP budget.

ORDINANCE OF THE COUNCIL OF THE CITY OF PALO ALTO
AMENDING THE BUDGET FOR THE FISCAL YEAR 1996-97 TO
RECEIVE OUTSIDE FUNDS FOR THE CAPITAL IMPROVEMENT PROJECT
ART IN PUBLIC PLACES, NUMBER 18617
WHEREAS, pursuant to the provisions of section 12 of Article
III of the Charter of the City of Palo Alto, the Council on June
24, 1996 did adopt a budget for fiscal year 1996-97; and
WHEREAS, the Public Art Commission (Commission) agreed to help
fund two Public Art projects through Capital Improvement Project
18617, Art in Public Places, provided outside funding be sought to
support the projects; and
WHEREAS, the first project was the replacement of a mural on
the old Wiedeman’s Department Store which was destroyed when the
property was remodeled for a new business; and
WHEREAS, the new business, upon being approached, donated
$6,500 towards the cost of the new mural; and
WHEREAS, for the second project, the Commission, in partnership
with the California Avenue Development Association, agreed to
sponsor a competition to commission an art work for California
Avenue; and
WHEREAS, California Avenue merchants and the California Avenue
Development Association have donated $5,700 to date for this
project, and may donate further funds in the future; and
WHEREAS, City Council authorization is needed to amend the
1996-97 budget as hereinafter set forth.
NOW,~ THEREFORE, the Council of the City of Palo Alto does
ORDAIN as follows:
SECTIQ~ i. Revenue in the Capital Improvement General Fund is
increased by the sum of Twelve Thousand~ Two Hundred Dollars
($12,200) for the receipt of the donated funds.
SECTION 2. The sum of Twelve Thousand Two Hundred Dollars
($12,200) is hereby~appropriated to the Capital Improvement Project
18617, Art in Public Places, and CIP 18617 is correspondingly
increased.
SECTION 3. This transaction has no impact on reserves.
SECTION 4. As specified in Section 2.28.080(a) of the Palo
Alto Municipal Code, a two-thirds vote of the City Council is
required to adopt this ordinance.
SECTION 5. The Council of the City of Palo Alto hereby finds
that this is not a project under the California Environmental
Quality Act and, therefore, no environmental impact assessment is
necessary.
SECTION 6. As provided in Section 2.04.350 of the Palo Alto
Municipal Code, this ordinance shall become effective upon adoption.
